PUBLIC HEARING TO CONSIDER APPROVAL OF
RESOLUTION 97 -XX ORDERING THE 1997 IMPROVEMENT
PROJECTS AND PREPARATION OF PLANS AND
SPECIFICATIONS THEREFORE.

SUBJECT:
INTRODUCTION:
The purpose of this agenda item is to conduct a public hearing for
the 1997 Capital Improvement Program (CIP) projects that require
the City to follow the Minnesota Statutes (MS), Chapter 429
process. These projects are: Pike Lake Trail; Mushtown Road;
and CSAH 42. Also, as part of this item Council will consider a
resolution to order these improvements and authorize the
preparation of plans and specifications therefore.
BACKGROUND:
On January 21, 1997, Council passed Resolution 97-03 ordering
the preparation of a feasibility report for those projects in the 1997
CIP required to follow the MS Chap. 429 process. The projects
studied in the report were: Mushtown Road, Pike Lake Trail,
CSAH 42, Street Sealcoating, and Lakefront Park Incremental
Improvements. The recommendation of the feasibility report was
to proceed with Mushtown Road, Pike Lake Trail, and CSAH 42.
The street sealcoating was determined not to be cost effective this
year. The Lakefront Park incremental improvements were
dropped due to the passage of the Parks referendum. On March
3, 1997, Council passed Resolution 97-11 accepting the feasibility
report and calling for a public hearing on the 1997 improvement
projects.
DISCUSSION:
The Public Hearing will cover the following three projects:
Mushtown Road, Pike Lake Trail (south of CSAH 42), and CSAH
42. Details of the projects and proposed financing will be
presented to the public at the hearing.
Financing of the improvements are recommended as follows:

The only properties on the projects subject to assessments are:
the Wood ridge Estates 3rd Addition development, and one lot in
the Windstar development on Mushtown Road; the Wensmann
property, and Holy Cross Church on Pike Lake Trail. Each of the
affected property owners has been notified and provided an
opportunity to discuss the projects with staff prior to the Public
Hearing.
The Feasibility Report recommended various financing sources.
The use of collector street funds for Mushtown Road and Pike
Lake Trail has been changed. The current plan is to increase the
proposed bond portion on Mushtown Road and use State-Aid
funds for Pike Lake Trail. Mushtown Road will include an
alternate bid item to extend the improvement to the Ponds access
road. Notwithstanding the change in funding, it is still
recommended to include the alternate bid item at this time and
determine at the time of bid opening/consideration whether to go
forward with the work based on available funding.
Anticipating that Council will order the improvements and in the
interest of project schedules, staff requested fee proposals for the
preparation of plans and specifications for Mushtown Road and
Pike Lake Trail (The County will prepare the CSAH 42
improvement plans) from three engineering firms: Maier, Stewart
& Associates (MSA) , Pioneer Engineering, and Rieke, Carroll,
Muller & Associates (RCM). The proposed fees were as follows:

Upon review of the proposals it was determined that MSA's fee
proposal, not to exceed $30,400, was in the best interests of the
City. Although RCM's fee was $500 less we were concerned
about having a new firm working with the City on these particular
projects due to the aggressive schedule. MSA is familiar with the
City, our standards, and our procedures. As professional services
are not subject to competitive bidding requirements we

determined that the $500 difference was not substantial enough to
outweigh our schedule concerns.
There are three alternatives for the City Council to consider:
1. Conduct the Public Hearing and approve Resolution 97-XX
which orders the 1997 Improvements and authorizes Maier
Stewart and Associates to prepare plans and specifications for
Mushtown Road and Pike Lake Trail.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

1. Conduct a Public Hearing on the 1997 Improvements.

RESOLUTION 97-XX
ORDERING 1997 IMPROVEMENTS AND PREPARATION OF PLANS
FOR MUSHTOWN ROAD (PROJECT 95-07), PIKE LAKE TRAIL (PROJECT 97-17)
AND CSAH 42 (PROJECT 95-09)

WHEREAS, pursuant to resolution 97-11 which the City Council adopted on March 3, 1997,
calling for a Public Hearing to be held on the 1997 Improvement Projects which
include the following improvements and generally described project areas:
1. Mushtown Road from approximately 1,400 feet south of Tower Street to
the southeast for 2,900 feet to a point approximately 800 feet beyond
Ridgewood Court by the construction of grading, storm sewer, aggregate
base, concrete curb and gutter, trails, bituminous surfacing, and
appurtenant work; and
2. Pike Lake Trail from CSAH 42 south to the proposed north plat line of
Knob Hill by the construction of grading, storm sewer, utility
improvements, concrete curb and gutter, sidewalk, bituminous surfacing,
and appurtenant work; and
3. CSAH 42 from Ferndale Avenue west to McKenna Road by the
construction of grading, storm sewer, aggregate base, concrete curb and
gutter, trunk sanitary sewer and watermain, trails, bituminous surfacing,
and appurtenant work; and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given,
and the hearing was held on the 7th day of April, 1997, at which all persons
desiring to be heard were given an opportunity to be heard thereon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. Such improvements are hereby ordered as proposed in the Council
Resolution 97-11 adopted the 3rd day of March, 1997.
2. The City Engineer and MSA Consulting Engineers are hereby designated
as the Engineer for these improvements. The Engineer shall prepare
plans and specifications for the making of such improvements.
3. MSA Consulting Engineers is hereby authorized to prepare plans and
specifications for Mushtown Road and Pike Lake Trail for a fee not to
exceed $30,400.
