MINUTES OF THE CITY COUNCIL
May 7, 1990
The Common Council of the City of Prior Lake met in regular
session on Monday, May 7, 1990 at 7:30 p.m. in the City Council
Chambers. Present were Mayor Andren, Councilmembers Fitzgerald,
Larson, Scott, White, City Manager Unmacht, City Engineer
Anderson, City Planner Graser, Assistant City Planner Garross,
Assistant City Manager/Economic Development Director Schmudlach,
and city Attorney Kessel.
Mayor Andren called the meeting to order and asked everyone to
rise for the pledge of allegiance and welcomed the audience.
The minutes of the April 16, 1990 Council meeting were reviewed
by Council.

The next order of business was: Presentation of the Third Annual
"Employee of the Year Awards". city Manager Unmacht explained
the criteria required for the award and presented the plaques to
Assistant city Engineer Bruce Loney and Building Official Gary
staber. council congratulated both individuals for receiving the
award.
The next order of business was: consider Variance and V~ance
Administrative Plat Application for Grant Leonard. Assistant to~
city Planner Garross presented an overhead of the area and [;~WU
explained the details of the variance and Administrative Plat. A Leon~d
short discussion followed with regard to the roadway easement and
hydrant.
MOTION BY WHITE, SECONDED BY SCOTT, TO APPROVE THE VARIANCE AND
ADMINISTRATIVE PLAT FOR GRANT LEONARD LOCATED AT LOT 1 & 2,
CONDON'S WOOD DALE & PART OF TRACT J, R.L.S. #71 CONTINGENT UPON
THE FOLLOWING CONDITIONS: 1.) PAYMENT OF THE $469.00 PARK
DEDICATION FEE; 2.) THAT THE PROPERTY OWNER GRANT THE CITY OF
PRIOR LAKE A PERMANENT EASEMENT FOR WATERMAIN AND UTILITY
PURPOSES; 3.) THAT THE LEGAL DESCRIPTION FOR TRACTS A AND B BE
AMENDED TO REFLECT THE 20 FOOT DRIVEWAY WHICH IS PART OF THE PLAT
OF THE FIRST ADDITION TO CONDON'S WOOD DALE; 4.) THAT THE
PROPERTY OWNER BE RESPONSIBLE FOR RELOCATION OF THE FIRE HYDRANT
IN HOPE STREET TO ACCOMMODATE A DRIVEWAY TO TRACT B.

The next order of business was: Consider Approval of Zoning Code Zoninf}
Amendments. City Planner Graser presented details concerning the Code
proposed amendments. A Public Hearing was held on April 19, 1990 Am~~
by the Planning Commission recommending approval of all
amendments except amendment number 5. The Council discussed the
amendments individually and voted on each one separately.
AMENDMENT NO.1:
Section 3.2 of Prior Lake Zoning Ordinance No. 83-6 and Section Amend #1
5-3-3 of the Prior Lake City Code is proposed to be amended to
include ~ublic parking lots as a conditional use in R-1 Urban
Residentlal, R-2 Urban Residential, R-3 Multiple Residential, and
R-4 Mixed Code Residential Districts. Council discussion
occurred regardin9' principle use. Council determined that the
first sentence ln the amendment should read: "The objective is
to make this Ordinance applicable when public parking lots are a
princi~le use in R1-R4 residential districts." In other words, a
conditlonal use permit should be re9uested when the parking lot
becomes the principle use for a locatlon in a R-1-R4 residential
district, i.e. DNR public access at Kent Street.

NO. 1 WITH THE WORDS "PRINCIPLE USE" ADDED AFTER THE WORDS Ap~oved
PUBLIC PARKING LOTS .

White, the motion passed unanimously.

AMENDMENT NO.2:
section 3.2 of the Prior Lake Zoning or~inance No. 83-6 and
section 5-3-3 of the Prior Lake city Code lS proposed to be
amended by adding "Nursery Schools and Day Care centers for more
than twelve (12) children", as a permitted use in the R-1 Urban
Residential District. This amendment wou1d make our code
consistent with State Law. Council discussion occurred.

