FOR 1) THE 1999 IMPROVEMENT PROJECT (CITY PROJECT #99-11) AND 2) THE 2000 IMPROVEMENT PROJECT (CITY PROJECT #00-12 AND 00-13). HISTORY 1999 Improvement Project: On July 19, 1999, the City Council awarded a contract to Northwest Asphalt, Inc. for the 1999 Improvement Project (City Project #99-11), which included reconstruction of Candy Cove Trail north of TH 13, Lemley Circle, Woodlawn Circle, Manor Road, and Hill Circle. The original contract amount was $696,739.77. Due to quantity over-runs, the final contract amount is $787,371.83. All work under the contract has been completed in accordance with the contract. 2000 Improvement Project: On June 19, 2000, the City Council awarded a contract to Northwest Asphalt, Inc. for the 2000 Improvement Project (City Projects #00-12 and 00-13), which included reconstruction of Oak Ridge Circle, Flandrau Circle, Fulbright Circle, Indian Ridge Circle, Euclid Avenue, Maves Trail, Forsythe Road, Shannon Trail, Prior Circle and Shannon Circle and bituminous overlay improvements to Fairlawn Shores Trail. The original contract amount was $1,082,790.15.The final contract amount is $1,077,640.61. All work under the contract has been completed in accordance with the contract. ISSUES Both of these projects were constructed in 2000. Typically the punch lists and final payments should have been completed in 2001. Due to staffing changes both within the City and the Contractor's office, the final payments have been delayed. 1999 Improvement Project: The full and final payment is $90,635.47 over the original contract amount. The reason for this is quantity over-runs} In particular, common excavation and aggregate base quantities were much higher than had been estimated. Northwest Asphalt originally requested additional payment for common excavation over and above what this payment reflects. Through negotiations, staff was able to reduce the original request. 2000 Improvement Project: The full and final payment is $5,149.54 less than the original contract amount. CONCLUSION It is staff's recommendation to approve the final payments as requested. FISCAL IMPACT: 1999 Improvement Project: The total contract amount for the 1999 Improvement Project is $696,736.36. The final payment amount of $80,993.59 brings the revised contract amount to $787,371.83, which is $90,635.47 more than the original awarded contract amount. Funding for this amount is available in the Construction Fund. 2000 Improvement Project: The total contract amount for the 2000 Improvement Project is $1,082,790.15. The final payment amount of $54,596.88 brings the revised contract amount to $1,077,640.61, which is $5,149.54 less than the original awarded contract amount. ALTERNATIVES: There are three alternatives for the City Council to consider: 1. Approve Resolution 03-XX authorizing full and final payment to Northwest Asphalt, Inc. for the 1999 Improvement Project and Resolution 03-XX authorizing full and final payment to Northwest Asphalt, Inc. for the 2000 Improvement Project. 2. Deny this item for a specific reason and provide staff with direction. 3. Table this item until some date in the future. RECOMMENDED MOTION: A motion and second to approve Resolutions authorizing final payments to Northwest Aspha , Inc. for the 1999 and 2000 Improvement Projects. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, 1. The recitals set forth above are incorporated herein. 2. Full and final payment is hereby authorized to be made to Northwest Asphalt, Inc. in the amount of $80,993.59 for the total contract amount of $787,371.83 for the 1999 Improvement Project, City Project 99-11.
