RESOLUTION 97 -XX ORDERING THE 1998 IMPROVEMENT
PROJECTS AND PREPARATION OF PLANS AND
SPECIFICATIONS THEREFORE.

INTRODUCTION:
The purpose of this agenda item is to conduct a public hearing for
the 1998 Capital Improvement Program (CIP) projects that require
the City to follow the Minnesota Statutes (MS), Chapter 429
process. These projects are: Pleasant Street, Colorado Street,
Birch Avenue and West Avenue reconstruction; Duluth Avenue
reconstruction; and Pleasant Street overlay. Also, as part of this
item Council will consider a resolution to order these
improvements and authorize the preparation of plans and
specifications.
BACKGROUND:
The 1998 improvement projects were included in the CIP due to
the condition of the street surfaces. All have failing bituminous
surfaces and bituminous curb with the exception of Birch Avenue
from Pleasant to Colorado Street which has a gravel surface. It is
no longer cost effective to continue to patch the streets.
On August 18, 1997, Council passed Resolution 97-68 ordering
the preparation of a feasibility report for those projects in the 1998
CIP required to follow the MS Chap. 429 process. The projects
studied in the report were: Area 1 - reconstruction of Pleasant
Street, Colorado Street, Birch Avenue, and West Avenue; Area 2 -
reconstruction of Duluth Avenue from Pleasant Street to TH 13;
Area 3 - Five Hawks Avenue mill and overlay improvements; Area
4 - realignment and signalization of CR 23 and Five Hawks
Avenue; and Area 5 - mill and overlay of Pleasant Street from
Duluth Avenue to Main Avenue and Main Avenue from Pleasant
Street to Colorado Street. The recommendation of the feasibility
report was to proceed with Areas 1, 2 and a portion of Area 5.
Areas 3 and 4 were determined not to be economically feasible in
1998. The Main Avenue overlay was deleted from the Area 5
proposed improvements due to its condition and pending the
outcome of the Downtown Redevelopment Steering Committee
created by the Economic Development Authority. On October 20,
1997, Council passed Resolution 97-96 accepting the feasibility

report and calling for a public hearing on November 17, 1997 for
the 1998 improvement projects.
DISCUSSION:
The Public Hearing will cover the following three projects:
1. Area 1 - Reconstruction of Pleasant Street from Park Avenue
to Duluth Avenue, Colorado Street from Lakeside Avenue to
West Avenue, Birch Avenue from Pleasant Street to Lakeside
Avenue, and West Avenue from Pleasant Street to Eagle
Creek Avenue including storm sewer, sanitary sewer,
watermain, aggregate base, concrete curb and gutter,
bituminous surfacing, pedestrian walkways, and appurtenant
work.
2. Area 2 - Reconstruction of Duluth Avenue from Pleasant
Street to TH 13 including storm sewer, sanitary sewer,
watermain, aggregate base, concrete curb and gutter,
bituminous surfacing, pedestrian walkways, and appurtenant
work.
3. Area 5 - Mill and bituminous overlay of Pleasant Street from
Duluth Avenue to Main Avenue.
Details of the projects and proposed financing will be presented to
the public at the hearing.
Financing of the improvements is recommended as follows:

The properties abutting each project are subject to assessment.
Each of the affected property owners has been notified prior to the
Public Hearing. Public Informational Meetings were held on
November 5 and 6, 1997' to provide the property owners an
opportunity to discuss the projects in an informal setting prior to
the Public Hearing. Summaries of the meetings are as follows:
Area 1- Pleasant Street, Colorado Street, Birch Street and
West Street: Eighteen residents attended the meeting which was
held on November 5, 1997 at 6:30 p.m. After a brief presentation,
discussion included the need for curb and gutter, the need for

replacing watermain and sewer, sidewalk placement, driveway
access during construction, and assessments.
Area 2 - Duluth Avenue: Fifteen residents attended the meeting
which was held November 6, 1997 at 6:00 p.m. Discussion at this
meeting mainly centered around replacement of sanitary sewer
and watermain and assessments for the utility improvements.
Concern was also expressed regarding roadway alignment and
width and how the proposed improvements would affect existing
buildings and landscaping. These are issues that would be
addressed in the design phase of the project.
Area 3 - Pleasant Avenue Overlay: Eight residents attended the
meeting which was held on November 5, 1997 at 5:30 p.m.
Those in attendance requested that the existing sidewalk be
replaced in addition to the pavement overlay.
On past City projects, the Council has authorized consulting firms
to prepare plans and specifications. As one way to reduce project
costs, it is the goal of the Engineering Department to design all
City projects in-house. As a step towards achieving this goal and
if preparation of plans and specifications is approved, staff is
proposing to complete the design and preparation of plans and
specifications for the Duluth Avenue project, and potentially, for all
of the 1998 improvement projects. To be able to do this
successfully we have set up a design schedule that includes
specific milestones in the design process. If staff is unable to
meet these deadlines we will solicit fee proposals for the
completion of this work from consulting firms for Council
consideration.
ISSUES:
The purpose of this public hearing is to determine whether the
projects should move forward. The next step is preparation of
plans and specifications which will provide greater information
about expected project cost and, therefore, the assessments
associated with these improvements. The Council could decide
not to continue with one or more of the projects upon receipt of
bids. A separate assessment hearing would be conducted
following review of the proposed assessments by the City
Council's Assessment Committee who could recommend
modifications to the proposed assessments to deal with unique
circumstances.
ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Conduct the Public Hearing and approve Resolution 97-XX
which orders the 1998 Improvements and authorizes City staff
to prepare plans and specifications for Areas 1, 2, and 5.

ORDERING 1998 IMPROVEMENTS AND PREPARATION OF PLANS
AND SPECIFICATIONS FOR PLEASANT STREET, COLORADO STREET,
BIRCH AVENUE AND WEST AVENUE (PROJECT 98-14), DULUTH
AVENUE (PROJECT 98-15) AND PLEASANT AVENUE OVERLAY (PROJECT 98-16)

WHEREAS, pursuant to resolution 97-96 which the City Council adopted on October 20, 1997,
calling for a Public Hearing to be held on the 1998 Improvement Projects which
include the following improvements and generally described project areas:
1. AREA 1 - Pleasant Street from Park Avenue to Duluth Avenue, Colorado
Street from Lakeside Avenue to Duluth Avenue, Birch Avenue from Pleasant
Street to Lakeside Avenue, West Avenue from Pleasant Street to Eagle
Creek by the construction of storm sewer, sanitary sewer, watermain,
aggregate base, concrete curb and gutter, pedestrian trails, bituminous
surfacing, and appurtenant work; and
2. AREA 2 - Duluth Avenue from Pleasant Street to TH 13 by the construction
of storm sewer, sanitary sewer, watermain, aggregate base, concrete curb
and gutter, pedestrian trails, bituminous surfacing, and appurtenant work;
and
3. AREA 5 - Pleasant Street from Duluth avenue to Main avenue by bituminous
overlay and appurtenant work.
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given,
and the hearing was held on the 17th day of November, 1997, at which time all
persons desiring to be heard were given an opportunity to be heard thereon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. Such improvements are hereby ordered as proposed in Council Resolution
97 -96 adopted the 20th day of October, 1997.
2. The City Engineer is hereby designated as the Engineer for these
improvements. The Engineer shall prepare plans and specifications for the
making of such improvements.
3. The City Engineer is hereby authorized to prepare plans and specifications
for Areas 1, 2, and 5.
