OCTOBER 20,1997 INTRODUCTION: The purpose of this agenda item is to consider approval of a policy for the acceptance of proposed County highway turnbacks. BACKGROUND: Scott County has proposed the turnback of three County road segments to the City. The three proposed segments are listed below and shown on an attached map: 1) 170th St - East from TH 13 to CSAH 23. (0.15 mile) 2) CSAH 39 (Franklin Trail) - From TH 13 South to TH 13 North. (1.21 miles) 3) CR 81 - From TH 13 to CSAH 12. (0.58 mile) City Council Directive 97-27 directed staff to meet with Savage and Shakopee to discuss the proposed turn backs to each City and prepare a policy for the acceptance of proposed turnbacks for Council consideration. DISCUSSION: Enclosed is a memorandum of understanding drafted by the Scott County Highway Engineer covering the financial and maintenance considerations associated with the turn backs. This proposal is the same as has been offered to the Scott County townships wherein the County proposes to turn roads back to the town board. State statute requires that when a county revokes a county road designation and turns the road back to a township they are required to provide for the maintenance of the road for two years from the date of the revoking resolution. The County indicated they wanted to be fair and treat the Cities the same as the townships. If the County Board of Commissioners has the political will there is nothing that prevents them from unilaterally voting to revoke a County Road designation, thus turning it back to the City or township in which it is located. Staff has met with Savage and Shakopee to discuss the turnback proposals for each City. Although we may not all agree to a uniform 162~ Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER ALTERNATIVES: RECOMMENDATION: ACTION REQUIRED: CIYTIl.DOC policy for the acceptance of turn backs, we are in agreement that the proposed financial and maintenance offers from the County are inadequate. Savage has gone so far as to ask for total reconstruction of all the proposed turn backs in that City. Although Shakopee believes the offers are low, they are waiting to see the results of Savage's negotiations, and to see what Prior Lake may get as well. The offer of an overlay or pay an equivalent of $30,000 per mile is inadequate to address the existing problems. The $30,000 figure translates to a 3/4 inch overlay. As indicated in the County's proposal this would amount to the following for each road segment: 0.15mileof170thSt. =$4,500 1.21 miles of cSAH 39 = $36,600 0.58 mile of CR 81 = $17,400 It is staffs opinion the amount of work required to bring these road segments to an acceptable level is far in excess of these proposed amounts. The enclosed proposed policy on County Road Turnback Acceptance offers a fair and impartial method to determine the corrective action needed and the associated costs. It is a simple and fair process to provide for the turnback of County roads to the City. Corrective work can be scheduled into the County Capital Improvement Program and the County can utlimately save all future maintenance costs of these streets. There are four alternatives for the City Council to consider: 1. Approve the policy as presented. 2. Amend and approve the policy. 3. Deny this item for a specific reason and provide staff with direction. 4. Table this item until some date in the future. Alternative NO.1. 1. A motion and second to approve the policy as presented for presentation to the City's County Commissioner and the County Administrator. HOTH SI.E., MEMORANDUM OF UNDERSTANDING HIGHWAY JURISDICTIONAL CHANGE Scott County and the City of Prior Lake, through this Memorandum of Understanding, pursuant to Minnesota Statutes 163.11, agree to the following County highway revocations: . . Transfer the jurisdiction of 170th Street E. from TH 13 to CSAH 23 Transfer the jurisdiction of CSAH 39 from the south junction with TH 13 to the north junction of TH 13 Transfer the jurisdiction of CR 81 from TH 13 to CSAH 12 . TOTAL * Includes portion of road within Prior Lake 0.15 mile* 1.21 miles 0.58 mile* .. 1. 94 miles In consideration of Prior Lake assuming responsibility for the above highway segments, Scott County would provide the following: . 170th St. (0.15 mile) - overlay or pay equivalent ($30,000/mile) = . CSAH 39 (1.21 miles) - Overlay or pay the equivalent ($30,OOO/mile) = . CR 81 (0.58 mile) - Overlay or pay the equivalent ($30,000/mile) = . Maintain highway segments for 2 years after the County Board turnback decision or pay the average cost per mile between County and city's annual roadway maintenance for the base year (1994) but not to exceed the County's cost or $5,958/mile/year CITY OPTIONS (Please circle option selected) 170th St. * Overlay or $ 4,500 CSAH 39 Overlay or $ 36,300 CR 81* Overlay or $17,400 Maintenance 2 Yr. EVALUATION At City cost, City and County jointly approve a consultant to evaluate each street proposed for turn back. Consultant determines corrective action requir~d to bring street to acceptable (as defined by City) levels of: a) surface rating, b) load rating, c) curb, gutter and storm sewer, d) signage and signals, and other miscellaneous corrections required. 2. CORRECTION County completes corrective action in accordance with consultant recommendations at the County's option: 1) own forces, 2) change order to another County contract, 3) bid the work, 4) enter a cooperative agreement with the City to have the City complete the work. County or contractor warranties the work for two years. 3. ACCEPTANCE When work is completed to the satisfaction of the City Engineer, the City will accept the street(s) and provide for immediate and ongoing maintenance. The County will have no further obligations except under the warranty provisions.
