CONTINUING CITY PARTICIPATION IN THE
LIVABLE COMMUNITIES PROGRAM
OCTOBER 20, 1997
In 1995, the state legislature adopted the Metropolitan Livable
Communities Act. This provided for three funding accounts
which would be available to communities which elected to
negotiate housing goals with the Metropolitan Council. The act
specifies that communities must adopt a resolution by
November 15th of each year to indicate their intent to
continue in the program for the following calendar year.
The City has participated in this program for the past two
years.The Act requires that a dollar figure be established for
each community for the year in which it participates. This
figure is to be spent in the community for low and moderate
income housing. For 1998, the Affordable and Life Style
Housing Opportunities Amount (ALHOA) for Prior Lake is
zero. Last year, the ALHOA was $21,113. Because the
ALHOA for next year is zero and because the Scott County
HRA spends approximately $400,000 a year in Prior Lake on
programs which qualify for the ALHOA, we do not anticipate
that the City will be required to make any additional
payments.
Continuation of City participation will maintain the City's
eligibility for participation in the funding programs which are
available. The Council needs to determine if continued
participation is necessary or desirable. At pres~nt, there are no
commitments which the City must meet and, in the event the
City wishes, there are funds available for various housing-
related activities.
Previous staff reports have indicated that several things might
happen if the City failed to participate, including the
following:

money available through the program.
· The Metropolitan Council will report to the Legislature on
the status of the program and will likely highlight those
communities that elect not to participate.
. The City could be viewed unfavorably by the public if it
does not participate.
. The lack of participation will be considered in any
decision in the City which involves a regional investment,
an impact on a metropolitan system or a MUSA
expanSIOn.
ALTERNATIVES: 1. Adopt the attached resolution confirming continued
participation in the Livable Communities Program for 1998.
2. Elect to terminate participation in the program.
RECOMMENDATION: Alternative 1. The Resolution does not commit the City to
specific actions, but only continues the City's eligibility to
participate in the Livable Communities Program.

RESOLUTION ELECTING TO CONTINUE PARTICIPATING IN THE LOCAL
HOUSING INCENTIVES ACCOUNT PROGRAM UNDER THE METROPOLITAN
LIVABLE COMMUNITIES ACT

WHEREAS, the Metropolitan Livable Communities Act (Minnesota Statues Section 473.25 to
473.254) establishes a Metropolitan Livable Communities Fund which is intended to address
housing and other development issues facing the metropolitan area defined by Minnesota
Statutes section 473.121; and
WHEREAS, the Metropolitan Livable Communities Fund, compnsmg the Tax Base
Revitalization Account, the Livable Communities Demonstration Account and the Local
Housing Incentive Account, is intended to provide certain funding and other assistance to
metropolitan area municipalities; and
WHEREAS, a metropolitan area municipality is not eligible to receive grants or loans under the
Metropolitan Livable Communities Fund or eligible to receive certain polluted sites cleanup
funding from the Minnesota Department of Trade and Economic Development unless the
municipality is particpating in the Local Housing Incentives Account Program under the
Minnesota Statutes section 473.254; and
WHEREAS, the Metropolitan Livable Communities Act requires the Metropolitan Council to
negotiate with each municipality to establish affordable and life-cycle housing goals for that
municipality that are consistent with and promote the policies of the Metropolitan Council as
provided in the adopted Metropolitan Development Guide; and
WHEREAS, each municipality must identify to the Metropolitan Council the actions the
municipality plans to take to meet the established housing goals through preparation of the
Housing Action Plan; and
WHEREAS, the Metropolitan Council adopted, by resolution after a public hearing, negotiated
affordable and life-cycle housing goals for each participating municipality; and
WHEREAS, a metropolitan area municipality which elects to participate in the Local Housing
Incentives Account Program must do so by November 15 of each year; and

WHEREAS, for calendar year 1998, a metropolitan area municipality that participated in the
Local Housing Incentive Account Program during the calendar year 1997, can continue to
participate under Minnesota Statues section 473.254 if: (a) the municipality elects to participate
in the Local Housing Incentives Account Program by November 15, 1997; and (b) the
Metropolitan Council and the municipality have successfully negotiated affordable and life-cycle
housing goals for the municipality:
NOW, THEREFORE, BE IT RESOLVED THAT the City of Prior Lake hereby elects to
participate in the Local Housing Incentives Program under the Metropolitan Livable
Communities Act during the calendar year 1998.
Passed and adopted this 20th day of October, 1997.
