RE: Lot 2. Block 1, Fountain Hills Addition. Scott County. Minnesota
Ladies and Gentlemen:
Reference is made to that certain Development Contract Fountain Hills Addition
Project #99-31 by and between Wensco ("Developer") and the City of Prior Lake, a
Minnesota municipal corporation ("City") dated September 20, 1999 (the
"Agreement"). Capitalized terms used but not defined herein shall have the meanings
given to them in the Agreement.
As of the date hereof, the City hereby certifies to the best of its knowledge as
follows:
1 . The Developer Improvements described in the Agreement have been
constructed and installed in accordance with the terms of the Agreement.
2. All amounts due and owing under the Agreement have been paid in full
and all letters of credit or other forms of security described in the Agreement have been
released.
3. Each of the actions and requirements to be taken or satisfied by
Developer under the Agreement have been fully completed and satisfied in accordance
with the terms of the Agreement.
4. The City knows of no default nor any facts, circumstances, acts or
omissions which with giving of notice and/or the passage of time would constitute a
default on the part of the Developer under the Agreement.
