BACKGROUND: At the August 18, 1997, City Council meeting, Council authorized staff to prepare a Feasibility Report for the 1998 Improvement projects as approved by the Council in the 1998-2002 Capital Improvement Program. In the adopted Resolution No. 97-68, the following five project areas were listed to be considered for the report: 1. Reconstruction of Pleasant Street from Park Avenue to Duluth Avenue, Colorado Street from Lakeside Avenue to West A venue, Birch Avenue from Pleasant Street to Lakeside Avenue, and West Avenue from Pleasant Street to Eagle Creek Avenue including storm sewer, sanitary sewer, watermain, aggregate base, concrete curb and gutter, bituminous surfacing, concrete sidewalk and appurtenant work. 2. Reconstruction of Duluth Avenue from Pleasant Street to TH 13 including storm sewer, sanitary sewer, aggregate base, concrete curb and gutter, bituminous surfacing, pedestrian walkways and appurtenant work. 3. Mill and bituminous overlay of Five Hawks Avenue from TH 13 to Priorwood Street. 4. Mill and bituminous overlay of Pleasant Street from Duluth A venue to Main A venue and Main Avenue from Pleasant Street to Colorado Street. DISCUSSION: The attached report indicates the estimated City costs for each project, along with preliminary assessment estimates. At the end of the Feasibility Report, a project financing summary is included to show project cost splits. The total estimated project cost of the five projects is $2,725,160.00. The following is a commentary on each project with regard to project need: Area 1 -Pleasant Street, West Avenue. Birch Avenue. and Main Avenue Pleasant Street has a 25-foot wide bituminous surface with bituminous curb from Park A venue to Duluth Avenue. Replacement of sewer and water is proposed in Pleasant Street from approximately 125 feet west of Birch Avenue to Duluth A venue where the road is undergoing reconstruction and the utilities were constructed in 1959. W est Avenue between Pleasant Street and Eagle Creek A venue has a 29-foot wide bituminous surface with bituminous curb. Replacement of sanitary sewer and water is proposed between Pleasant and Colorado Streets where existing sanitary sewer and water were constructed in 1959. Birch Avenue is a gravel roadway from Pleasant Street to Colorado Street and has a 30-foot wide bituminous surface with bituminous curb from Colorado Street to Lakeside Avenue. Area 2 - Duluth Avenue Duluth Avenue between Pleasant Street and TH 13 is a bituminous roadway with no curb which varies in width from 30 to 34 feet. Extension of sanitary sewer is proposed with this project to serve a house that is currently on a private septic system. Replacement of watennain which was constructed in 1958 is proposed. Area 3 -Five Hawks Avenue Five Hawks Avenue between Priorwood and TH 13 is a 30-foot wide bituminous roadway with concrete curb and gutter. The G:\AGENDA97\98FEAS.DOC 2 feasibility report discusses improving this roadway to a 9-ton standard. Area 4 - Realignment and Signalization of Five Hawks Avenue and CR23 The proposed work to the subject intersection would include the realignment of Five Hawks Avenue north of TH 13 with the proposed realignment of County Road 23 south of TH 13 and installation of a traffic signal. A feasibility report was prepared for this project in February of 1992 by Strgar-Roscoe-Fausch, Inc.(SRF). The Engineering Department has copies on file for review. Plans for the traffic signal were prepared in 1994. The cost estimate for this project was revisited in 1996 and meetings with MnDOT, Scott County and the School District were held to discuss funding of this project. At that time, the proposed cost shares were MnDOT: $160,000; Scott County: $200,000; City: $340,000; Assessable: $50,000; and School District: $50,000. MnDOT and Scott County have recently been contacted about participation in 1998. MnDDT recommended pursuing funding for signalization through their cooperative agreement program. Preliminary information including estimates and roadway layout have been sent to MnDOT. The deadline for submission of the cooperative agreement request is mid-December and the selections for the program are made in mid-January. Scott County does not have this project in their 5-year program, but suggested two funding options. The county has a fund set aside for safety projects which may cover their share of the traffic signal (approx. $30,000). The second option is for the County to reimburse the City at a later date. In either case, it appears that $200,000 which is the County's estimated share, would not be covered by either program. Through a meeting