INTRODUCTION:
The purpose of this agenda item is to consider the approval of the
attached Feasibility Report and call for a Public Hearing on 1997
Improvement Projects.
BACKGROUND:
At the January 21, 1997, City Council meeting, Council authorized
staff to prepare a Feasibility Report for the 1997 Improvement
projects as approved by the Council in the 1997-2001 Capital
Improvement Program.
In the adopted Resolution No. 97-03, the following five project
areas were listed to be considered for the report:
1. Mushtown Road from approximately 1,400 feet south of Tower
Street to the southeast for 2,900 feet to a point approximately
800 feet beyond Ridgewood Court by the construction of
grading, storm sewer, aggregate base, concrete curb and gutter,
trails, bituminous surfacing, and appurtenant work (Includes
580 feet originally contemplated for construction in 200 I).
2. Pike Lake Trail from CSAH 42 south to the proposed north
plat line of Knob Hill by the construction of grading, storm
sewer, utility improvements, concrete curb and gutter,
sidewalk, bituminous surfacing, and appurtenant work.
3. CSAH 42 from Ferndale Avenue west to McKenna Road by
the construction of grading, storm sewer, aggregate base,
concrete curb and gutter, trunk sanitary sewer and watermain,
trails, bituminous surfacing, and appurtenant work (This

project to be constructed with CSAH 21 improvements from
CSAH 82 to CSAH 42).
4. Sealcoating of bituminous paved streets throughout the City.
5. Paving of Lakefront Park roads, trails and parking lots by the
construction of grading, storm sewer, aggregate base, concrete
curb and gutter, bituminous surfacing, and appurtenant work.
In the attached Feasibility Report, there are two projects in which a
portion of the cost will be assessed to the benefiting properties.
The projects are as follows:
1. Street reconstruction of Mushtown Road from 1,400 feet south
of Tower Street to 800 feet south of Ridgewood Court to local
City Street Standards.
2. Street reconstruction and utility extensions of Pike Lake Trail
from CSAH 42 south to the north plat line of Knob Hill to
Municipal State Aid Standards.
Also included in the Feasibility Report are other City projects in
which project financing can be leveraged against the MS Chapter
429 Assessment Bond. These projects include the following:
A. CSAH 42 from Ferndale Avenue to McKenna Road, the City
cost share of improvement.
B. Seal Coating of bituminous paved streets throughout the City.
C. Paving of Lakefront Park roads, trails and parking lot.
DISCUSSION:
The attached report indicates the estimated City costs for each
project, along with preliminary assessment estimates. At the end
of the Feasibility Report, a project financing summary is included
to show project cost splits. The total estimated project cost of the
five projects is $1,449,135.00.
The following is a commentary on each project with regard to
project need:
Area 1 - Mushtown Road
Mushtown road is required to be improved by the City as part of
the annexation agreement for the plat of W oodridge Estates. This

