HomeMy WebLinkAbout4G - Special Assessments on DNR and Post Office Property AGENDA #: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: DISCUSSION: STAFF AGENDA REPORT 4G RALPH TESCHNER, FINANCE DIRECTOR CONSIDER APPROVAL OF RESOLUTION 97-XX AUTIIORIZING ABATEMENT OF SPECIAL ASSESSMENTS ON DNR AND POST OFFICE PROPERTY DECEMBER 15, 1997 This consent item is basically a housekeeping item in response to a request by the Scott County Auditor's Office to abate old special assessments dating back to 1980 and 1981 on two parcels of property, one owned by the State of Minnesota and the other by the federal government. (see attached map showing property location) In 1978 Lot 2 Block 29 (PIN #25 133 023 0) Spring Lake Townsite' was assessed for sewer and water improvements. Subsequently on January 6, 1981 the City Council removed the balance of special assessments because the property was purchased by the DNR, however the 1980 installment of $304.86 has remained delinquent on the county tax records ever since. Similarly, the City upgraded Anna Trail in 1980 with new pavement and concrete curb and gutter at the time the property (PIN # 25 902 049 2) was being purchased by federal government as the Prior Lake Post office. This transaction voided our special assessment in the total amount of $5,831.78. Attached with your agenda report is a copy of the correspondence received from Deputy Auditor Tom Lannon requesting the City to formally abate these special assessments so that they may clean up the delinquent taxes that are on their system. The basis for this action is that these properties are exempt from any property taxes and special assessments of any type and therefore do not receive property tax statements. If the City chose not to abate, the assessments would remain outstanding and in a delinquent state which would require annual maintenance by the county with respect to their computer tracking. The City did ask the Post Office at the time of the public hearing to participate in the cost but they declined. The only way the City could ever recover these dollars is if the property were sold to a private taxpaying property owner at some time in the future which is highly unlikely. 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. ALTERNATIVES: Council has the following alternatives: 1. Approve Resolution 97-xx Authorizing Abatement of Special Assessments on DNR and Post Office Property. . 2. Deny the abatement request. 3. Defer for additional information. RECOMMENDATION: Alternative 1. Staff would recommend abating the special assessment balances as indicated above since both parcels are owned by tax exempt government entities. RESOLUTION 97-xx RESOLUTION AUTHORIZING ABATEMENT OF SPECIAL ASSESSMENTS ON DNR AND POST OFFICE PROPERTY MOTION BY: SECOND BY: WHEREAS, Scott County Auditor's Office has requested the abatement of special assessments on property owned by the state of Minnesota (DNR) and federal government (Post Office); and WHEREAS, The purpose of the special assessment abatement request is to allow Scott County to cleanup their tax records and purge uncollectable delinquencies; and WHEREAS, Both parcels are owned by tax exempt governmental entities which are not required to pay property taxes or special assessments; and. WHEREAS, The debt service fund balances for each of the projects affecting the above referenced parcels are sufficient to cover the assessment abatements. NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF PRIOR LAKE, the special assessments on the following described properties and in the amounts indicated are to be abated: Property Owner Legal Description Amount 1.
