HomeMy WebLinkAbout6A - Wilds Second Addition, Outlot E AGENDA #: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: STAFF AGENDA REPORT 6A JANE KANSIER, PLANNING COORDINATOR PUBLIC HEARING TO CONSIDER THE VACATION OF ROAD, UTILITY AND DRAINAGE EASEMENTS PLATTED IN OUTLOT E, THE WILDS 2ND ADDITION JULY 7, 1997 The City has received a petition from Shamrock Development to vacate the road, drainage and utility easements located on Outlot E, The Wilds Second Addition. A location map showing the road right-of-way (Exhibit A) is attached for your information. Shamrock Development is the only property owner adjacent to this property. As required by Minnesota Statute 412.851 (see Exhibit F), notice of the hearing was published in the Prior Lake American and individual notices were mailed to the adjacent property owners. M.S. 412.851 allows the Council to vacate right-of-way by resolution. Since there has been a petition, the Council may adopt a resolution by a majority vote. The statute also states that "no such vacation shall be made unless it appears to be in the public interest to do so". The Wilds Second Addition was platted in 1996. Outlot E included several easements for the extension of sewer and water service from the end of Wilds Parkway to CR 82. October 7, 1996, the Council approved Resolution #96-102, approving Addendum #1 to the Contract for Development for The Wilds Second Addition. This resolution allowed the developer to construct Wilds Parkway through Outlot E from CR 82 to its current end without filing a final plat. As a condition of this approval, the developer agreed to grant the City a road, drainage and utility easement over the portion of Outlot E to be used for road purposes, and to dedicate this area as road right-of-way with the next plat. The developer has since constructed the utilities and the road is nearly completed. The Wilds 4th Addition will also be considered by the Council on July 7, 1997. This final plat dedicates the road right-of-way for the remaining portion of Wilds Parkway, and the necessary utility and drainage easements. DISCUSSION: In a vacation request, the City must determine whether there is a public need or anticipated future need for the dedicated property. After review, the staff has concluded that the proposed easements to be dedicated will actually be rededicated in The Wilds 4th Addition. The new dedication will provide cleaner and clearer descriptions. The vacation can proceed as requested subject to the approval and recording of the final plat of The Wilds 4th Addition. ALTERNATIVES: 1. Adopt Resolution 97-XX approving the vacation of the road, drainage and utility easements in Outlot E of The Wilds 2nd Addition as requested. 2. Defer consideration of this item for specific reasons. 3. Based upon expressed findings of fact, recommend the City Council deny part or all of the application based upon inconsistency of the proposal with specific regulations of the Zoning and Subdivision Ordinances and/or specific policies of the Comprehensive Plan. RECOMMENDATION: The Planning staff recommends approval of Alternative #1. Approval of this vacation should be subject to the following conditions: 1. The resolution vacating these easements must be recorded with the recording of the final plat of The Wilds 4th Addition. ACTION REQUIRED: A motion and second to adopt Resolution #97-XX. The requirement that this vacation be recorded together with the recording of the final plat of The Wilds 4th Addition assures that the City receives the easements and right-of-way required. Resolution 96-102 nd Addendum NO.1 to Development Contract for The ds 2nd Addition I :\97files\97vac\vac97057\97057 cc. doc Page 2 RESOLUTION 97-XX RESOLUTION PROVIDING FOR THE VACATION OF THE ROAD, DRAINAGE AND UTILITY EASEMENTS IN OUTLOT E, THE WILDS 2ND ADDITION MOTION BY: SECOND BY: WHEREAS, a petition for the vacation of the road, drainage and utility easements in Outlot E, The Wilds 2nd Addition has been duly presented to the City of Prior Lake, signed by a majority of the owners of the property abutting the following described right-of-way situated in the City of Prior Lake, Scott County, Minnesota to wit: LEGAL DESCRIPTION: All roadway, drainage and utility easements as delineated and dedicated on The Wilds and The Wilds Second Addition, according to the recorded plats thereof, Scott County, Minnesota, lying over, under and across that part platted as Outlot E, said The Wilds Second Addition. WHEREAS, notice of the hearing on said petition has been duly published and posted in accordance with the applicable Minnesota Statutes, and WHEREAS, a Public Hearing was held on said petition on Monday, July 7, 1997, at 7:30 p.m. in the Council Chambers at the Prior Lake Fire Station # 1; and WHEREAS, the City Council then proceeded to hear all persons interested in said petition and persons interested afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, the City Council of Prior Lake has determined that the vacation of said road, drainage and utility easements would be in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant to Minnesota Statues 412.851, the above described road, drainage and utility easements situated in the City of Prior Lake, Scott County, Minnesota is hereby vacated subject to the following conditions: 1. The resolution vacating these easements must be recorded together with the recording of the final plat of The Wilds 4th Addition. BE IT FURTHER RESOLVED that this Resolution will be forwarded to the Office of the County Recorder, Scott County, for appropriate action. MOTION BY: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, RESOLUTION 96-102 APPROVING ADDENDUM NO.1 TO CONTRACT FOR DEVELOPMENT OF LAND THE WILDS 2ND ADDITION Kedrowski SECOND BY: Schenck the City has granted preliminary plat approval and final plat approval to The Wilds 2nd Addition, subject to certain terms and conditions set forth in the CONTRACT FOR DEVELOPMENT dated June 3, 1996; and the Southeasterly portion of the land compnsmg The Wilds 2nd Addition is platted as Outlot E; and the CONTRACT FOR DEVELOPMENT of The Wilds 2nd Addition (hereinafter "Contract for Development") provides that the Developer will construct Wilds Parkway to a terminus at the most westerly line of Outlot E; and the Developer at some future date intends to plat Outlot E as The Wilds Fifth Addition; and the City and Developer agree that it is in the best interest of the City and Developer to presently construct Wilds Parkway through Outlot E to terminate at County Road 82. The Contract for Development of The Wilds 2nd Addition for Shamrock Development, Inc. is amended by the inclusion of Addendum #1 as set forth below and as attached hereto: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The CONTRACT FOR DEVELOPMENT is hereby amended to add Addendum No. 1. 3. The Developer grants the City a roadway, drainage and utility easement over that portion of Outlot E, legally described in Attachment 1 to this Addendum. Attachment 1 is incorporated by reference as if fully set forth herein. 4. All fees owed to the City associated with the construction of the extension of Wilds Parkway through Outlot E will be captured at the time of the final plat for The Wilds Fifth Addition; and said fees will be based upon the estimated costs for the construction set forth in paragraph 6 below. 6. The estimated costs for the construction of Wilds Parkway through Outlot E IS $324,307.00. 7. Paragraph 7 to the CONTRACT FOR DEVELOPMENT IS amended to add the following Section 7.3: The Irrevocable Letter of Credit in the amount of $695,187.73 provided by the Developer to secure compliance with the terms of the CONTRACT FOR DEVELOPMENT shall apply also to secure the completion and acceptance by the City for the extension of Wilds Parkway through Outlot E to County Road 82. 8. In calculating any reduction in the Irrevocable Letter of Credit pursuant to Paragraph 8 of the CONTRACT FOR DEVELOPMENT, the City shall include the estimated construction costs for the extension of Wilds Parkway through Outlot E. 9. The construction of Wilds Parkway through Outlot E shall be in accordance with the engineering plans prepared according to City specifications and approved by the City Engineer. 10. Grading relating to the extension of Wilds Parkway through Outlot E shall be in accordance with a grading plan submitted by the Developer and approved by the City Engineer. NOW THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE that Addendum #1 to the Contract for Development of The Wilds 2nd Addition is approved and the Mayor and City Manager are authorized to execute said Addendum on behalf of the City. ADDENDUM NO.1 TO THE CONTRACT FOR DEVELOPMENT OF LAND IN THE CITY OF PRIOR LAKE, MINNESOTA TillS AGREEMENT, made and entered into as of the 7th day of October, 1996, by and between the City of Prior Lake, (hereinafter "City"), a municipal corporation organized under the laws of the State of Minnesota and Shamrock Development, Inc. (hereinafter "Developer"), a Minnesota corporation. WITNESSETH THAT: WHEREAS, the City has granted preliminary plat approval and final plat approval to The Wilds 2nd Addition, subject to certain terms and conditions set forth in the Contract for Development of Land in the City of Prior Lake dated June 3, 1996 ("CONTRACT FOR DEVELOP~T"); and WHEREAS, pursuant to the approval, the City Council authorized the Mayor and City Manager to execute a CONTRACT FOR DEVELOPMENT for a single- family development known as The Wilds 2nd Addition; and WHEREAS~ the CONTRACT FOR DEVELOPMENT require the Developer to construct certain City Improvements; and WHEREAS, the Southeasterly portion of the land comprising The Wilds 2nd Addition is platted as Outlot E; and WHEREAS, the CONTRACT FOR DEVELOPMENT of The Wilds 2nd Addition provides that the Developer will construct Wilds Parkway to a terminus at the most westerly line of Outlot E; and WHEREAS, the Developer at some future date intends to plat Outlot E as The Wilds Fifth Addition; and WHEREAS, the City and Developer agree that it is in the best interest of the City and Developer to presently construct Wilds Parkway through Outlot E to terminate at County Road 82.