NO.2.
Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and
White, the motion passed unanimously.
AMENDMENT NO.3:
section 3.2 of the Prior Lake Zoning Ordinance No. 83-6 and
Section 5-3-3 of the Prior Lake City Code is proposed to be
amended to include "Nurseries" as a permitted use in the C-1
Conservation District.
MOTION BY LARSON, SECONDED BY WHITE, TO APPROVE AMENDMENT NO. 3Amend. #3
WITH THE WORD "WHOLESALE" INCLUDED BEFORE THE WORD "NURSERIES". Ap~oved
Council discussion occurred.
Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and
White, the motion passed unanimously.
AMENDMENT NO.4:
section 6.2A(3) of the Prior Lake Zoning Ordinance No. 83-6, and Amend. #4
section 5-5-2 (A)3 of the City Code is proposed to be amended
increasing the size for accessory structures from eight hundred
(800) square feet to eight hundred thirty two (832) square feet
maximum.
MOTION BY FITZGERALD, SECONDED BY LARSON, TO APPROVE AMENDMENT
NO.4, WITH THE ADDITION OF THE WORD MAXIMUM AT THE END OF THE
SENTENCE.
Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and
White, the motion passed unanimously.
It was the consensus of the Council to put Amendment No. 5 at the
end of the amendments for discussion purposes.
AMENDMENT NO.6
section 7.5A of the Prior Lake zoning Ordinance No. 83-6 and Amend. #6
section 5-6-5(A) of the Prior Lake City Code are proposed to be
amended to require that a name search be conducted on all
property owners located within five hundred (500) feet of the
conditional use site by a certified abstract company. Council
discussion occurred.

AMENDMENT NO. 7
section 7.6A(1) of the Prior Lake Zoning Ordinance No. 83-6 and
section 5-6-6(A)1 of Prior Lake City Code are proposed to be
amended to re9Uire that a name search of all property owners
located withln one hundred (100) feet of the boundaries of the
variance application site be conducted by a certified abstract
company. Council discussion occurred.

white, the motion passed unanimously.
AMENDMENT NO. 8
section 4.1J of Prior Lake zoning Ordinance No. 83-6 and section
5-4-1(J) of the Prior Lake City Code are proposed to be amended
to add the word "principle" after the first word in the second
sentence of paragraph J. The second sentence would read as
follows: "Where principle structures on adjacent lots have yard
setbacks different from these requirements, the minimum setback
from the lake shall be the average setback of such adjacent
structures to a minimum of fifty (50) feet." Council discussion
occurred.
MOTION BY SCOTT, SECONDED BY WHITE, TO APPROVE AMENDMENT NO.8.
Amend. #8
Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and
White, the motion passed unanimously.
AMENDMENT NO. 5
section 4.2 of the Prior Lake Zoning Ordinance No. 83-6 and
section 5-4-1 Lot and Yard Requirements of the City Code was
~roposed to be amended to create the minimum residential lot size
ln both A-1 and C-1 districts of 2.5 acres.
Cit~ Planner Graser commented that this amendment is to make the
minlmum residential lot size in both A-1 and C-1 districts 2.5
acres. Graser indicated that Gary Staber, Prior Lake Building
Official, is of the opinion that the current 1 acre lot size in
A-1 districts is too small for adequate on-site sewage treatment

options. The minimum lot size in the C-l district is currently
10 acres for all uses. According to Graser, in concept the
districts serve the same purpose, hence, it is recommended that a
consistent size of 2.5 acres be established for all C-1 and A-1
zones with a minimum width of 150 feet. In addition, Graser
pointed out that densities in both zoning districts would not
change, only the lot sizes.
Councilmembers had varying opinions on specifics of this
amendment, but concurred that this amendment needs further
research for future land development requests that may come
before the city. Extensive discussion occurred on many options
for rural residential development.
MOTION BY LARSON, SECONDED BY FITZGERALD, TO DENY THIS
UNTIL STAFF CAN RESEARCH AND RESTRUCTURE THE AMENDMENT.

Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and
White, the motion passed unanimously.
A short recess was called.
The meeting reconvened at 9:03 p.m.
The next order of business was: Receive Update on Centennial
Committee Activities. Assistant City Manager/Economic
Development Director Schmudlach briefly reviewed the activities
of the upcoming 1990 Lakefront Days and 1991 Centennial with
regard to fund raising events, type of events and community
involvement.

Under Other Business the following topics were discussed:
Cit~ Manager Unmacht commented that the May 23 Le~l~ve
Leg1slative Wrap Up Session will include laws that will W~apU~
impact the cities local state aid distribution. 5~~~on
City Manager Unmacht commented on the A.M.M. Annual
meeting May 16 in Arden Hills. Councilmember White is a
candidate at this time for the A.M.M. Board.

A brief report was made regarding a successful Clean
Day held Saturday, May 5, 1990.
Councilmember White stated that bids for transit service
for the Minnesota Valley Transit Authority were extended
for a week.

Councilmember Scott stated that Mr. Dux of Prior Lake Dux
called regarding a stop sign at Crossandra and Itasca inC~o~~~a
Brooksville Hills. and J:tMca
Councilmembers requested that Planning Staff research
the issue of similar exterior house construction and
report back in thirty days on options for the City
Council.