with County Market owners, it has come to the attention of City staff that a Cub Food store, including building expansion and additional retail stores, is proposed at the County Market site. Expansion of the site would make this project more desirable for safety and access reasons. Area 5 -Pleasant Street and Main Avenue Overlay Pleasant Street from Duluth Avenue to Main Avenue has a 36-foot wide bituminous surface with concrete curb and gutter. Milling G:IAGENDA97\98FEAS.DOC 3 and bituminous surfacing is proposed for this segment of Pleasant Street. Main A venue from Pleasant Street to Eagle Creek Avenue has a 60-foot wide bituminous surface with concrete curb and gutter. Milling and overlaying with bituminous surfacing is proposed for Main Avenue. The attached Feasibility Report outlines which portions of the cost for the above projects will be assessed to the benefiting properties. If the Council approves the Feasibility Report, the Chapter 429 special assessment projects require public hearings to be conducted prior to implementing the project. Staff proposes to conduct Informational Meetings prior to the Public Hearings to help the residents understand and answer any questions. ISSUES: During preparation of the feasibility report, a number of issues for City Council determination were found. A work session was held on October 13, 1997 so that staff could present these issues to the council. The following is a list of the issues with the outcome of the work session in bold print. A. Area 1 - Pleasant Street. Colorado Street, West Avenue, Birch Avenue The feasibility report proposes the replacement of sanitary sewer and watermain in Pleasant Street in the locations where existing utilities were constructed in 1959. The life of the cast iron pipe used to construct the watermain is approximately 50 years. The existing sanitary sewer is vitrified clay pipe. Video tape of the existing sewer shows the pipe separated at joints and roots at various locations. Although both the sanitary sewer and watermain may have some years of useful life left, from an engineering standpoint, the time to replace them is at the time of street reconstruction versus the possibility of tearing up the street if a repair is necessary. The issue is the funding source to cover the cost of the utility replacement. Three alternatives are as follows: 1. The sewer and water will be assessed on a front footage basis to the benefiting property owners either 100% or a percentage based on the remaining estimated useful life of the system. If a partial assessment method is used, the City's share could come from the Trunk Reserve fund. G:\AGENDA97\98FEAS.DOC 4 2. The city could finance the sewer and water replacement from the Trunk Reserve fund. 3. Street construction could be completed without replacing the utilities. Another consideration is that the watermain in the adjacent area (Area 5) which Area 1 would connect to was constructed in 1937 and the sanitary sewer was constructed in 1959. Alternative 1 using a partial assessment method (60% trunk reserve/40% assessable) will be addressed in the feasibility report. B. Area 2 - Duluth Avenue 1. Duluth Avenue is a Municipal State Aid Road. Currently, the Capital Improvement Program shows $100,000 of MSA funds for the reconstruction of Duluth. The feasibility report proposes tapering the roadway width from 44 feet wide at Pleasant Street to match existing and allow parking on both sides of the street down to 36 feet wide (MSA standard) approximately 400 feet south of Pleasant Street to TH 13. Staff will determine if a 44-foot roadway can be designed for the whole project length and address this in the feasibility report. 2. The proposed Duluth reconstruction project includes replacing watermain and sanitary sewer. As in Area 2 the cost would be assessed to affected property owners. The utilities will be partially assessed as in Area 1. C. Area 3 -Five Hawks Avenue 1. This project was programmed as a mill and overlay in the 1998 CIP. Due to the condition of the road several borings were taken to determine the existing pavement section. Based on the borings, constructing Five Hawks Avenue to a 9-ton standard will require removing the existing pavement section. The existing curb and gutter would remain in place. This additional work increased the cost from the CIP estimate. G:\AGENDA97\98FEAS.DOC 5 2. This section of Five Hawks Avenue abuts Area 4 and should be combined with the proposed CR23/Five Hawks A venue realignment improvements. Upgrading Five Hawks Avenue should be completed when the CR 23/ Five Hawks Avenue realignment project is constructed. D. Area 4 - CR 23 and Five Hawks Avenue Realignment and Signalization 1. Staff would like to pursue funding options for this project and report back to the Council at a later date. At that time, staff would request authorization to update the feasibility report if funding is available. Preliminary cost estimates are shown in the attached feasibility report. 2. The Capital Improvement Program shows $340,000 funded from Municipal State Aid funds. The City has already requested an advance to accomplish 1997 projects. We are limited to a maximum of $500,000 in advances. A request for $340,000 would be in excess of the maximum allowed. This project cannot be completed without funding commitments from MnDOT, Scott County and the School District. A letter will be sent to the Scott County requesting that this improvement be programmed in their Capital Improvement Program as they play a key funding role in this County/City/State project. E. Area 5 - Pleasant Street and Main Avenue Overlay The council may want to consider this project with respect to the recent moratorium on downtown building permits and formation of a downtown development task force. The council may wish to defer this project pending the outcome of the task force. Pleasant Avenue is in need of an overlay. Main Avenue will not be a part of this project. Conclusion In summary, Areas 1, 2, and 5 are feasible from an engineering and economic standpoint and will benefit the properties proposed to be assessed. While Areas 3 and 4 are feasible from an engineering standpoint, they do not appear to be economically feasible at this G:\AGENDA97\98FEAS.DOC 6 FINANCIAL IMP ACT: ALTERNATIVES: RECOMMENDATION: ACTION REQUIRED: G:IAGENDA97\98FEAS.DOC time due to limited funding from outside agencies (Area 4) and increased costs that arose during feasibility investigations (Area 3). The 1998 improvement projects are proposed to be financed by special assessments, tax levy, and Municipal State Aid. Funding sources and amounts are as shown below (Areas 3 and 4 are not included in the following amounts): 1.) Assessments 2.) Tax Levy 3.) Trunk Reserve 3.) Approve Resolution 97-XX accepting the Feasibility Report and establish a Public Hearing date as per Resolution 97-XX with amendments as appropriate based upon the above directions. 2. Table this item for a specific reason. 3. Deny Resolution 97-XX. Alternative No.1. Staff recommends that the Council accept the Feasibility Report for the 1998 projects and establish the Public Hearing date for areas 1, 2, and 5 as listed in Resolution 97-XX. Approval of the Feasibility Report does not grant final approval of any project. A motion and second to approve Resolution 97-XX as proposed or amended. 7 RESOLUTION 97-XX RESOLUTION ACCEPTING FEASIBILITY REPORT AND CALLING FOR A PUBLIC HEARING ON 1998 IMPROVEMENT PROJECTS MOTION BY: SECONDED BY: WHEREAS, pursuant to Resolution 97-68 of the City Council, adopted on August 18, 1997, a report prepared by the City's Engineering Department with reference to the following improvements and the generally described project areas: 1. AREA 1 - Pleasant Street from Park Avenue to Duluth Avenue, Colorado Street from Lakeside Avenue to Duluth Avenue, Birch A venue from Pleasant Street to Lakeside Avenue, West Avenue from Pleasant Street to Eagle Creek Avenue by the construction of storm sewer, sanitary sewer, watermain, aggregate base, concrete curb and gutter, bituminous surfacing, concrete sidewalk and appurtenant work; and 2. AREA 2 - Duluth Street from Pleasant Street to TH 13 by the construction of storm sewer, sanitary sewer, aggregate base, concrete curb and gutter, bituminous surfacing, pedestrian walkways and appurtenant work; and 3. AREA 5 - Pleasant Street from Duluth Avenue to Main Avenue by bituminous overlay and appurtenant work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that 1. The Council will consider the improvement of such streets and areas in accordance with the report and the assessment of property as described in the report for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvements of $1,799,926.00. 