CONSIDER APPROVAL OF AN ORDINANCE ADOPTING THE 2007 STATE
BUILDING CODE, THE 2006 INTERNATIONAL BUILDING CODE AND
DELETING SECTIONS 401.105,401.700,401.701,401.702,401.704 AND
401.705 OF THE CITY CODE
Introduction
Effective as of July 10, 2007, the 2007 Minnesota State Building Code has
been amended by adopting Chapter 1305 which adopted the 2006
International Building Code. This is the code the city must now adopt and
enforce. We are proposing the Council adopt the 2007 Minnesota State
Building Code.
Also by deleting Sections 401.105,401.700,401.701,401.702,401.704 and
401.705 of the City Code will provide necessary housekeeping to the Prior
Lake City Code.
History
Chapter 561 of the 1972 Sessions Laws established the Minnesota State
Building Code which superseded all municipal building codes and became
effective July 1, 1972. All metropolitan area municipalities must adopt the
state Building Code which in turn adopted the Uniform Building Code. As new
State Building Codes are adopted, Prior Lake is required to incorporate the
new provisions into their ordinances. However, the adoptions of appendices to
the Minnesota State Building Code are a local option.
At the June 2, 2003 City council meeting, Ordinance 03-07 was passed
amending Title 4, Chapter 1, of the Prior Lake City Code. The amendment
adopted the 2000 Minnesota State Building Code which includes Chapter 1305
which adopted the 2000 International Building Code.
Current Circumstances
Effective as of July 10, 2007 the 2007 Minnesota State Building Code has
been amended by adopting Chapter 1305 which adopted the 2006
International Building Code. The International Building Code is the
amalgamation of three different codes intended to address most of the building
types around the world. This is the code the city must now adopt and enforce.
The 2007 Minnesota State Building Code is more understandable in the
verbiage than that which was in the 2003 Minnesota State Building Code. An
item that was added to the 2007 Minnesota State Building Code which is
considerably different than the previous Code is the addition that two family
and townhouse dwelling units over 9,250 square feet of floor area will now be
required to have a fire suppression system installed. This code addition will
increase the cost of such buildings.

MOTION:
The appendices we are recommending for adoption are the same as in
previous years except for those which have now become part of the code.
In housekeeping measures, Section 401.106 is being moved to Section
401.104 and pertains to erosion control plans, referencing guidelines outlined
in outdated material from the Minnesota Pollution Control Agency and is being
replaced by guidelines outlined in the City of Prior Lake Public Design Manual
which was adopted at the July 16, 2007 City council meeting. Section 401.105
is being deleted for the reason that the 1-2 light Zoning District no longer exists.
The entire Section 401.700 is being deleted because it was included in Section
1109.600 of the City of Prior Lake Zoning Code, effective May 1, 1999.
Conclusion
Minnesota Statues Sections 16B.62 mandates that the City of Prior Lake shall
adopt the Minnesota State Building Code. Deleting Sections 401.105, 401.700,
401.701,401.702,401.704 and 401.705, will provide necessary housekeeping
to the Prior Lake City Code.
We are recommending that the City retain the fee schedule which was
incorporated in the 2003 code. We believe that this fee schedule reflects the
actual costs incurred by the City for delivering services. As many as 14
separate inspections can be associated with each new structure. The permit
issuance, inspection and recordkeeping process requires the services of
persons in Building Inspection, Planning, Engineering, Finance and often
Public Works. Customer Service and complaints associated with constructing
buildings can also involve Police, Fire and Administration. The involvement of
these many departments creates costs which are recovered through building
fees.
The City Council has three alternatives:
1. Adopt Ordinance 07 -XX Adopting the 2007 State Building Code and 2006
International Building Code, and Deleting Sections 401.105, 401.700,
401.701, 401. 702, 401.704 and 401.705, Approving Amendments to the
Prior Lake City Code Section 400.
2. Deny Ordinance 07 -XX and Deleting Sections 401.105, 401.700, 401.701,
401. 702, 401.704 and 401.705, Approving an Amendment to Section 400
of the Prior Lake City Code.
3. Defer this item and provide staff with specific direction.

The City Council of the City of Prior Lake does hereby ordain that:
1. Section 401.101 of the Prior Lake City Code is hereby amended by adding the
language in bold underline and deleting the language with a strike line as follows:
