INTRODUCTION:
The purpose of this Agenda item is to consider approval of a
resolution of partial concurrence with Scott County resolution
97120 which revokes County State Aid designation from
CSAH 39 (Franklin Trail) and designates portions of County
Roads 21, 42, 82, and 83 as County State Aid Highways.
Concurrence by the City is required by state statute in order
for the County to designate, abandon, change, or revoke a
County State Aid Highway within a municipality. The
resolution is partial concurrence because the
recommendation is to approve the designations and
disapprove the revocation of CSAH 39.
BACKGROUND:
Scott County has recently gone through a review of their
entire roadway system to determine which roadways should
be what type of roadway and under who's jurisdiction. The
proposed County Road turnbacks the Council has previously
discussed was one result of this review. In the process of
their review the County also received permission from the
State to add approximately 38 miles of roadway to their
County State Aid System.
The state aid system is comprised of those streets and
highways under local (vs. state) jurisdiction that are eligible
for funding from the state gasoline tax. The state gas tax is
constitutionally distributed 62% to the state trunk highway
fund, 29% to the county state aid fund, and 9% to the

municipal state aid fund. In turn, each county and each
municipality over 5000 population receive an allocation of
state aid funds based on a formula. In the case of the
county the allocation is proportional to the number of miles
of county state aid it has designated. As in Prior Lake,
county highways are either state aid and eligible for
construction and maintenance funded in whole or in part
with state aid money, or they are funded with local property
tax dollars.
The additional mileage to the County's state aid system is a
significant accomplishment. For many years the total county
state aid system statewide was capped at 30,000 miles and
additions were miserly approved by the County State Aid
Screening Board. The rules were recently changed
removing that cap and a number of metro counties have
been successful in getting additions of this size approved for
their systems.
DISCUSSION:
The County wishes to designate and add to their state aid
system portions of County Roads 21, 42, 82, and 83,
described as follows:
1. A non-existent piece of County 21 from its northerly
terminus at CSAH 42, north and northeasterly to intersect
with new CSAH 18. Although it is non-existent, this is
eligible for designation as a County State Aid Highway in
accordance with state aid rules. The City has previously
expressed support for completion of this segment of
roadway.
2. County Road 42, from CSAH 17 easterly to McKenna
Road. This segment is not currently on the state aid
system.
3. County Road 82, from CSAH 17 easterly to CSAH 21.
4. County Road 83, from County Road 82 northerly to CSAH
101 (formerly TH 101).
These designations will allow the County to annually receive
state aid funds for these segments of road and to use state
aid funds for construction of these segments in the future.
The addition of these segments to the County's state aid
system will bring additional state aid dollars into the County.

The addition of these roadways to the state aid system
significantly increases the chances that the County would
undertake improvements to these roadways in the future.
The Scott County Board in Resolution 97120 also included
the revocation of the County State Aid designation from
CSAH 39, Franklin Trail. Without City concurrence on this
revocation the County cannot revoke the CSAH designation
and will not be able to redesignate the 1.21 miles of CSAH
from Franklin Trail to another County Road, which is their
ultimate goal. Whether this is total leverage to prevent a
turnback is unclear. However, for whatever leverage it
provides the City in its turnback negotiations with the
County, a resolution of concurrence on the CSAH revocation
should not be forthcoming from the City until such time as
the turnback issue is resolved.
The alternatives are:
1. Adopt Resolution 97 -XX concurring with Scott County's
designation of portions of County Roads 21,42, 82, and
83 as County State Aid Highways.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

REVOKING COUNTY STATE AID HIGHWAY NO. 39;
AND DESIGNATING PORTIONS OF
COUNTY STATE AID HIGHWAYS NO. 21, 42, 82, AND 83

WHEREAS, the County Board of Commissioners of the County of Scott did adopt
Resolution No. 97120 on October 21, 1997, designating a portion of County State Aid
Highway No. 21, within the corporate limits of the City of Prior Lake as follows:
Beginning at a point on County State Aid Highway No. 42 (l40th Street
Northeast), at or near the southeast comer of Section 22, Township 115
North, Range 22 West; thence northerly on or near the east line of
Sections 22 and 15 of said township. and range to a point on Eagle Creek
Boulevard (County State Aid Highway No. 16); thence northeasterly
through Sections 14 and 13 of said township and range to a point on
County State Aid Highway No. 18 (New County Highway No. 18), in the
northwest quarter of said Section 13, and there terminating; and
WHEREAS, the County Board by Resolution No. 97120 did also gesignate a portion of
County State Aid Highway No. 42, within the corporate limits of the City of Prior Lake
as follows:
Beginning at the junction of Marschall Road (County State Aid Highway
No. 17) and 29th Avenue in the City of Shakopee, on or near the south
line of Section 19, Township 115 North, Range 22 West; thence easterly
on or near the south section lines of Sections 19, 20, 21, and 22 of said
township and range to the junction of McKenna Road and 140th Street
(County State Aid Highway No. 42), in the City of Prior Lake, and there
terminating; and
WHEREAS, the County Board by Resolution No. 97120 did also designate County State
Aid Highway No. 82, within the corpo,ratelimitsofthe City of Prior Lake as follows:
Beginning at a point on County State Aid Highway No. 17 (Marschall
Road), in Section 32, Township 115 North, Range 22 West; thence
easterly through Sections 32, 33, and 34 of said townshio and range, to a
point of intersection of County State Aid Highway No. 21 (Eagle Creek
Avenue) and 154th Street, ~n or near the east section line of said Section
34, all in the City of Prior Lake, and there terminating; and

South, also through Sections 33, 28, 21, 16,9, ap.d 4 of said t0wnship and
range to a point on C6unty State Aid Highway ~o. 101 (formerly Trunk
Highway No. 101) in the City of Shakopee, and there terminating; and
WHEREAS, the County Board by Resolution No. 97120 did also revoke County State
Aid Highway No. 39 within the corporate limits of the City of Prior Lake as.follows:
Beginning at the north junction of Trunk Highway No. 13 and Franklin
Trail (County State Aid Highway No. 39) in Section 36, Township 115
North, Range 22 West; thence southerly and westerly along Franklin
Trail to a point at the south junction of Trunk Highway No. 13 and
Franklin Trail in Section 2, Township 114 North, Range 22 West, all in
the City of Prior Lake, and there terminating.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that
said designation of County State Aid Highways No. 21, 42, 82, and 83, all within the corporate
limits of the City of Prior Lake is hereby approved.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that said
revocation of County State Aid Highway No. 39 within the corporate limits of the City of Prior
Lake is hereby NOT approved.
