CONSIDER APPROVAL OF A RESOLUTION APPOINTING A
REPRESENTATIVE AND AN ALTERNATE TO SERVE ON THE OUTLET
CHANNEL JOINT POWERS BOARD
Introduction
In June 2007 the City Council authorized the execution of a Joint Powers
Agreement and Cooperative Agreement for the construction, use, operation,
and maintenance of the Prior Lake outlet channel. The agreements are
between the City of Prior Lake and The Prior Lake-Spring Lake Watershed
District (PLSLWD), City of Shakopee and the Shakopee Mdewakanton Sioux
Community (SMSC). Together the four organizations participating in the Joint
Powers and Cooperative Agreement are defined as the "Project Cooperators."
Current Circumstances
As part of the agreement the City will participate in an initial meeting with the
Project Cooperators. The meeting is scheduled to take place on December
11, 2007, and will be noticed and open to the public. The City of Prior Lake
must choose a representative and alternate to represent them at this meeting.
Because the representatives will have voting authority, Staff recommends that
the representative be an elected official. The meeting will also include
technical discussions of engineering design and project budgeting. For this
reason Staff recommends that a senior staff member be approved as an
advisor to the elected official and as an alternate. The attached resolution
proposes that the Council liaison to the Watershed District be chosen as the
voting representative at Joint Powers meetings and the Public Works Director!
City Engineer to serve as alternate. In 2007 this would be City Councilor
Hedberg and Public Works Director Albrecht, respectively.
Financial commitments have been made as part of this agreement. All new
construction is paid from the Trunk Reserve fund, all maintenance is paid from
the Water Quality fund. Total liabilities resulting from the Agreements in this
form are estimated to total $750,000.00 over the next 20 years. Two-thirds of
the total amount is estimated to be paid by the Trunk Reserve fund in the initial
five years of construction. One-third of the total is estimated to be paid by the
Water Quality fund over the course of the 20-year maintenance period.
Portions of both of these liabilities have already been paid as part of
cooperation in early phases of construction; and the City's 2007-2011 and
2008-2012 Capital Improvement Program incorporated the cost included in
these agreements. A year by year schedule of estimates is included in the
JPA and MOA. Not included in the estimate of total liabilities are unknown
expenditures for emergency maintenance which are shared by the Project
Cooperators.

While many of the budgets and financial commitments have already been
made, the initial Project Cooperator meeting will set the budget for 2007 and
establish the emergency maintenance fund.
ALTERNATIVES:
1. Approve a resolution appointing the City Council Watershed District Liaison
to serve as city representative at Joint Powers meetings and the Public
Works Director I City Engineer to serve as alternate.
2. Deny this agenda item for a specific reason and provide staff with direction.
3. Table this item to a certain date in the future

A~SOLUTION APPOINTING THE CITY COUNCIL WATERSHED DISTRICT LIAISON
AND THE CITY PUBLIC WORKS DIRECTOR/CITY ENGINEER TO SERVE AS
REPRESENTATIVE AND ALTERNATE, RESPECTIVELY, AT THE PROJECT
COOPERATOR MEETING HELD ACCORDING TO THE JOINT POWERS AGREEMENT
AND MEMORANDUM OF AGREEMENT FOR THE RESTORATION AND MAINTENANCE
OF THE PRIOR LAKE OUTLET CHANNEL.

WHEREAS, The City of Prior Lake, Prior Lake Spring Lake Watershed District and the City of
Shakopee have entered into a Joint Powers Agreements for the maintenance of the
Prior Lake outlet channel; and,
WHEREAS, The City of Prior Lake, Prior Lake Spring Lake Watershed District, City of Shakopee
along with the Shakopee Mdewakanton Sioux Community have entered into a
Memorandum of Agreement for the same purpose; and,
WHEREAS, Restoration and maintenance of the Prior Lake outlet channel is consistent with
environmental goals set forth in the City Local Surface Water Management Plan and
those set forth in the City of Prior Lake 2030 Vision and Strategic Plan.
WHEREAS, The Joint Powers Agreement and Memorandum of Agreement require a
representative and alternate to attend Project Cooperator meetings.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council Watershed District Liaison, as appointed annually by the Council, is hereby
appointed to serve as City Representative at Project Cooperator meetings as spelled out in the
Memorandum of Agreement and Joint Powers Agreement for the maintenance of the Prior Lake
outlet channel.
3. The City Public Works Director! City Engineer is hereby appointed to serve as Alternate City
Representative at Project Cooperator meetings as spelled out in the Memorandum of Agreement
and Joint Powers Agreement for the maintenance of the Prior Lake outlet channel.
