INTRODUCTION:
The City uses the Five Year Capital Improvement Program to plan
its infrastructure improvements and the financing therefore. The
proposed 1998 street program includes six road improvements.
The purpose of this Agenda item is to initiate the process for local
improvements set forth in the 1998 portion of the 1998-2002
Capital Improvement Program in accordance with Minnesota
Statutes (M.S.), Chapter 429.
This process applies to all projects that will be financed in whole
or part through special assessments or bond proceeds. The first
step in the process is for the Council to order preparation of a
Feasibility Report on improvement projects.
The Feasibility Report will address: the upgrading of Duluth Street
from TH 13 to Pleasant; upgrading of Pleasant Street (Park
Avenue to Main Street), West Avenue (Pleasant Street to Eagle
Creek Avenue), Birch Avenue (Pleasant Street to Lakeside
Avenue) and Main Avenue (Pleasant Street to Eagle Creek
Avenue); the realignment and signalization of County Road 23
with Five Hawks Avenue; and mill and overlay of Five Hawks
Avenue between TH 13 and Priorwood (see attached location
map).
BACKGROUND:
Each of these projects is in the 1998 Capital Improvement
Program. Attached are pages from the C.I.P. which provide
additional information on these projects. All of the projects require
special assessments and therefore require the City to follow the
requirements of MS Chapter 429.
A Feasibility Report for the County Road 23/Five Hawks Avenue
intersection improvements was prepared in 1992 by Strgar-
Roscoe-Fausch, Inc. The traffic signal was also included in the
1993 Feasibility Report for the CIP projects. Plans for the traffic
signal were prepared in 1994. These feasibility reports will be
updated as part of this authorization.

The City is required to assess a minimum of 20% of the cost of a
public improvement project completed through the Chapter 429
process and financed through G.O. bonds. The City will meet the
minimum assessment requirement. The Feasibility Report will
determine the costs of the improvements and methods of
financing.
The preparation of the feasibility report is only the first step in the
public improvement process. Following receipt of the feasibility
report the council can determine which projects to move forward
with by scheduling a public improvement hearing. If the council
approves the hearing, it is still not committed to proceed with
actual construction until bids are solicited following approval to
prepare plans and specifications.
There are three alternatives for the City Council to consider:
1. Approve Resolution 97 -XX which orders preparation of a
Feasibility Report for: the upgrading of Duluth Street from TH
13 to Pleasant Street; upgrading of Pleasant Street (Park
Avenue to Main Street), West Avenue (Pleasant Street to
Eagle Creek Avenue), Birch Avenue (Pleasant Street to
Lakeside Avenue) and Main Avenue (Pleasant Street to Eagle
Creek Avenue); the realignment and signalization of County
Road 23 with Five Hawks Avenue; and mill and overlay of Five
Hawks Avenue between TH 13 and Priorwood Street.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

ORDERING PREPARATION OF FEASIBILITY REPORT
FOR 1998 IMPROVEMENT PROJECTS

WHEREAS, it is proposed to construct improvements within the following generally described
project area:
1. Duluth Street from Pleasant Avenue to TH 13 by the construction of storm sewer,
grading, aggregate base, concrete curb and gutter, bituminous surfacing, pedestrian
walkways and appurtenant work; and
2. Pleasant Street from Park Avenue to Main Street, Colorado Street from Lakeside
Avenue to Duluth Avenue, Birch Avenue from Pleasant Street to Lakeside Avenue,
West Avenue from Pleasant Street to Eagle Creek Avenue and Main Street from
Pleasant Street to Colorado Street by the construction of storm sewer, aggregate base,
concrete curb and gutter, bituminous surfacing, concrete sidewalk, and appurtenant
work; and
3. Mill and bituminous overlay of Five Hawks Avenue from TH 13 to Priorwood Street; and
4. Realignment and signalization of County Road 23 and Five Hawks Avenue including
construction of storm sewer, aggregate base, concrete curb and gutter, bituminous
surfacing, sidewalk, bituminous trail and appurtenant work.
WHEREAS, it is proposed to assess the benefited property for all or a portion of the cost of the
improvements, pursuant to Minnesota Statutes, Chapter 429,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the proposed improvements be referred to the City Engineer for study and
that he is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are feasible and as to whether they
should best be made as proposed or in connection with other improvements, and the estimated
costs for the improvements as recommended.
