HomeMy WebLinkAboutCreekside Condo CIC Plat MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT MAY 19,2003 SF JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1091 (CREEKSIDE CONDOMINIUM) CIC PLAT History: On September 18, 2000, the City Council adopted Resolution 00-89 approving the preliminary plat for Creekside Estates. The preliminary plat consisted of 12.7 acres, to be developed with 3 lots for multifamily dwellings, and one outlot. The development includes a total of 102 units for senior housing. On December 18, 2000, the City Council also adopted Resolution 00-128 approving the final plat for Creekside Estates. This final plat created 3 lots for a total of 102 townhouse units. On AugustS, 2002, the City Council adopted Resolution 02~124 approving a CIC plat for the 24-unit apartment building located on Lot 2, Block 1. This plat created individual lots for each individual unit in order to allow the individual sale of these units. Current Circumstances: At this time, the developer is requesting approval of an amendment to the Creekside Condominium CIC plat. The purpose this amendment is to correct a mistake made in the original CIC plat. Two of the units, #202 and #302, were not built as shown on the plat. The CIC plat does not change the number of units or the density of the development. Staff has reviewed the CIC plat and finds it consistent with the approved preliminary and final plats. The Issues: CIC plats do not require a development contract. The required developer improvements were included under a previous final plat, so no Letter of Credit is necessary. Staffwill be available to discuss the details of this plat with the Council. Budf!et Impact: There are no budget impacts with the approval of this amended CIC plat since the building has already been built. The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1091 Amended (Creekside Condominium) CIC Plat. 2. Deny the resolution approving the CIC plat. 3. Defer this item and provide staffwith specific direction. The staff recommends adoption of Alternative #1 as part of the consent agenda. A motion and second to adopt a resolution approving the Common Interest Community Number 1091 Amended (Creekside Condominium) CIC Plat and authorizing the Mayor and City Manager to sign the CIC plat documents is required. 1:\03 files\03 subdivisions\03 cic\creekside amend\cc report. doc Page 2 RESOLUTION 03-XX RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1091 AMENDED (CREEKSIDE CONDOMINIUM) CIC PLAT MOTION BY: SECOND BY: WHEREAS: on September 18, 2000, the City Council approved the preliminary plat known as Creekside Estates, subject to conditions identified by Resolution 00-89; and WHEREAS: on December 18, 2000, the City Council adopted Resolution 00-128 approving the final plat of Creekside Estates; and WHEREAS: On August 7, 2002, the City Council adopted Resolution 02~124 approving the Common Interest Community Number 1091 (Creekside Condominium) CIC Plat; and WHEREAS: The applicant is requesting approval of an amendment to Common Interest Community Number 1091 (Creekside Condominium) CIC Plat in order to correct a mistake made in the original CIC plat; and WHEREAS: The City Council has found that the Common Interest Community Number 1091 Amended (Creekside Condominium) CIC Plat is in substantial compliance with the approved preliminary plat for Creekside Estates and the approved final plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that the City Council has approved the Common Interest Community Number 1091 Amended (Creekside Condominium) CIC Plat and it should and hereby does require the following conditions to be met, prior to release of, and recording of said plat: 1. The recitals set forth above are incorporated herein as if fully setforth. 2. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by July 19, 2003, will render the CIC plat null and void. 3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
