A RESOLUTION PROVIDING FOR THE VACATION OF THE EXISTING THE PLATTED ROAD
RIGHT-OF-WAY FOR ST. PAUL AVENUE ADJACENT TO 16280 ST. PAUL AVENUE SE AND 5061
MINNESOTA STREET SE

WHEREAS, A petition for the vacation of the platted right-of-way for St. Paul Avenue (originally
platted as Prior Avenue) adjacent to the properties at 16280 St. Paul Avenue and 5061
Minnesota Street has been duly presented to the City of Prior Lake, and
WHEREAS, Notice of the hearing has been duly published and posted in accordance with the
applicable Minnesota Statutes, and
WHEREAS, A Public Hearing was held on said petition on Monday, October 1,2007, in the Council
Chambers at City Hall; during which the City Council then proceeded to hear all
persons interested in said petition and persons interested afforded the opportunity to
present their views and objections to the granting of said petition; and
WHEREAS, This portion of St. Paul Avenue is not improved and 16280 St. Paul Avenue is the only
residence accessing the right-of-way; and
WHEREAS, There are telephone and gas lines located within the right-of-way; and
WHEREAS, New drainage and utility easements will be dedicated prior to recording the vacation
resolution.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council of Prior Lake has determined that the vacation of said right-of-way would be in the
public interest.
3. Pursuant to Minnesota Statues 412.851, the following described drainage and utility easement is
hereby vacated:
Legal Description:
That part of Prior Avenue as dedicated in COSTELLO'S ADDITION TO PRIOR LAKE, MINN., Scott
County, Minnesota, lying north of the northeasterly line of Credit River Road SE and south of a line
150.00 feet south of the south line of vacated Dakota Street.
4. The vacation is subject to the following condition:
a) A drainage and utility easement must be provided over the existing right-of-way prior to
recording the vacation resolution.
b) The address for the property at 16280 St. Paul Avenue must be changed to a Credit River Road
address.
