MICHAEL'S APRILFEST MARCH 3, 1997 INTRODUCTION: St. Michael's Church is requesting an Outdoor Concert permit in order to hold a family dance on the school grounds during their Aprilfest celebration on April 26, 1997. BACKGROUND: Aprilfest is an annual event for families of the entire community and a main fund-raiser for St. Michael's Church. They have already been approved for a temporary gambling license and a temporary liquor license is being considered for this event. DISCUSSION: St. Michael's is requesting that the $200.00 Outdoor Concert Fee be waived along with the $250.00 clean-up deposit as they are a non-profit organization. The fees have been waived previously by the City Council. ISSUES: The dance will be held in an enclosed area (tent) and any debris from the dance will also be contained in the enclosed area. The format is similar to previous dances which have taken place with minimum incident. AL TERNATIVES: 1. Approve the waiver of Outdoor Concert fee m the amount of $200.00 and the clean-up deposit m the amount of $250.00. 2. Deny fee waiver request. RECOMMENDATION: Staff recommends Council approve the fee waiver for St. Michael's Aprilfest upon approval by City Manager Frank Boyles of the Outdoor Concert Permit. ACTION R... EQUIRk n . We are asking for your approval to have Todd Hertaus, a OJ, provide the music for our parish, at our annual Church festival on April 26, 1997 from 7:00 pm to 11:00 pm. We have used him in the past, and have formerly notified all surrounding neighbors about this concert. We will continue to notify them and provide them with a special invitation to join us for these hours. We will continue to hold to our 11:00 pm ~finish. We would like to ask for your consideration in waiving the $ 250.00 permit fee, like you always have done in the past years. We do not charge to get into this concert, and it is not used for a fundraising activity as much as it is used for the socializing of all of our parishioners who have worked all day long at other activities that are needed to make the Aprilfest the function that the Church of St. Michael's desperately needs. We would like to assure that there will be no under age drinking. We have instituted a task force this year, along with other adults, that will be monitoring the grounds and watching for any youths that attempt to acquire beer. Also, the people who run the beer garden, and their workers, are very strict in askiI?g for I.D. ifthere is any doubt that the customer might be underage. A liability claim made aqainst a family that does not have any insurance could result in a great financial hardship. Therefore, we want to be certain that those persons us1nq Church facilities do have proper insurance in place to protect them. If alcohol is beinq served at their function, then it is mandatory that the host family have insurance coverage that includes Host Liquor Liability in the minimum amount of $500,000 and names the Church as an additional insured. Most Homeowners Insurance will cover their insured for Host Liquor and General ~iabl11ty. .Renters should be told to check with their insurer about their coverage and obtain a Certificate of InSUrance from their agent as evidence of their coveraqe. A copy of the Certificate of Insurance should be sent ~o our otfice ftt least 15 days prior to the event. If the renter i>> buyinq ~he coverage through the Archdiocese, they must liieml a cOlllpleted application (see paqe 5) and a check for $65.00 payable to tho Archdiocese of st. paul/Mpls., to our office at least l~ days prior to the event.