improvement was originally scheduled for 1996 and then
rescheduled to 1997 by the Council.
Mushtown Road has a 24-foot wide bituminous surface from
Panama Avenue (CSAH 23) south 1,400 feet to approximately the
south plat line of Maple Acres, and a 30-foot wide gravel surface
from the bituminous terminus and continues to the south to serve
the township.
A Feasibility Report for this project was prepared by MSA
Consulting Engineers in September, 1995 and determined the
estimated costs of this project and the special assessments against
the property known today as Woodridge Estates 3rd Addition. Per
the developers agreement for Woodridge Estates 3rd and the
annexation agreement with Spring Lake Township the developer is
required to pay his portion of the Mushtown Road improvements.
The developer has given the City a letter of credit for $85,177.19.
Two roads have been constructed within Woodridge Estates 3rd
Addition to the west edge of the plat and are proposed to connect
to Mushtown Road. Per the annexation agreement these roads
cannot connect to Mushtown until it is improved. The two streets
are Toronto Avenue and Ridgewood Court.
The original feasibility report did not include the installation of a
8' bituminous trail from Toronto A venue to the proposed trail to
the Ponds Athletic complex nor did it include extending the
roadway improvements. This increased the length of the project by
approximately 580 feet. The extension of Mushtown Road
Improvements, an additional 580 feet southerly in the Township, is
to intersect with a proposed second access road to the Ponds which
was funded as part of the 1996 Park budget and Department of
Natural Resources Grant. This work is to be completed this year
so a gravel access is available. The park access road will be
surfaced with bituminous next year.
Area 2 - Pike Lake Trail
Pike Lake Trail from CSAH 42 south to Carriage Hills Parkway is
approximately 1/2 mile long and is currently gravel. The plat of
Knob Hill has preliminary plat approval to realign Pike Lake Trail
slightly from Carriage Hills Parkway to approximately 1/4 mile to
the north. It appears that this phase of Knob Hill may be included
with the plat of Knob Hill North and the improvements could be
installed in 1997. Sanitary sewer, watermain, storm sewer, and
streets will be extended to the north plat line.

Scott County is proposing to improve the existing CSAH 42 from
Ferndale Avenue west to McKenna Road in 1997 and with this
construction sanitary sewer and watermain will be extended and
stubs provided at Pike Lake Trail. This street construction provides
the opportunity to extend the sanitary sewer south and loop the
watermain from the Knob Hill Subdivision.
The existing plat of Maple Hill which is located on the east side of
Pike Lake Trail approximately 600 feet south of CSAH 42, Gust
south of the Holy Cross Church) has petitioned the City for
sanitary sewer and watermain for their entire plat. Plans and
specifications have been submitted to the City for review. A
developers agreement is to be prepared to enable the home owners
association to install the utilities in the spring of 1997. Connections
to these utilities cannot be made until the utilities are installed
along Pike Lake Trail.
Area 3 - CSAH 42
Scott County proposes to upgrade CSAH 42 to four lanes from
F erndale A venue west to McKenna Road in 1997. Along with this
construction the upgrading of CSAH 21 will be bid and
constructed together and the County anticipates that the contractor
would need 2 years to complete the street reconstruction. The City
has bonded for $475,000.00 in 1996 to support our portion of
CSAH 21.
Sanitary sewer and watermain are proposed in conjunction with
this construction. Sanitary sewer is proposed to include a crossing
and the extension of sewer from Pike Lake Trail east to Rolling
Oaks Circle. Watermain trunk line is proposed to extend from
Ferndale Avenue west to Pike Lake Trail.
Street lighting and landscaping for CSAH 21 and CSAH 42 is
contemplated to "match" the existing segments but is not included
in this report. Street lighting on CSAH 21 would be accomplished
by NSP and landscaping by a professional firm subject to public
bids.
Area 4 - Sealcoatinl! of Streets
For four years the City has engaged in an annual program of crack
sealing, patching and sealcoating. All three are done as preventive
maintenance to extend the life of the streets. As of 1996, all streets
built prior to 1993 have been seal coated where cost-effective.
Based on this staff has determined there is no need to seal coating
this year. A program of cracksealing and patching will continue as

in past years. This will be funded exclusively through the
operating budget. There is no need to use bond proceeds for
sealcoating this year and it is recommended this project not
advance any further. The sealcoating program will be revisited in
1998.
Area 5 - Lakefront Park
The City Council has earmarked $75,000 for Lakefront Park
Improvements in the 1997 Capital Improvement Program. The
allocation of these funds, if any, will be dependent upon the results
of the Parks and Library Referendum.
Staff will make a presentation on the Feasibility Report and will
discuss the merits of each project. Council can eliminate any
project or portions of a project at this time. The City is required to
assess a minimum of 20% of the bond amount per bonding
requirements.
If the Council approves the Feasibility Report, the Chapter 429
special assessment projects require public hearings to be conducted
prior to implementing the project. Staff would also conduct
Informational Meetings prior to the Public Hearings to help the
residents understand and answer any questions.
The 1997 improvement projects are proposed to be financed by
special assessments, property taxes, Street Collector Funds, and
Trunk Reserve Funds. Funding sources and amounts are as shown
below:

