HomeMy WebLinkAbout4C - Police & Fire Agreement AGENDA #: PREPARED BY: SUBJECT: DATE: BACKGROUND: DISCUSSION: ISSUES: ALTERNATIVES: STAFF AGENDA REPORT 4C ~~ FRANK BOYLES, CITY MANAGER' W ADDENDUM TO THE POLICE AND FIRE AGREEMENT BETWEEN THE SHAKOPEE MDEWAKANTON DAKOTA COMMUNITY AND THE CITY OF PRIOR LAKE November 3,1997 As the Council is aware, the City has entered into a four year agreement with the Dakota Community for Police and Fire Protection services in 1996. The first two years of the contract set forth the annual payment. The last two years (1998 and 1999) were to be negotiated. The purpose of this agenda item is to execute an addendum to the 1996 - 1999 Police and Fire Agreement to establish a fixed fee for 1998 and 1999. Attached is a draft addendum to the 1996-1999 Police and Fire Agreement which establishes a fee of $255,000 for calendar year 1998 for Police and Fire Services and a fee of $265,572 for 1999. These amounts would include the Community's local share contribution to the Cops Fast program, which will provide a Police liaison officer to the Community. These are the only amendments to the existing Police and Fire Agreement which would be effectuated by this addendum. As I indicated to the Council in an earlier Update Memorandum, the Dakota Business Council has agreed to these new fees and this action is the formalization of our negotiated agreement. The Council has the following alternatives: 1. Authorize the Mayor and City Manager to execute the addendum to the 1996 - 1999 Police and Fire Agreement. 2. Defer action for a specified reason. Attachment FlREMDE.DOC ADDENDUM TO POLICE AND FIRE PROTECTION AGREEMENT BETWEEN THE SHAKO PEE MDEW AKANTON SIOUX (DAKOTA) COMMUNITY AND THE CITY OF PRIOR LAKE This Addendum to the Intergovernmental Police and Fire Protection Service Agreement (hereinafter, the "Addendum") is executed and entered into this day of , 1997 by and between the Shakopee Mdewakanton Sioux (Dakota) Community, a sovereign Indian Tribe federally recognized and organized under the provisions of the Indian Reorganization Act of 1934 (48 Stat. 984) (hereinafter, the "Community") and the City of Prior Lake, a municipal corporation in Scott County, Minnesota (hereinafter "City"). Whereas, the Community and the City executed the Intergovernmental Police and Fire Protection Agreement (hereinafter, the "Agreement") on February 20, 1996; and Whereas, the Community and City have each determined that it is in the best interests of each to establish the fee amount paid by the Community to the City for years 1998 and 1999; and Whereas, in light of the terms of the Agreement and the desire to establish the fee amount paid by the Community to the City for years 1998 and 1999 , the Community and the City wish to enter into this Addendum to ensure the prompt and satisfactory continuation of the intergovernmental cooperation between the Community and the City; IT IS HEREBY AGREED AS FOLLOWS: 1. All terms, conditions and provisions of the Agreement, to the extent not specifically altered by this Addendum, remain in full force and effect. 2. The Community shall pay City a fixed fee of Two Hundred Fifty Five Thousand Dollars ($255,000) for the calendar year of 1998. Fees to the City in the year 1998 shall be made in equal quarterly payments of Sixty Three Thousand Seven Hundred Fifty Dollars ($63,750) no later than fifteen days after the beginning of each new calendar quarter. The Community shall pay City a fixed fee of Two Hundred Sixty Five Thousand Five Hundred Seventy Two ($265,572) for the calendar year of 1999. Fees to the City in the year 1999 shall be made in equal quarterly payments of Sixty Six Thousand Three Hundred Ninety Three Dollars ($66,393) no later than fifteen days after the beginning of each new calendar quarter. Addendum to Police and Fire Protection Agreement Page 2 Included in the fixed fee amounts for the years 1998 and 1999 are all fees for police, fire and emergency response services and the "local share" (as defined by the federal grant guidelines) of the funding obligation designated for the COPS FAST program. IN WITNESS WHEREOF, the Community and the City have caused this Addendum to be signed in their names by themselves or by their duly authorized representatives and delivered as their act and deed, intending to be legally bound by all of its terms and conditions.
