INTRODUCTION:
The purpose of this agenda item is to consider whether the council
supports a regional water quality pond concept as part of the County
Road 42 upgrade or a more traditional ponding approach.
BACKGROUND:
Since 1995, when Scott County first started discussions with the
City about the future improvement of County Road 42 between
McKenna Road and F emdale Avenue there was talk of constructing
one regional water quality pond instead of up to six smaller ponds
to handle runoff to meet the Nationwide Urban Runoff Program
(NURP) standards.
The initial location for a regional pond was north of CSAH 42 on
the east side of Pike Lake Trail on the Vierling farm. The reason
for this location was two-fold: 1) There is a ravine through the
Vierling farm that is eroding causing sediment to be washed into
Pike Lake, which is forming a delta in the lake. The pond would
help to reduce sediment load to the lake; 2) The bottom of the
ravine the Vierling's have a cattle lot on the side of a hill. During
rain events cow manure washes off the side hill into the ravine and
into Pike Lake. The pond would have helped to clean up the
surface water runoff before it entered Pike Lake.
The Vierling's were contacted in 1996 by the City about selling
some of their land so that a regional pond could be constructed, but
there was reluctance on their part. They mentioned that they did not
want to take anymore land out of crop production. Given the above
scenario and the fact that the MPCA is now requiring corrective
action to eliminate pollution, the initial location for the regional
pond was abandoned.

Given the advantages of the regional pond concept, the City sought
a second location. This location is north of CSAH 42 and west of
Pike Lake Trail, just north of the Wensmann commercial property.
This site has several benefits: I) The regional pond could serve the
needs of four individual County NURP ponds and two on
Wensmann's site, and 2) the regional pond could recover 1.5 acres
from the Wensmann commercial site, which would otherwise have
been required for ponding purposes, and 3) the regional pond could
serve the water quality needs of the Pike Lake Trail improvement.
The owners of the property, Gordon Beneke and John Corsbie,
were contacted to see if they would sell this land to the City. At this
first meeting the owners seemed to be willing participants to this
concept. No further contact has been made with these property
owners since that October, 1996 meeting.
DISCUSSION:
The County, City and Watershed have considered the following
alternatives to meet the water quality needs for the CSAH 42
improvement project and the benefits for each as follows:
Alternative 1
Alternative I would involve constructing four (4) individual NURP
ponds along CSAH 42 at localized runoff points to treat the water
for quality purposes. This alternative does not reflect a long term
planning approach.
Alternative 2
Alternative 2 involves eliminating up to six individual NURP ponds
and constructing one regional NURP pond to meet the water quality
needs for this drainage area. Storm sewer pipe will need to be
installed along CSAH 42 to pipe the water to the regional pond.
This alternative reflects a long term planning approach.
There are numerous advantages of a regional pond design. One is
that it can be sized to handle water quality needs for multiple
properties. The NURP ponds required for the Wensmann site can
be eliminated and the NURP pond needs for the upgrade of Pike
Lake Trail will be met by the regional pond. Other advantages are:
I) minimized use of developable commercial property for ponding
purposes, 2) safety - one pond to protect instead of six, 3)
elimination of four CSAH 42 NURP ponds, 4) maintenance costs _
one pond to clean out instead of six, 5) utilization of non-
developable land for regional ponding, 6) involves willing sellers,
7) use of non-MUS A property versus MUSA property.

Land Purchase North of CSAH 42
There is 18.5 acres of land owned by Mr. Beneke and Mr. Corsbie
where the regional pond is proposed. Of this 18.5 acres, 2.5 acres is
located to the northeast and is separated from the remaining
property by a driveway easement to a private residence (see map).
The remaining 16 acres consists of2.2 acres of lake and 5.0 acres of
wetland leaving approximately 8.8 acres of upland. Staff will
negotiate for the purchase of this property and seek Council
approval as appropriate.
This project will be financed by County reimbursements, Trunk
Reserve Funds and storm water fees, which is future revenue.
Funding sources are shown on the sheet entitled "Alternative
Costs" .
Considering construction costs and fees, the regional pond costs
approximately $6,300 more than using a traditional multiple
ponding system. This financial analysis does not address the fact
that the regional pond will treat 54 acres, while the multiple pond
system treats only 18.6 acres. This means that the city's cost to treat
storm water is $8,481 per acre with the regional pond system as
opposed to $18,010 per acre using multiple ponding. In addition
the regional pond serves 35 acres of developable land (Wensmann
parcel) while the multiple ponds treat only County right-of-way.
The alternatives are as follows:
1. Approve Resolution 97-XX approving the regional water
quality pond concept as part of the CSAH 42 upgrade project.
2. Table this item for a specific reason.
3. Deny this agenda item for specific reasons.
Alternative No.1. Staff recommends that the Council approve
Resolution 97-XX approving the regional water quality pond
concept and authorize staff to negotiate for the purchase of the land.

RESOLUTION APPROVING THE REGIONAL WATER QUALITY POND CONCEPT
AS PART OF THE COUNTY ROAD 42 UPGRADE AND AUTHORIZES STAFF TO
NEGOTIATE FOR THE ACQUISITION OF LAND FOR A REGIONAL WATER
QUALITY POND.

WHEREAS, Scott County proposes to upgrade CSAH 42 from Ferndale Ave. to Mckenna Rd.
to a four lane highway, including storm sewer, and
WHEREAS, The Nationwide Urban Runoff Program (NURP) requires treatment of storm water
runoff prior to discharge to public waters, and
WHEREAS, Scott County, The City of Prior Lake, and the Prior Lake/Spring Lake Watershed
District have agreed that the best method of treating the storm water runoff to meet
NURP requirements is through the construction of a regional water quality pond.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The Council will approve the concept of a regional pond as part of the CSAH 42
upgrade project.
2. The Council authorizes staff to negotiate with the property owners of the land where
the pond is proposed. Staff will obtain final approval from Council prior to the final
signing for acquisition of this property.