The feasibility report raises a number of issues for City Council
determination:
A. Mushtown Road
1.
The construction of the 580' of Mushtown Road within the
Township was originally contemplated for improvement by
the City in the year 2001 at a cost of $75,000 to be drawn
from the Collector Street Fund. The feasibility report
includes this segment as a bid alternate in hopes of

receiving a better price than if the project were done alone
in 2001. The sole reason for constructing the additional
580' is to provide for a second access and egress to Ponds
Park as contemplated in the park's development plans.
Attached is a Collector Street Fund recap for Council
information. The issue before the courts is Collection fees
received as part of the building permit. The issue of
Collector fees as part of the developer's agreement is not
part of this case. Of the total Street Collector Funding,
$308,330 were collected through developer's agreements.
While there is still some risk, there may be less risk
associated with this funding source than building permit
related Collector fees.
The Council should determine if this segment should be bid
as an alternate or not at all. If bid, the Council will have to
decide the source of funding for this work. This decision
can be made by the Council at bid award later this year.
B. Pike Lake Trail
1. Pike Lake Trail cannot be fully funded through special
assessments. Consequently, the expenditure of $114,104
from the Collector Street Fund is contemplated. Does the
Council believe such an expenditure to be appropriate?
Because Pike Lake Trail is a Municipal State Aid Road, an
MSA allocation could be used in lieu of the Collector Street
Funds. Currently, MSA funds are programmed for the
extension of Fish Point Road through Cardinal Ridge 5th
Addition.
C. CSAH 42
1.
Proposed landscaping and lighting improvements for
CSAH 42 are identical to the improved segments of this
roadway. While amounts are not included in the feasibility
report, landscaping would be contemplated to match the
easterly segments of the roadway within Prior Lake. The
work would be publicly bid. The lighting contemplated is
intersection only which is consistent with the remainder of
CSAH 42. Lighting would be installed by the public
utility. Does the Council believe that these proposals are
appropriate?

D. Lakefront Park
1. By the time this report is received by the Council, we will
know if the referendum was successful. If so, the $75,000
Lakefront Park allocation should be deleted as such
improvements will be paid for by the referendum bond
issue. If the referendum is unsuccessful, the $75,000 would
be generally earmarked for Lakefront Park Improvements
in accordance with the master plan previously adopted by
the City Council.
ALTERNATIVES:
The alternatives are as follows:
1. Provide staff direction on each issue area and any others as the
Council deems appropriate.
2. Approve Resolution 97-XX receiving the Feasibility Report
and establish a Public Hearing date as per Resolution 97-XX
with amendments as appropriate based upon the above
directions.
3. Table this item for a specific reason.
4. Deny Resolution 97-XX.
RECOMMENDATION: Alternative No.1 and 2. Staff recommends that the Council accept
the Feasibility Report for the 1997 projects and establish the Public
Hearing date as listed in Resolution 97-XX. Approval of the
Feasibility Report does not grant final approval of any project.
ACTION REQUIRED: A motion and second to approve Resolution 97-XX as proposed or
amended.