2. No. 21715 10 I/s /0, '7 I Date PRELIMINARY REPORT AND ESTIMATE OF COST FOR THE CITY OF PRIOR LAKE ON 1998 PUBLIC IMPROVEMENT PROJECTS SANITARY SEWER, WATERMAIN, STORM SEWER, GRADING, CURBING, WALKS, STREET PAVING, SURFACE IMPROVEMENTS, AND APPURTENANT WORK OCTOBER 1997 TYPE OF WORK The improvements proposed for construction during 1998 include sanitary sewer, watermain, storm sewer, sidewalk, bike path, bituminous overlayment, street surface improvements, and street reconstruction, including grading, concrete curb and gutter, retaining walls, boulevard restoration and appurtenant work. The proposed project locations within the city limits of Prior Lake are shown by Exhibit 1. A brief description of the improvements shown by Exhibit 1 is as follows: AREA 1 - Pleasant Street. Colorado Street. West Avenue and Birch Avenue To rehabilitate or restore streets to a 7-ton design standard. Includes reconstruction of Pleasant Street from Park Avenue to Duluth Avenue, Colorado Street from Lakeside Avenue to West Avenue, Birch Street from Pleasant Street to Lakeside Avenue, and West Avenue from Pleasant Street to Eagle Creek Avenue. AREA 2 - Duluth Avenue Reconstruction of Duluth Avenue from Trunk Highway 13 to Pleasant Street to a 9-ton standard. AREA 3 - Five Hawks Avenue Reconstruction of Five Hawks Avenue north of Trunk Highway 13 to Priorwood Street to a 9-ton standard. AREA 4 - Five Hawks Avenue/County Road 23 Intersection Realignment of County Road 23 with Five Hawks Avenue and construction of associated improvements. West Avenue and Birch Avenue Pleasant Street from Park Avenue to Duluth Avenue, Colorado Street from Lakeside Avenue to West Avenue, W est Avenue from Pleasant Street to Eagle Creek Avenue (eSAR 21), and Birch Avenue from Pleasant Avenue to Lakeside Avenue, within the north half of Section 2, Township 114 north, Range 22 west, Scott County, Minnesota. AREA 2 - Duluth Avenue Duluth Avenue from Trunk Highway 13 to Pleasant Street in Section 2, Township 114 north, Range 22 west, Scott County, Minnesota. AREA 3 - Five Hawks Avenue Five Hawks Avenue from Trunk Highway 13 to Priorwood Street within the southwest quarter of Section 2, Township 114 north, Range 22 west, Scott County, Minnesota. AREA 5 - Pleasant Street and Main Avenue Overlay Pleasant Street from Duluth Avenue to Main Avenue and Main Avenue from Pleasant Street to Eagle Creek Avenue are located within the north half of Section 2, Township 114 north, Range 22 west, Scott County, Minnesota. DESCRIPTION OF PROJECT A more detailed description of the projects that are proposed to be assessed are as follows: g:\projects\city\98FEAS.DOC 3 AREA 1- Pleasant & Colorado Street. West, Birch. & Main Avenue AREA 1 is shown on Exhibit 2. The portion of Pleasant Street from Park to Duluth Avenue, Colorado Street from Lakeside to West A venue, and W est Avenue from Pleasant Street to Eagle Creek Boulevard has a failing bituminous surface and bituminous curb and gutter. The portion of Birch A venue from Pleasant to Colorado Street has a gravel surface and is also rural in nature with no curb and gutter. Storm water runoff currently flows overland to shallow ditches and isolated wetlands. The portion of Birch Avenue from Colorado Street to Lakeside Avenue also has a failing bituminous surface with bituminous curb. These failing bituminous surfaces were originally paved between 1973 and 1975. These streets no longer meet minimum design standards and it is not cost effective to continue to patch the streets. Proposed improvements include 7-ton design street reconstruction with storm sewer, retaining walls, concrete curb and gutter, concrete sidewalk, and bituminous surfacing. Street reconstruction provides the opportunity to replace the 1959 sanitary sewer and the 1959 watermain on Pleasant Street from Birch to Duluth Avenue and on West Avenue from Pleasant to Colorado Street. The typical street section is shown on Exhibit 3. Existing right-of-way is 66 feet wide on Pleasant Street, Colorado Street, and West Avenue and 50 feet wide on Birch avenue. No additional right-of-way or easement requirements are anticipated. The benefiting property owners will be assessed for street, water and sanitary sewer. Tax levy funds will be used to finance the City portion of the street reconstruction costs. Trunk reserve funds will be used to finance the City portion of the water and sanitary sewer replacements. AREA 2 - Duluth Avenue Duluth Avenue is shown on Exhibit 4. The street is designated as a Municipal State Aid route. The portion of Duluth Avenue from T .H. 13 to Pleasant Street has a failing bituminous surface and is rural in nature with no curb and gutter. Storm water runoff currently flows overland to shallow ditches and isolated wetlands. Proposed improvements include street reconstruction with storm sewer, concrete curb and gutter, bituminous trail, and bituminous surfacing. Street reconstruction provides the opportunity to extend the sanitary sewer to 16460 Duluth Avenue, which presently has a private septic system and replace watermain and sanitary sewer which were constructed in 1958 and 1959. As