Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT August 20, 2007 10B Angie Barstad, Recreation Coordinator CONSIDER APPROVAL OF A RESOLUTION APPOINTING MEMBERS TO THE PARKS ADVISORY COMMITTEE. Introduction The purpose of this agenda item is to request City Council approval of appointments to the Parks Advisory Committee to fill vacancies for a one-year term expiring October 30, 2008; and two (2) three-year terms expiring October 30, 2010. Historv There are currently three vacancies on the Parks Advisory Board due to resignations for various personal and scheduling issues. Members submitting their resignations include Dick Carlson, Cary Grayson, and Todd Loose. In order to fill the vacancies, staff placed notices in the local newspapers and on the Website for candidates. Current Circumstances The City received three applications. On July 19, 2007, a committee consisting of Recreation Coordinator Angie Barstad, City Councilor and PAC Liaison Steve Millar, Asst. City Manager Kelly Meyer and PAC Chair Mike Feriancek conducted interviews of the three applicants. After conducting the interviews, the panel believes that each of the candidates would bring a different perspective to the Park Advisory Committee, and that each were well-spoken, enthusiastic, and believed they could meet the commitment to be a contributing member of the Parks Advisory Committee. Following are the applicants and the recommended appointments. . Dan Ruhme - Recommended for three-year term (ending 10/31/2010) . Ron Ceminsky - Recommended for three-year term (ending 10/31/2010) . J. Kyle Haugen - Recommended for one-year term (ending 10/31/2008, but then eligible for two additional three-year terms). Conclusion The City Council should determine if it concurs with the appointments recommended by the interview committee. Council member Millar is available to respond to questions. A copy of the applications submitted is attached. Only one of the proposed appointments raise an issue which the Council should consider. The purpose of having term limits is to encourage new perspectives and volunteers on advisory bodies. In the case of the Parks Advisory Committee, the term limit is six years (2 - 3 year terms). PAC applicant Ron Ceminsky has previously served on the Parks Advisory Board from 1990 - 2001, and previously reached his term limit. Six years have elapsed since his last participation as a PAC member. The issue before the Council is whether applicants who have previously reached their term limit are eligible for re-appointment. For consistency and ease of administration, whichever direction the Council provides should be applied to the Lake Advisory Committee and Planning Commission as well. The Council has two options: 1. Declare that the applicant is eligible for re-appointment after a vacancy from the committee for a period of "x" years, and direct staff to amend all advisory committee bylaws accordingly. 2. Declare that the applicant is not eligible for re-appointment once they have reached a term limit. The interview committee is recommending that applicants be eligible for re- appointment after five years have elapsed since the last time they served on the committee. This approach meets the intent of term limits in that it provides the opportunity for new people to participate and also provides the City an opportunity to take advantage of a former member's experience if they choose to re-apply and go through the selection process when a vacancy occurs. The attached resolution provides for the appointments of the three applicants to the Parks Advisory Committee for the terms noted above, and directs staff to amend the Parks Advisory Committee, Lake Advisory Committee and Planning Commission bylaws to permit re-appointment to an advisory committee after a period of five years following their term limit. If the Council desires to take a separate action, it should direct staff to bring a resolution back to the Council at its August 20 meeting. ALTERNATIVES: 1. Motion and Second to adopt Resolution 07 -XX appointing three members to the Parks Advisory Committee and directing staff to amend advisory committee bylaws. 2. Take no action on the appointments and direct staff accordingly. RECOMMENDED MOTION: Alternative #1. A RESOLUTION APPOINTING MEMBERS TO THE PARKS ADVISORY COMMITTEE AND DIRECTING STAFF TO AMEND ADVISORY COMMITTEE BYLAWS RELATED TO ELIGIBILITY FOR RE-APPOINTMENT. Motion By: Second By: WHEREAS, Three vacancies have occurred on the Parks Advisory Committee; and WHEREAS, Applications were solicited from members of the community who are interested; and WHEREAS, Notice of such openings were placed in the local newspapers and City Website; and WHEREAS, Applications were received and applicants interviewed in accordance with the advisory body bylaws, and WHEREAS, The Council desires to appoint the most qualified and experienced applicants that can best serve the needs of the Prior Lake residents. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. City Council has determined that applicants who have reached their term limit may be eligible for re- appointment to the committee after a period of five years of inactivity on that particular body.
