CITY OF PRIOR LAKE
ORDINANCE NO. 90-07
AN ORDINANCE AMENDING PRIOR LAKE CITY CODE AND PRIOR LAKE ZONING
ORDINANCE NO. 83-6.
The Council of the City of Prior Lake does hereby ordain:
I .
Section 5-3-3 of Chapter 3, Title 5, Prior Lake City Code, and
Section 3.2 of Prior Lake Zoning Ordinance No. 83-6 are hereby
amended by adding the following Conditional Use in the following
Districts:
R-1 Urban Residential
R-2 Urban Residential
R-3 Multiple Residential
R-4 Mixed Code Residential
16. Public parking lots
17. Public parking lots
13. Public parking lots
7. Public parking lots
II.
Section 5-3-3 of Chapter 3, Title 5, Prior Lake City Code, and
Section 3.2 of Prior Lake Zoning Ordinance No. 83-6 are hereby
amended by adding "8. Nursery schools and day care centers for
more than 12 children" as a Permitted Use in the R-l Urban
Residential District.
III.
Section 5-3-3 of Chapter 3, Title 5, Prior Lake City Code, and
Section 3.2 of Prior Lake Zoning Ordinance No. 83-6 are hereby
amended by adding "12. Wholesale plant nurseries" as a Permitted
Use in the C-1 Conservation District.
IV.
Section 5-5-2(A)3 of Chapter 5, Title 5, Prior Lake City Code,
and Section 6.2A3 of Prior Lake Zoning Ordinance No. 83-6 are
hereby amended to read as follows:
3. In R-l Residential areas, accessory structures shall not
exceed the coverage ratio of the principal structure or the
maximum of eight hundred thirty-two (832) square feet, whichever
is less.
V.
Section 5-6-5(A) of Chapter 6, Title 5, Prior Lake City Code,
and Section 7.5A of Prior Lake Zoning Ordinance No. 83-6 are
hereby amended by adding a new paragraph 4 to read as follows:
4. The names and addresses of all property owners within
five hundred feet (500') shall be provided by a
certification of an abstract company so that the Zoning
Officer may provide notification of the conditional use
permit application.
VI.
Section 5-6-6(A}1 of Chapter 6, Title 5, Prior Lake City Code,
and Section 7.6A1 of Prior Lake Zoning Ordinance No. 83-6 are
hereby amended to read as follows:
I. The names and addresses of all property owners within
one hundred feet (100') shall be provided by a certification
of an abstract company so that the Zoning Officer may
provide notification of the variance application.
VII.
Section 5-4-1(J) of Chapter 4, Title 5, Prior Lake City Code,
and Section 4.1J of Prior Lake Zoning Ordinance No. 83-6 are
hereby amended to read as follows:
(J)
Any principal structure situated on lands contiguous to
or abutting any portion of the public lakes in Prior
Lake shall maintain yard setbacks of seventy-five feet
(75') from the lake. Where principal structures on
adjacent lots have yard setbacks different from such
requirements, the minimum setback from the lake shall
be the avera~e setback of such adjacent structures to a
minimum of f1fty feet (50').
This ordinance shall become effective from and after its passage
and publication.
Passed by the City Council of the City of Prior Lake this 21st
day of May , 1990.