A PUBLIC HEARING ON 1997 IMPROVEMENT PROJECTS

WHEREAS, pursuant to Resolution 97-03 of the City Council, adopted on January 21, 1997, a
report prepared by the City's Engineering Department with reference to the
following improvements and the generally described project areas:
1. Mushtown Road from approximately 1,400 feet south of Tower Street to the
southeast for 2,900 feet to a point approximately 800 feet beyond Ridgewood
Court by the construction of grading, storm sewer, aggregate base, concrete
curb and gutter, bituminous surfacing, walk and appurtenant work; and
2. Pike Lake Trail from CSAH 42 south to the proposed north plat line of Knob
Hill by the construction of grading, storm sewer, aggregate base, concrete curb
and gutter, bituminous surfacing, walk and appurtenant work; and
3. CSAH 42. from Ferndale Avenue west to McKenna Road by the construction
of storm sewer, utility crossings, concrete curb and gutter, sidewalk,
bituminous surfacing, and appurtenant work; and
4. Sea1coating of bituminous streets throughout the City.
5. Paving of Lakefront Park roads, trails and parking lots by the construction of

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The Council will consider the improvement of such streets and areas in accordance
with the report and the assessment of property as described in the report for all or a
portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429
at an estimated total cost of the improvements of$1,449,135.00.
2. A Public Hearing shall be held on the following such proposed improvements on the
following date at the Fire Station No.1, with the address of 16776 Fish Point Road,
City of Prior Lake, Minnesota at the following time:

TYPE OF WORK
The improvements proposed for construction during 1997 include sanitary sewer,
watermain, storm sewer, sidewalk, bike path, bituminous overlayment, street surface
improvements, and street reconstruction, including grading, concrete curb and gutter,
retaining walls, boulevard restoration and appurtenant work. The proposed project
locations within the city limits of Prior Lake are shown by Exhibit 1. A brief description
of the improvements shown by Exhibit 1 is as follows:
AREA 1 - Mushtown Road
Mushtown Road from approximately 1,400 feet south of Tower Street to the southeast for
2,900 feet to a point approximately 800 feet beyond Ridgewood Court by the
construction of grading, storm sewer, aggregate base, concrete curb and gutter,
bituminous trail, bituminous surfacing and appurtenant work.
AREA 2 - Pike Lake Trail
Pike Lake Trail from CSAH 42 south to the proposed north plat line of Knob Hill by the

LOCATION OF THE PROJECTS
The five projects shown by Exhibit 1 are located in the following areas:
AREA 1 - Mushtown Road
Mushtown Road from the south plat line of Maple Acres approximately 2,900 feet south
past the City limit line within the north half of Section 11, Township 114 north, Range 22
west, Scott County, Minnesota.
AREA 2 - Pike Lake Trail
Pike Lake Trail from County Road 42 to the proposed north plat line in the plat of Knob
Hill in Section 26, Township 115 north, Range 22 west, Scott County, Minnesota.
AREA 3 - CSAH 42 from Ferndale to McKenna Road
CSAH 42 from Ferndale Avenue to McKenna Road within the south half of Section 22,
23 and 24, Township 115 north, Range 22 west, Scott County, Minnesota.
AREA 4 - Street Sealcoatine:
The sealcoating of bituminous paved streets will be on the older streets with excessive
cracks and surface deterioration throughout the city.
AREA 5 - Lakefront Park Road Pavine
Lakefront Park within the south half of Section 35, Township 115 north, Range 22 west,

