HomeMy WebLinkAbout8A - Acquistion of Tax Forfeit Lands AGENDA #: PREPARED BY: SUBJECT: DATE: INTRODUCTION: DISCUSSION: STAFF AGENDA REPORT SA JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF RESOLUTION #97-XX PERTAINING TO THE ACQUISITION OF TAX FORFEITED LANDS FEBRUARY 3, 1997 The purpose of this item is to consider City acquisition of tax forfeited parcels. The Scott County Auditor recently submitted a list of properties in the County which will be on the next tax forfeiture sale. The City has the opportunity to request a specified use deed from the State for any of these parcels. A specified use is defined as any public use. If the City does not request a specified use deed, the City may also purchase fee title to the property at market value. Several parcels of land in the City of Prior Lake are currently in tax forfeiture (as shown on attached Exhibits A-D). The Development Review Committee has reviewed these parcels on the basis of whether there is a public need to acquire the land. The staff recommends the following be acquired through a specified use deed: · 25-133-001-0 and 25-133-002-0: These parcels, shown on Exhibit A, are located north of Spring Lake and adjacent to Spring Lake Regional Park. There is a wetland and a pond on the parcels. The City has tried to acquire an easement on these parcels in the past, but the property owner would not sign the easement. If the County does not want the parcels, it is in the public interest for the City to acquire them. · 25-063-003-0: This is a 66' wide strip of land extending west from Island View Park to Arctic Lake (see Exhibit 8). The Comprehensive Plan identifies a need for a trail from this park to Arctic Lake. · 25-934-012-0: This is a 16.5' strip of land extending south from CR 82 to Arctic Lake (see Exhibit 8). The Planning Commission found that the proposed public need for the above-listed parcels is in compliance with the Comprehensive Plan. Furthermore, these parcels may be acquired without any cost to the City. The Planning Commission recommends the City proceed to acquire the above-listed parcels through a specified use deed. All other parcels on the Tax Forfeit List (Exhibit C) will be sold by the County to private parties at their market value. ALTERNATIVES: The Council has the following alternatives: 1. Approve Resolution #97-XX 2. Deny Resolution #97-XX 3. Defer action on this item and request the staff provided specific information. RECOMMENDATION: The staff recommends Alternative #1. I:\deptwork\taxforcc.doc Page 2 RESOLUTION 97-XX RESOLUTION PERTAINING TO THE CITY ACQUISITION OF TAX FORFEITED PARCELS MOTION BY: SECONDED BY: WHEREAS, the Scott County Auditor has submitted a list of properties, shown on Exhibit C, that will be on the next tax forfeiture sale; and WHEREAS, Minnesota Statutes allow the City to request a specified use deed from the State for a property on the tax forfeiture list; and WHEREAS, the City Planning Commission has reviewed this list and determined there is a specified need for four of the these parcels (shown on Exhibit A and B); and WHEREAS, the City Planning Commission has determined the City acquisition of these parcels is consistent with the goals and the policies of the 2010 Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council that a specified use deed for each of the following parcels should be acquired: · Parcel #25-133-001-0: This parcel, shown on Exhibit A, is located north of Spring Lake and adjacent to Spring Lake Regional Park. There is a wetland and a pond on the parcels. The City has a specified use for a storm water detention pond on this parcel. · Parcel #25-133-002-0: This parcel, shown on Exhibit A, are located north of Spring Lake and adjacent to Spring Lake Regional Park. There is a wetland and a pond on the parcels. The City has a specified use for a stormwater detention pond on this parcel. · Parcel #25-063-003-0: This is a 66' wide strip ofland extending west from Island View Park to Arctic Lake (see Exhibit B).
