HomeMy WebLinkAbout8A3 - Labor Agreement - Sergeants AGENDA#: PREPARED BY: SUBJECT: DATE: INTRODUCTION: DISCUSSION: ISSUES: STAFF AGENDA REPORT SA (3) BRET WOODSON, ASSISTANT CITY MANAGER CONSIDER APPROVAL OF RESOLUTION 97-XX RATIFYING AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES REPRESENTING POLICE SERGEANTS DECEMBER 15, 1997 The Sergeants bargaining unit representing three employees was formed in 1994. This contract represents the results of the "reopener" bargaining envisioned by the contract approved by the City Council this past May. The only item included in the "reopener" for 1998 is health insurance contributions. The City's negotiating team, consisting of myself and Labor Attorney John Roszak have drafted an agreement to satisfy the "reopener" item for 1998 in accordance with the Public Employee Labor Relations Act (PELRA) and with the labor agreement ratified by the City Council this past May. The City has already settled on health insurance contributions for AFSCME for 1998. That amount is $415 per month for family coverage. The City offered and the Union has accepted the same monthly contribution for health insurance in 1998. This represents a $10 increase from 1997 when the City contributed $405 per month. An agreement reflecting the agreed upon increase is attached for City Council approval. Labor Agreements typically do not provide complete satisfaction to either party. However, this particular issue was not very controversial, as a fair offer was made and accepted. This Agreement, therefore, represents an equitable conclusion of bargaining which allows us the opportunity to focus upon the issues at hand, which are considerable in our growing community. 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. Defer action on the Agreement subject to receipt of additional information. RECOMMENDATION: Staff recommends Alternative #1 ACTION REQUIRED: Motion and second to adopt Resolution 97-XX ratifying the Agreement with the Sergeant's Bargaining Unit. Attachments CC98REOP.DOCl1124/97 ~INNESO~"t- ESOLUTION RATIFYING AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES UNION LOCAL 320 REPRESENTING POLICE SEARGENTS RESOLUTION 97-XX MOTION BY: SECOND BY: WHEREAS, the Public Employee Labor Relations Act as amended requires that the City negotiate with the exclusive bargaining representative for groups of essential and non-essential employees; and, WHEREAS, the Minnesota Teamsters Public and Law Enforcement Employees Union Local 320 represents the three Prior Lake Police Sergeants; and, WHEREAS, the current ratified Labor Agreement includes language calling for a reopener to negotiate health insurance contributions for the period of 1/1/98 - 12/31/98; and, WHEREAS, negotiations have taken place which have resulted m an Agreement for 1998; and, WHEREAS, the employees who make up the Minnesota Teamsters - Sergeants bargaining unit have ratified said agreement; and, WHEREAS, the Agreement becomes effective on January 1, 1998; and, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that it hereby ratifies the Agreement between the City of Prior Lake and the Minnesota Teamsters Public and Law Enforcement Employees Union Local 320, January 1, 1998 through December 31, 1998; and, BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized to execute the above referenced Agreement. The current Labor Agreement between the City of Prior Lake and Minnesota teamsters Public and Law Enforcement Employees Union Local No. 320 contains the following language: "Notwithstanding any other provisions to the contrary, the exclusive representative may provide the City with a notice of its desire to reopen negotiations only on the following subjects." For 1998, the only reopener up for negotiation is Section 22.1: Employer Contribution to the Premium for Health and Hospitalization Insurance. As of November 12th, the City has not yet received a "Notice of Desire to Negotiate." that is to be filed with the Bureau of Mediation Services if a bargaining unit desires to reopen negotiations. On Thursday, November 13th, the City was told verbally by the Union Steward that this notice was being filed within the next week. In an effort to settle this issue in a timely and efficient manner, the City and the Union have discussed the reopener issue by way of communication between the Assistant City Manager and the Union Steward. The City has offered, and the Union accepts, to raise the employer contribution to the premium for health and hospitalization insurance to $415 effective January 1, 1998. In doing so, the City and the Union agree to amend Section 22.1 of the current Labor Agreement between the City of Prior Lake and Minnesota Teamsters Public and Law Enforcement Employees Union Local No. 320 to read as follows: 22.1 The Employer will select and provide group health insurance with benefits at the same level as presently exists. The employer will pay a sum not to exceed the monthly premium off{mr ooadrcd fi'fc dollars ($~05) four hundred fifteen ($415) per month for individual and dependent coverage, effective January 1. 1998. In the event premiums are increased beyond the maximum contribution paid by the employer, then such increases shall be paid by the employee through payroll deduction.
