INTRODUCTION:
The purpose of this agenda item is to consider payment for an
easement over the proposed regional water quality pond property
which will be constructed as part of the County Road 42 upgrade.
BACKGROUND:
On March 3, 1997, Council passed Resolution 97-12 approving the
regional water quality pond concept as part of the County Road 42
upgrade and authorized staff to negotiate for the acquisition of land
for the regional water quality pond.
After several discussions the owners of the property, Gordon
Beneke and John Corsbie, have agreed to grant easements to the
City as shown on the attached map.
An appraisal for the property in question was completed by Lake
Region Appraisal Services. The wetland portion of the land was
valued at $3,300 per acre and upland was valued at $12,300 per
acre.
DISCUSSION:
This project involves eliminating six individual NURP ponds and
constructing one regional NURP pond to meet the water quality
needs for this drainage area. Storm sewer pipe will be installed as
part of the CSAH 42 upgrade project to pipe the water to the
regional pond. This project reflects a long range planning approach.
The numerous advantages of a regional pond design are that it can
be sized to handle water quality needs for multiple properties. The
NURP ponds required for the Wensmann site will be eliminated and
the NURP pond needs for the upgrade of Pike Lake Trail will also
be met by the regional pond. Other advantages are: 1) minimized
use of developable commercial property for ponding purposes, 2)
safety - one pond versus six, 3) elimination of four CSAH 42

NURP ponds, 4) maintenance costs - one pond to clean out instead
of six, 5) utilization of non-developable land for regional ponding,
6) use of non-MUS A property versus MUSA property.
The subject property consists of approximately 19 acres of land. Of
this 19 acres, 2.5 acres is located in the upper northeast and is
separated from the remaining property by a driveway easement to a
private residence. The remaining 16.5 acres consists of 2.2 acres of
lake and 5.0 acres of wetland leaving approximately 9.3 acres of
upland. The easement area to be acquired is approximately 10
acres.
Staff has negotiated with the owners and have come to an
agreement regarding the location of drainage and utility easements
and monetary compensation.
This project will be financed by County reimbursements, Trunk
Reserve Funds and storm water fees.
The total cost for easement acquisition is as follows:
5.52 acres upland x $12,300/ac = $67,896.00
4.84 acres wetland x $3,300/ac = $15,972.00
Total = $83,868.00
If Council approves the easement acquisition, the owners have
asked that the City make two equal payments, one payment in 1997
and one payment in 1998. Finance Director Ralph Teschner
confirms that this payment schedule is satisfactory from a financial
perspective.
The alternatives are as follows:
1. Approve Resolution 97-XX authorizing payment of $83,868.00
for permanent easements over the regional water quality pond
property as part of the CSAH 42 upgrade project.
2. Table this item for a specific reason.
3. Deny this agenda item for specific reasons.
Alternative No.1. Staff recommends that the Council approve
Resolution 97-XX approving payment for an easement over the
proposed regional water quality pond.

RESOLUTION AUTHORIZING PAYMENT FOR AN EASEMENT OVER THE
PROPOSED REGIONAL WATER QUALITY POND AS PART OF THE COUNTY
ROAD 42 UPGRADE.

WHEREAS, Scott County proposes to upgrade CSAH 42 from Fernda1e Ave. to Mckenna Rd.
to a four lane highway, including storm sewer, and
WHEREAS, The Nationwide Urban Runoff Program (NURP) requires treatment of storm water
runoff prior to discharge to public waters, and
WHEREAS, Scott County, The City of Prior Lake, and the Prior Lake/Spring Lake Watershed
District have agreed that the best method of treating the storm water runoff to meet
NURP requirements is through the construction of a regional water quality pond.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The Council authorizes payment in the amount of $83,868.00 for a drainage and
utility easement for the proposed regional water quality pond as part of the CSAH 42
upgrade project.
2. Payment will be made to the property owners in two equal payments, one of which
will be in 1997 and the other in 1998.