shown on Exhibit 5, this road is proposed to be built to a 9-ton design. Duluth Avenue is designated as a minor collector street. The proposed roadway width will taper from 44 feet at Pleasant Street, matching the existing street width north of Pleasant Street, down to 36 feet in width which is the Municipal State Aid standard, as shown on Exhibit 4. A 44-foot roadway for the total project length was also investigated. Due to the topography of the adjacent land, this option does not appear to be feasible without acquisition of additional right-of-way to accommodate slopes and the proposed bituminous trail. g:\projects\city\98FEAS.DOC 4 The existing right-of-way is 66 feet wide. Easements will be necessary for storm sewer construction. Estimated costs for acquiring easements are included in the project cost for Duluth Avenue. Benefiting properties will be assessed, while the balance of the project costs will be paid from the project levy and Municipal State Aid funds. AREA 3 - Five Hawks Avenue Five Hawks Avenue is shown on Exhibit 1. Five Hawks Avenue from T. H. 13 to Priorwood Street was originally paved in 1982 with concrete curb and gutter. The bituminous portion of the street is failing and no longer meets design standards. Initially, this project was proposed to be a mill and overlay. During feasibility investigations, it was determined that replacement of the entire pavement section, including establishment of an adequate subgrade would be necessary in order to achieve a 9-ton roadway. Proposed improvements include street reconstruction with aggregate base and bituminous surfacing. Existing curb and gutter will remain in place. As shown on Exhibit 6, Five Hawks Avenue is proposed to be built to a 9-ton standard. Both Five Hawks Avenue and Priorwood within Eagle Creek Villas, which is a 9-ton road and connects Five Hawks to Duluth Avenue, are designated as minor collector streets. The benefiting property owners will be assessed for the improvements. The City costs, which will include oversizing from a 7-ton to a 9-ton road, are proposed to be financed by tax levy. AREA 4 - Five Hawks Avenue/County Road 23 Intersection A detailed feasibility was prepared in 1992 by Strgar-Roscoe-Fausch, Inc. The report recommended the relocation of County Road 23 to align with the intersection of TH 13 and Five Hawks Avenue, including the final realignment of CR 23 and 170th Street. The proposed improvements include street, traffic signal, storm sewer, sanitary sewer and watermain construction. Right of way acquisition would be required for this project. The costs for acquiring right- of-way and/or easements are included in the project cost for Area 4. Plans for the traffic signal have been prepared. Funding is proposed through a cooperative agreement from MnDOT, Scott County participation, School District participation and assessments to benefiting properties. City costs were proposed to be paid from State Aid funds. AREA 5 - Pleasant Street and Main Avenue The portion of Pleasant Street from Duluth to Main Avenue has concrete curb and gutter with a failing bituminous surface. Proposed improvements include a 2" bituminous removal and overlayment. Area 5 originally included an overlay on Main Avenue from Pleasant Street to Colorado Street. Since Main Avenue appears to be in adequate condition and is part of a future downtown development plan, this portion of the project was deleted. g:\projects\city\98FEAS.DOC 5 The Pleasant Street overlay project is proposed to be funded through special assessments to the benefiting property owners and tax levy funds. FEASIBILITY From an engineering standpoint, project number 1,2,3, 4 and 5 are feasible, independent of each other, and can be accomplished as proposed, and not in conjunction with each other or any other project. ESTIMATED COST The following costs were prepared based upon an Engineer's Estimate and are subject to change, depending on the final design of the project, bids received, and actual work performed. The method of assessment and rate will be determined at the Assessment Hearing. The estimated project cost for each project is for the installation of associated improvements and includes indirect project costs. Project costs in Areas 1 through 5 include special assessments. AREA 1- Pleasant Street. With a total project cost of $2,725,160 an estimated bond of $1,610,837 and an assessment total of $761,473, the assessed amount would be 47%. If Areas 1,2, and 5 are approved, the total project cost is $1,799,926 with an estimated bond of $1,426,603 and an assessment total of $652,379, the assessed amount would be 46%.
