VARIANCE AND WATER ORIENTED ACCESSO~Y STRUCTURE
This information is provided to clarify issues associated with
Variance 92-18 granted June 18, 1992 to the Munsingers of 15229
Fairbanks Trail, Prior Lake. See attached Variance application.
The application indicates a 6% lot coverage,S' north side, 3.5'
south side, and a 12' west front yard variance was granted. The
variance allows construction of a 24' x 24' attached garage,
repairs, and a stairway addition to the existing house access and
deck. Conditions attached to the variance include replacement of
two trees compliant with Prior Lake tree planting requirements in
type, size, and species, but located somewhere in the front yard.
A Variance runs with the land and is 900d for one (1) year, but
may be extended for one year by appear~ng before the Planning
Commission and making the request. There is no fee for this
request, but it must be for the exact Variance granted. Changes
to the request require a new Variance application.
During the hearin9 the applicant indicated construction of a
storage shed wh~ch did not meet setback requirements. The
Plann~ng Commission ordered the applicant to comply with City
Codes. The applicant may comply through Ordinance 91-07 Water
Oriented Accessory Structures (attached) which allows storage
sheds on lake lots if they meet certain criteria including
obtainin9 a building permit. Basically this shed will comply
if it ~s moved 10' from the side property line, 10' from the
Ordinary-High-Water mark which is the retaining wall, and kept
above the 909' contour elevation. The manhole cover in the back
yard is at the 910' elevation, so using that as a rough reference
point the shed would have to be located between the manhole' and
the house, 10' in from the side property line. A buildin9 permit
must also be obtained for the shed, but it could be appl~ed for
at the same time as the garage/deck building permit and
incorporated into that one building permit. The shed compliance
is not a condition of the Variance however, it should be brought
into compliance within 30 days of this letter. If these
conditions are not acceptable the shed must be removed.

If the proposed structure will be located
below the regulatory flood plain elevation,
the structure must be built compliant with
ap~licable flood proofing requirements of the
BU1lding Code and Prior Lake Flood Plain
Ordinance; and
Trees that are four (4) inches in caliper or
larger, should not be removed for the erection
of a water-oriented accessory structure. If
removal is necessary, replacement with like
trees must be made with the approval of the
Buildin~ Official. Erosion control measures
as requ~red by the Building Official must be
implemented and all disturbed vegetation
replaced with sod or suitable landscaping
materials.
A new Definition of Water-Oriented Accessory Structure, is hereby
added to Prior Lake City Zoning Ordinance Section 8.1 to read as
follows:

The structure must not be designed or used for
human habitation and must not contain water
supply. or sewage treatment facilities.
However, the structure may contain electrical
and aechanical systems; and
The structure must be constructed of treated
wood and/or block that is ~atible with the
prin~~al ~t~~~~re and des1gnea to reduce
ViS1Dl 1ty as v1ewed from public waters 'i and
adjacent shorelands by vegetation, topography,
increased setbacks or color, assuming summer,
leaf-on conditions; and
8.1 WATER-ORIENTED ACCESSORY STRUCTURE: A building of one
hundred twenty (120) square feet or less used to store
boating accessories and equipment located on lake shore
lots that contain steep slopes equal to or greater than
twenty percent (20\) which because of the relationship
of its use to a surface water feature reasonably needs
to be located closer to the lakeshore ordinary high
water mark O-H-W than the normal structural setback
requirement.
A new paragraph 6.3 E. is hereby added to Prior Lake City Zoning
Ordinance to read as follows:
One (1) Water-Oriented Accessory Structure may be
allowed per lot on General Development (GO) lakes
that have munici~al sewer and water, provided a
building permit ~s obtained from the City of .Prior
Lake and the following criteria are met:
