CONSIDER APPROVAL OF ORDINANCE 97-XX AMENDING
SECTIONS 3-1-9, 3-2-5 & 3-13-3 OF THE CITY CODE TO
PROVIDE FOR THE COLLECTION OF A LATE FEE FOR
RENEW AL LICENSES
JANUARY 6, 1997
The City Council directed Staff to implement a late fee for
processing the annual business license renewals for cigarette, liquor
and refuse haulers licenses. Attached for your consideration is
Ordinance 97-XX which would impose a late fee of $50.00 for those
businesses that did not submit a timely renewal application.
These licenses all renew at the same time of year either on January
1 st for the cigarette licenses or July 1 for liquor and refuse haulers
licenses. The premise for charging a late fee is based upon the extra
cost associated with re-processing an applicant's material twice plus
the additional scheduling requirement at a subsequent council
meeting.
Staff has proposed that the license renewal application, license fee
and required insurance documents be submitted to the City no later
than 45 days prior to the expiration of the license. Failure to submit
within this time span would result in the $50.00 late fee being
applied.
The following alternatives are available to the City Council:
1. Approve Ordinance 97-XX Amending Sections 3-1-9, 3-2-5 &
3-13-1 of the City Code to Provide for the Collection of a Late Fee
for Renewal Licenses.
2. Approve Ordinance 97-XX subject to changes agreed to by the
City Council.
RECOMMENDATION: Staff would recommend the approval of Ordinance 97-XX
Amending Sections 3-1-9, 3-2-5 & 3-13-1 of the City Code to
Provide for the Collection of a Late Fee for Renewal Licenses. The
implementation of the late fee should help avoid and reduce
additional administrative costs while encouraging prompt license
renewal submission.

Motion to approve Amending Sections 3-1-9, 3-2-5 & 3-13-1 of the
City Code to Provide for the Collection of a Late Fee for Renewal
Licenses as part of the consent agenda would be in order.

ORDINANCE NO. 97-
An Ordinance Amending Sections 3-1-9, 3-2-5, 3-13-3
and 8-1-3-2 of the City Code to Provide for the
Collection of a Late Fee for Renewal Licenses
WHEREAS, it is unlawful to operate a business or carry on an activity for which a
license is required without first obtaining a license; and
WHEREAS, all City licenses are issued for a period of one (1) year; and
WHEREAS, failure to file an application for renewal of a license, and to pay the
required fees prior to the expiration of the license period imposes an administrative burden on
City staff and City Council in processing, investigating and considering approval of a renewal
application.
NOW THEREFORE, be it ordained by the Prior Lake City Council that:
1. Title 3, Chapter 1, Section 3-1-9 of the City Code is amended to add:
Section 3-1-9 (C) License Required. Any person intending to apply to renew a
liquor license must submit a renewal application, on a form provided by the City,
and pay the application and license fee. A license renewal application, and
license fee must be submitted to the City no later than forty-five (45) days prior
to the expiration of the license.
Section 3-1-9 (D) Late Fee. A late fee of Fifty Dollars ($50.00) will be imposed
on any licensee who fails to submit a timely renewal application.
2. Title 3, Chapter 2, Section 3-2-5 is amended to add:
Section 3-2-5(C) License Required. Any person intending to apply to renew a
wine license must submit a renewal application, on a form provided by the City,
and pay the application and license fee. A license renewal application and license
fee must be submitted to the City no later than forty-five (45) days prior to the
expiration of the license.
Section 3-2-5(D) Late Fee. A late fee of Fifty Dollars ($50.00) will be imposed
on any licensee who fails to submit a timely renewal application.
3. Title 3, Chapter 13, Section 3-13-3 of the City Code is amended to add:
Section 3-13-3-7 License Renewal. Any person intending to apply to renew a
cigarette license must submit a renewal application, on a form provided by the

City, and pay the application and license fee. A license renewal application and
license fee must be submitted to the City no later than forty-five (45) days prior
to the expiration of the license.
Section 3-13-3-10 Late Fee. A late fee of Fifty Dollars ($50.00) will be imposed
on any licensee who fails to submit a timely renewal application.
4. Title 8, Chapter 1, Section 8-1-3-2 is amended to add:
Section 8-1-3-2(D) License Renewal. Any person intending to apply to renew a
garbage and refuse collectors license must submit a renewal application, on a
form provided by the City, and pay the application and license fee. A license
renewal application and license fee must be submitted to the City no later than
forty-five (45) days prior to the expiration of the license.
Section 8-1-3-2(E) Late Fee. A late fee of Fifty Dollars ($50.00) will be imposed
on any licensee who fails to submit a timely renewal application.