and the north half of Section 2, Township 114 north, Range 22 west, Scott County,
Minnesota.
DESCRIPTION OF PROJECT
A more detailed description of the projects that are proposed to be assessed are as
follows:
AREA 1 - Mushtown Road
Mushtown Road runs south-east from Panama Avenue (CSAH 23) for approximately
one-half mile. The section of road proposed for improvement is shown by Exhibit 2 and
begins where the current bituminous surface ends. That portion of Mushtown Road is
rural in nature with a gravel surface and no curb and gutter. Storm water runoff currently
flows overland to shallow ditches and isolated wetlands. There are three wetlands
adjacent to the road which are recognized by the National Wetlands Inventory map, and
one man-made pond. These existing wetlands and pond are shown on Exhibit 2. If any
filling of the wetlands is done, permits form the Minnesota Department of Natural
Resources and the U.S. Corps of Engineers will be required.
The condition of Mushtown Road is worst in the spring. During the freeze-thaw season,
the gravel road becomes soft and unstable due to frost action. Proposed improvements
include upgrading the street to a bituminous surface, concrete curb and gutter, and storm
sewer. A permit from the Prior Lake/Spring Lake Watershed District will be required for
the storm sewer improvements.
Scott County records show no defined right-of-way for Mushtown Road except within
platted areas adjacent to the road. The platted section adjacent to Woodridge Estates 3rd
has a 50-foot right-of-way and the preliminary plat application for the Windstar
Development has a 33-foot right-of-way. Costs for acquiring the remaining right-of-way
and/or easements are included in the project cost for Mushtown Road. Benefiting
developer of Woodridge Estates 3rd and the developer of the proposed Windstar
Development will be assessed, while the balance of the project costs will be paid from the
Project Levy and the Street Collector Fund.
AREA 2 - Pike Lake Trail
Pike Lake Trail is shown on Exhibit 4. The street is designated as a Municipal State Aid
route. Currently, the street has a gravel surface and is rural in nature with no curb and
gutter. The terrain is hilly and is heavily wooded on both sides of the road. The portion of
Pike Lake Trail south of the Maple Hill Subdivision will be built by the developer as part
of the Knob Hill Subdivision; therefore, costs for the street reconstruction within Knob
Hill are not included in this report. The plat of Maple Hill is proposing to extend the
existing sanitary sewer from the Holy Cross Church property south to serve their entire
plat in the spring of 1997.

Proposed improvements includes street reconstruction with storm sewer, retaining walls,
concrete curb and gutter, concrete sidewalk, bituminous trails, and bituminous surfacing.
Street reconstruction provides the opportunity to extend the sanitary sewer and loop the
watermain with the Knob Hill Subdivision.
As shown on Exhibit 5, this road is proposed to be built to a 9 ton design. Pike Lake Trail
from Carriage Hills Parkway to CSAH 42 is designated as a minor collector street. Some
of the project will be financed by the City Street Collector funds. Benefiting property
owners will be assessed. Trunk Reserve funds will be used to finance the City portion of
the sanitary sewer, watermain, and trunk storm sewer.
FEASIBILITY
From an engineering standpoint, project number 1,2,3, and 5 are feasible, independent of
each other, and can be accomplished as proposed, and not in conjunction with each other
or any other project. So project number 4 (Sealcoating) has been determined not to be
feasible due to the fact that all city streets built prior to 1993 have been sealcoated and it
would not be cost effective to seale oat any streets at this time.
ESTIMATED COST
The following costs were prepared based upon an Engineer's Estimate and are subject to
change, depending on the final design of the project, bids received, and actual work
performed. The method of assessment and rate will be determined at the Assessment
Hearing.
The estimated project cost for each project is for the installation of associated
improvements and includes indirect project costs. Project costs in Areas 1 & 2 include
special assessments.

and is not feasible.

Project Areas 3 and 5 will be included in the Minnesota Statutes Chapter 429 Special
Assessment Bond issue but will not be assessed. These two projects have general overall
City benefit and are paid by ad valorem tax levy.

The area proposed to be assessed is every lot, piece, and parcel within the City limits
benefiting from said improvement, whether abutting or not, within the following
described areas:

Minnesota Statutes Chapter 429 Special Assessment Bond issue requires that at a
minimum of 20% of the total bond amount be recovered through special assessments.
With a total project cost of$1,449,135, an estimated bond of $900,000, and an
assessment total of $286,678, the assessed amount would be 32%.
From an economic standpoint, project number 1,2,3, and 5 are feasible

CONCLUSION
The total estimated cost of the proposed improvements is $1,449,135. A portion of these
projects are proposed to be assessed to the benefiting property owners and the remainder
through other funding sources. The projects are feasible from an engineering and
economic standpoint, and will benefit the properties proposed to be assessed.
