HomeMy WebLinkAbout8C - CSAH 42 and TH 13 AGENDA #: PREP ARED BY: SUBJECT: 8C SUE MCDERMOTT, ASSISTANT CITY ENGINEER CONSIDER APPROVAL OF JOINT RESOLUTION BETWEEN THE CITY OF SA V AGE AND THE CITY OF PRIOR LAKE FOR CONCURRENT DETACHMENT AND ANNEXATION FOR CSAH 42 AND TH 13 JUNE 2, 1997 DATE: INTRODUCTION: The purpose of this agenda item is to: Consider approval of a Joint Resolution which: · Approves detachment of approximately 6 acres of land from the City of Prior Lake located between the center line of CSAH 42 and its northerly right-of-way line to be concurrently annexed to the City of Savage. · Approves detachment of approximately 10.5 acres of land from the City of Prior Lake located between the center line of TH 13 and its easterly right-of-way line to be concurrently annexed to the City of Savage. BACKGROUND: The current boundaries between the cities of Savage and Prior Lake are the northerly right-of-way line of CSAH 42 and the easterly right-of-way line of TH 13. The City of Savage has requested a concurrent detachment and annexation in order to eliminate the possibility of unforeseen consequences of the current boundaries. Services to these properties are currently being provided by the City of Savage. Potential issues include fiscal responsibilities for improvements on the north side of CSAH 42 and the east side of TH 13, emergency/public safety responsibility for accidents/infractions, 1620Q,~~reek Ave. S.L Prior Lake. DOC and development issues that must be addressed by the City of Savage. The council briefly discussed this issue before and had two concerns: 1) access and 2) possible State Aid ramifications. The State of Minnesota and Scott County have jurisdiction over access points on TH 13 and CSAH 42. The City of Prior Lake does not currently have authority to approve access points in these areas. If the City of Savage petitions either the County or the State for access points on TH 13 and CSAH 42, and approval is received by these agencies, no further approval is required from a neighboring city. The City of Prior Lake currently has the ability to comment to the State and County regarding potential access points and would still maintain this right if the boundaries were changed. There would be no State Aid ramifications to the City of Prior Lake because CSAH 42 is County State Aid, not Municipal State Aid. The City of Prior Lake receives no State Aid dollars due to this designation of CSAH 42. Therefore, the State Aid received by the City of Prior Lake will not be impacted by a concurrent detachment and annexation. When the CSAH 42 improvement project was done, the County assessed costs to both the City of Prior Lake and the City of Savage as if the boundary line was the centerline of CSAH 42. An advantage of concurrent detachment and annexation would be in the event that TH 13 is improved, costs would be shared between the cities of Savage and Prior Lake. Under the current boundaries, there is the potential for Prior Lake to be responsible for the entire cost. The alternatives are as follows: 1. Approval of the Joint Resolution with the City of Savage for a concurrent detachment and annexation. 2. Table this item for a specific reason. 3. Deny this agenda item for a specific reason. RECOMMENDATION: FINANCIAL IMPACT: ACTION REQillRED: ROW42 13. DOC Approve Alternative No.1. State Aid funding will not be impacted. Potential for a cost savings in the event of i 13 improvements. L~ REVIEWE I ( RESOLUTION 97-XX JOINT RESOLUTION BETWEEN THE CITY OF SAVAGE AND THE CITY OF PRIOR LAKE FOR THE CONCURRENT DETACHMENT AND ANNEXATION OF LAND LOCATED BETWEEN THE CENTER LINE OF COUNTY ROAD 42 AND ITS NORTHERLY RIGHT-OF-WAY LINE and LAND LOCATED BETWEEN THE CENTER LINE OF HIGHWAY 13 AND ITS EASTERLY RIGHT-OF-WAY LINE. WHEREAS, the City of Prior Lake desires to detach a parcel of property approximately 6 acres in size and described as follows: All land presently situated in the City of Prior Lake lying between the center line of Scott County Road 42 and its northerly right-of- way line of Scott County Road 42, extending from the intersection of Scott County Road 42 and MN Highway 13 to the westerly boundary of Section 19 , Township 115N, Range 21 W of Scott County. WHEREAS, the City of Prior Lake desires to detach a parcel of property approximately 10.5 acres in size and described as follows: All land presently situated in the City of Prior Lake lying between the center line of MN Highway 13 and its easterly right-of-way line of MN Highway 13, extending from the intersection of MN Highway 13 and Scott County Road 42 to the westerly boundary of Section 31, Township 115N, Range 21W of Scott County. WHEREAS, the above properties abut the City of Savage and the City of Savage desired to annex said properties; and WHEREAS, services to said properties are currently provided by the City of Savage, and will continue to be provided by the City of Savage in the future. NOW, THEREFORE, BE IT RESOLVED that the City of Prior Lake and the City of Savage hereby jointly express a desire to adjust the municipal boundaries through detachment and annexation; and, BE IT FURTHER RESOLVED that the desired new boundaries be located along the center line of CSAH 42 and TH 13 in the areas described above; and FINALLY, BE IT RESOLVED that this resolution be submitted to the Minnesota Municipal Board with the intent and request that the Municipal Board authorize the detachment and annexation at the earliest possible date.
