HomeMy WebLinkAbout8A1 - Labor Agreement AFSCME AGENDA#: PREPARED BY: SUBJECT: DATE: INTRODUCTION: DISCUSSION: STAFF AGENDA REPORT 8A (1) BRET WOODSON, ASSISTANT CITY MANAGER CONSIDER APPROVAL OF RESOLUTION 97-XX RATIFYING AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND COUNCIL #14, LOCAL 3884, AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES (AFSCME), AFL- CIO DECEMBER 15, 1997 The AFSCME bargaining unit representing secretarial, clerical, maintenance, and technical employees of the City of Prior Lake was formed in 1993. The present agreement, previously approved by the City Council for the years 1996-1998, provides for a wage reopener for selected positions within the Unit. Those positions include: Community Service Officer, Receptionist / Secretary, Maintenance Worker I and II, and Park Maintenance Worker II. Wage negotiations were to occur upon completion of a comprehensive study of the City's job classifications and structure (see agendas item 7C). The City's negotiating team, consisting of myself and Labor Attorney John Roszak have met with the bargaining unit representing these employees many times since late 1996 when the Employee Classification System was approved by the City Council. The purpose of the negotiations were to address the wage "reopener" in accordance with the Public Employee Labor Relations Act (PELRA) and with the labor agreement ratified by the City Council in August of 1996. Mter analyzing the results from the study conducted by ROI, the City has determined the following in regards to the five positions included in the reopener: Community Service Officer (CSO) - This position was reclassified on December 23, 1996 to a higher grade so it 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. Part-time Receptionist I Secretary (Police and Parks & Recreation Departments) - These two positions, which include four employees, have now been reclassified as Part-time Secretaries and will be moved to pay grade 5 of the new classification system. This is the same classification as the full-time secretaries. The positions were previously one grade lower than the full-time secretaries. The change recognizes that both full and part-time positions in this classification are performing essentially the same responsibilities. Maintenance Worker I and II - These positions continue to be classified in two different levels. A minor change was made to the position titles so Maintenance Worker I's will now become Maintenance Worker V's (grade 5) and Maintenance Worker II's will now become Maintenance Worker VI's (grade 6). These changes do not result in any change in pay. Park Maintenance Worker II - This position also received a new title, but did not change classification levels. Park Maintenance Worker II's will now become Maintenance Worker V's (grade 5). This change in title does not change the pay. During the negotiations on the above mentioned positions, two additional items were brought to the table by the City for discussion. They included the Leadworker position classification and the City of Prior Lake Employee Classification System. The Leadworker position was evaluated and placed in grade 7 of the of the Employee Classification System. This is one level higher than existing Maintenance Worker VI's. The City of Prior Lake Employee Classification System was brought to the table by the City in an effort to bring some consistency between the AFSCME contract and the City's new classification system. The Agreement for which Council ratification is requested includes the new ranges from the City of Prior Lake Employee Classification System. Labor Agreements typically do not provide complete satisfaction to either party. However, they do represent an equitable conclusion of bargaining between the two respective groups. This Agreement, therefore, will now allow us the opportunity to focus upon the issues at hand, which are considerable in our growing community. ALTERNATIVES: The Council has the following alternatives: 1. Approve Resolution 97-XX ratifying the attached Agreement. 2. Defer action on the Agreement subject to receipt of additional information. RECOMMENDATION: Staff recommends Alternative #1 ACTION REQUIRED: Motion and second to adopt Resolution 97-XX ratifying the Agreement with the AFSCME Bargaining Unit. The current Labor Agreement between the City of Prior Lake and AFSCME Council #14, Local 3884 contains a Memorandum of Understanding that includes the following language: "The parties agree to reopen wage negotiations following the completion of a study of job classifications no later than January 1, 1997 for the purpose of negotiating wages for the CSO, Receptionist / Secretary, Maintenance Worker I and II, and Park Maintenance Worker II." It also states that any adjustments in grades will result in pay adjustments retroactive to January 1, 1996. The City and the Union have discussed this issue by way of communication between the Assistant City Manager and the Union Steward, formal negotiations between the two parties, and one mediation session. During these discussions two additional items were brought to the table for discussion. They included the Leadworker position classification and the City of Prior Lake Employee Classification System. A study was completed in October of 1996 by ROI Consultants to fully review the City's entire classification structure, including the position classifications mentioned above. Discussion occurred after the results were distributed to AFSCME. The results were incorporated into the new City of Prior Lake Employee Classification System. After analyzing the results from the study conducted by ROI, the City has determined the following in regards to the five positions included in the reopener: Community Service Officer (CSO) Position was reclassified on December 23, 1996 to pay grade 5 of the new classification system. Retroactive pay has been made. Part-time Receptionist I Secretary (Police and Parks and Recreation Departments) The City has reclassified these positions to pay grade 5 of the new classification system. This is the same classification as full-time secretaries. The full-time receptionist I secretaries, however, will remain in pay grade 4 of the new classification system. Retroactive wages will be paid to the four employees effected by the change in grade. Maintenance Worker I and II These positions were given new titles, but continue to be classified in two different levels. Maintenance Worker I's will now become Maintenance Worker V's (Grade 5) and Maintenance Worker II's will now become Maintenance Worker VI's (Grade 6). These changes do not result in any changes in pay grades. Park Maintenance Worker II This position also received a new title but did not change classification levels. Park Maintenance Worker II's will now become Maintenance Worker V's (Grade 5). This change in title does not change the pay grade. The Leadworker position classification was also determined. Leadworker Position is included in Grade 7 of the Employee Classification System. This is one level higher than existing Maintenance Worker VI's. The pay ranges listed in the Employee Classification System were also agreed to by both parties for the remainder of 1997 and 1988 as listed below. This system was established so that the City would have a system that keeps the City in compliance with Comparable Worth, keep the City in a good position to recruit and retain good employees, and stays within the City Council and budgetary guidelines. On this new plan, all current AFSCME employees fall in a range that is at or higher than the existing ranges contained in the current AFSCME contract. The Collective Bargaining Agreement will be amended consistent with this agreement to reflect these changes. The City will draft the ammended Collective Bargaining Agreement and the Union will review the changes and give its approval. The new Collective Bargaining Agreement will thereafter be the Labor Agreement between the two parties. IN WITNESS WHEREOF, the parties have signed this Agreement on the dates indicated.
