Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT AUGUST 6, 2007 5D JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING A STREET NAME CHANGE FOR NORTH BERENS ROAD LOCATED NORTH OF THE SHEPHERDS PATH CAMPUS Introduction The purpose of this agenda item is to consider a request to change the name of North Berens Road to Kenna Circle. Historv On June 26, 2006, the City Council adopted Resolution 06-91 approving the final plat for Shepherd's Path. This final plat realigned McKenna Road so that it extends straight south to CSAH 42. The easterly leg of the original street has been renamed Shepherd's Path. A new street extending from McKenna Road on the west to the east property boundary was also created. This northerly segment of the former McKenna Road was named North Berens Road on the final plat. On September 11, 2006, the City received a petition to rename North Berens Road to McKenna Road. The petition was not processed immediately because the Council needed to reestablish the Naming Committee. On February 5,2007, the City Council disbanded the Naming Committee and delegated street naming tasks to the Planning Commission. Since renaming a platted street is an amendment to the approved final plat, the City Council must make the final decision. The Planning Commission's recommendation will be forwarded to the City Council. Current Circumstances The Planning Commission considered this petition on July 23,2007. The Commission heard testimony from three parties who signed the petition. These included two residents on North Berens Road and Kermit Mahlum, representing Shepherd's Path. The residents wished to change the name of North Berens Road back to McKenna Road. Mr. Mahlum testified that Shepherd's Path has no issues with changing the name of the road back to McKenna Road. They do not want to lose the Shepherd's Path name, and would like to keep the Berens name in the development. After much discussion, the Planning Commission determined that the street cannot include the name "McKenna" for public safety reasons. The Planning Commission recommended the name be changed to Kenna Circle on a 4-1 vote (Lemke voting no). The primary function of street names and addresses is to provide a unique identifier for each building, residential or commercial, in the City. This is the reason staff reviews street names on every proposed plat against the existing street names in the City. When the final plat was approved, the street was assigned a name, and addresses were assigned. The owners of the existing houses along this road were notified of their new addresses. In order to ensure any new name is consistent with public safety purposes, the petition and the proposed street name change was referred to the City public safety agencies and the 911 system for comments. Attached is a memorandum outlining their concerns. In summary, if North Berens Road is to be renamed, it should be something unique to the street system in Prior Lake. McKenna Road is not a viable option. Any new name should avoid prefixes such as "Old" or "North." FINANCIAL IMPACT: A change to the street name will affect both the existing properties and new development. It will require all property owners change their addresses to be consistent with the new name. In addition, new street signs must be ordered and installed. The staff recommends that Shepherd's Path, as the developer of the site, be responsible for the cost of the new street signs, including installation. ALTERNATIVES: 1. Adopt a resolution approving the change of the street name to Kenna Circle. 2. Deny the proposed street name change. 3. Table or continue discussion of the item for specific purpose. RECOMMENDED MOTION: A motion and second adopting a resolution changing the name of North Berens Road to Kenna Circle, subject to the following two conditions: 1. Shepherd's Path be responsible for the cost of the new street signs, including installation. 2. Before any renaming officially occurs, a duly authorized representative of Shepherd's Path shall sign a consent for the costs of the street signs and installation. 16200 Eagle Creek Avenue S.E. Prior Lake, MN 55372-1714 RESOLUTION 07 -xx Motion By: Second By: WHEREAS, The Prior Lake City Council has approved the final plat known as Shepherd's Path, which includes the right-of-way for North Berens Road; and WHEREAS, The City of Prior Lake received a petition to change the name of North Berens Road to McKenna Road; and WHEREAS, The Planning Commission considered this petition on July 23,2007, and heard comments from the petitioners; and WHEREAS, The Planning Commission determined the request to change the road name to McKenna Road was not consistent with the City's street naming policy or public safety; and WHEREAS, The Planning Commission recommended the road be renamed as Kenna Circle; and WHEREAS, For public health and safety reasons, no two streets should have the same name when they are not connected; and WHEREAS, Changing the name of North Berens Road to Kenna Circle will not have a detrimental effect on the City. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council approves the name change from North Berens Road to Kenna Circle, subject to the following conditions: a. Shepherd's Path be responsible for the cost of the new street signs, including installation. b. Before any renaming officially occurs, a duly authorized representative of Shepherd's Path shall sign a consent for the costs referred to in (a) above. Using a direction (such as "North") in a street name should be avoided. Such a name results in problems with the NWS records management system used by emergency personnel. 2. Duplicating a base street name (such as "Berens" or "McKenna") should be avoided. Both of these street names exist within the City of Prior Lake, outside of the Shepherd's Path development. Repeating the names can cause confusion for public service personnel when responding to emergency situations. Additionally, the realignment of McKenna Road through the Jeffers/Wilds area and north into the City of Shakopee has been a long-standing project in Prior Lake. Now complete, McKenna Road has a generally straight, north/south alignment, stretching approximately 1.2 miles, and providing frontage for nearly 40 Prior Lake properties with McKenna Road addresses. Having the road bend 900 at a stop sign, to continue the name along the current North Berens Road alignment, would create confusion both for public safety officials and the general public traveling in the area. It should be taken into consideration that the residents who have petitioned for a street name change have already changed their addresses once as a result of the Shepherd's Path plat. It will be an inconvenience for them to change addresses again. However, if another name change is to be undertaken, in the interest of public safety, it is recommended that the new name for North Berens Rd NW not contain either "McKenna" or "Berens," in keeping with the two issues discussed above. Both Lyn at Scott Co and Cindy in the PD have been aware of the issue since the beginning. In general, the concerns expressed have been: - not having "NORTH" (or any direction) begin a street name (causes trouble with the records mgmt system) - both "McKENNA" and "BERENS" are already in use on other street names and really should not be used again Please let me know if you want something more formal/in writing from any of us. I've also been asked by the Sheriff's Records staff to eliminate street directions such as "North" from street names, because it causes confusion with the NWS records management system. Just an FYI. Maybe Cindy has found a way around that particular issue. But we're hoping that the "North" part of the second keeps it from being confused with the first. And there might be a change to the name "North Berens Rd NW" anyhow. There were some homeowners affected by that platted street name change, who have since submitted a petition to change the name, again. The City has a naming committee that is supposed to meet sometime this month, and I fully intend to make it a better situation when all is said & done. We'll keep you posted. Hi Judy - I just had an email from one of the dispatchers requesting I check an address that had been changed from McKenna Rd NW to North Berens Rd NW (Shepherds Path Addition). While looking for the "Berens", I noticed a NW Berens Ct in the Berens Woods Addition. I don't know if any permits have been pulled on Berens Ct yet... I am wondering if emergency responders might have an issue with this? The house numbers are 4 digit for North Berens Rd and 5 digits for Berens Ct, but the similarity in names might become a problem.
