MN 55372-1714 CITY COUNCIL AGENDA REPORT August 6, 2007 9E ~I Frank Boyles, City ManagerJ( CONSIDER APPROVAL OF A RECOMMENDATION AMENDING THE PROCESS FOR PREPARING A DOCK LOCATION AND MARINA POLICY I ORDINANCE Introduction The purpose of this agenda item is to request Council modification of the process for preparing a policy on dock location and ordinance refinements for marinas. Historv At its last meeting, the City Council directed the staff to refer the above matters to the Lake Advisory Committee for investigation and recommendations. Current Circumstances Representatives from Public Works, Planning and Administration have had discussion on this topic. The conversation suggested to us that discussion of this topic should not be limited to the Lake Advisory Committee, but also include the Planning Commission. Rather than referring the dock location policy preparation matter and marina ordinance clarification to the Lake Advisory Committee only, it is recommended that a committee of two Lake Advisory and two Planning Commissioners be formed, The committee would complete the analysis and submit recommendations to the City Council. A recommended policy and ordinance would be provided to the committee by the staff. There are various reasons for this recommendation which are enumerated below: · It is beneficial to continue to have the input and knowledge which the Lake Advisory Committee has garnered from its investigation of this topic to date. · There is another perspective (planning) which has not been part of the discussions to date. · The Planning Department, rather than Engineering, has the first-hand customer experience with these issues. · Whether a policy or ordinance is to be written, Planning should be involved as they are likely to be responsible for enforcement. · Given the magnitude of the issue, a more comprehensive recommendation is likely by including input from both bodies. · Since we now know a policy is desired for dock location and an ordinance refinement for marinas; the staff can prepare draft language for consideration by the committee to facilitate completion of this task. www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 FINANCIAL IMPACT: There is no appreciable added expense created by this recommendation. ALTERNATIVES: 1. Take no action, effectively leaving the matter referred to the Lake Advisory Committee as originally contemplated. 2. Approve by motion and second a change in the approach which would call for the creation of a committee composed of two members each from the Lake Advisory Committee and the Planning Commission to prepare recommendations on a dock placement policy and a marina ordinance based upon draft recommendations prepared by the staff.
