ORDERING THE 2008 IMPROVEMENT PROJECT AND PREPARATION OF
PLANS AND SPECIFICATIONS (BROOKSVILLE HILLS)

On July 16, 2007, Council adopted Resolution 07-127 ordering the preparation of
a Feasibility Report for those projects in the 2007 Capital Improvement Program
(CIP) required to follow the Minnesota Statutes Chapter 429 process. The
Minnesota Statutes Chapter 429 process is required because the City Council
intends to specially assess a portion of the project. The roadways studied in the
report include Brooks Circle, Fillmore Avenue, Franklin Trail, and Itasca Avenue.
The 2008 Improvement Project is Phase One of a two phase improvement
project. The recommendation of the Feasibility Report was to proceed with this
project.
On November 19, 2007, Council adopted Resolution 07-193 accepting the
Feasibility Report and calling for a Public Hearing on December 17, 2007 for the
2008 Improvement Project.
Current Circumstances
The purpose of the Public Hearing is to determine if plans and specifications
should be prepared for Council consideration. The Public Hearing will cover the
reconstruction of Brooks Circle, Fillmore Avenue, Franklin Trail, and Itasca
Avenue, including sanitary sewer, water main, storm sewer, aggregate base,
concrete curb and gutter, bituminous surfacing, storm water pond, and
appurtenant work.
Details of the project and proposed financing will be presented to the public at the
hearing.
Assessments $397,461.00
Tax Levv $596,184.00
Sewer & Water Fund $526,239.00
Water Quality Fund $117,435.00
Project Total Cost $1,637,319.00
The proposed assessment rate for the project is $6,973/unit.
The properties deemed to specially benefit from the improvements, in most cases
the properties abutting the streets located in the project area, are subject to
assessment. Each of the affected property owners have been notified in
accordance with the statute regarding tonight's Public Hearing.

ISSUES:
A Public Information Meeting was held on December 12,2007 to provide the
property owners an opportunity to discuss the project in an informal setting prior
to the Public Hearing. Staff presented the proposed improvements, project
costs, estimated assessments and answered general questions regarding the
project. Comments received from the Public Informational Meeting will be
presented at the Public Hearing.
The Public Information Meeting also afforded staff an opportunity to provide
additional information regarding the voluntary rain garden program. Comments
and interest shown for the program will be presented at the Public Hearing.
Conclusion
City Staff is prepared to discuss each of the concerns presented at the Public
Hearing. If, in the Council's judgment, the issues should be addressed in the
plans and specifications, direction could be given to staff.
The purpose of this Public Hearing is to determine whether the project should
move forward to the next step, which is preparation of plans and specifications
which will provide greater information about expected project cost and, therefore,
the assessments associated with the improvements. Once the plans and
specifications are completed, they will be submitted to the City Council for
approval at the same time approval is sought to advertise for bids. The Council
could decide not to continue with the project upon receipt of bids. A separate
Assessment Hearing will be conducted following review of the proposed
assessments by the City Council's Special Assessment Committee.
In summary, the project is feasible from an engineering and economic
standpoint. If the preparation of plans and specifications is approved, the work
will be completed by City staff.
Wellhead Protection Area
This project is located within the City's Wellhead Protection Area. As a way to
reduce groundwater impacts within the Wellhead Protection Area, the Feasibility
Report has included a number of strategies. These strategies include reducing
the street widths, constructing a pond in Cardinal Ridge Park, creating native
plantings around the proposed pond, and a volunteer raingarden program.
Reduced Street Widths
As a way to decrease upfront costs, maintenance costs and reduce the amount
of impervious surface, the proposed design includes reducing the street widths in
the project area to 28 foot wide.
Prooosed Stormwater Pond
As part of the reconstruction project, a stormwater pond is proposed to be
constructed in Cardinal Ridge Park. The pond would provide stormwater
treatment for both the phase 1 and phase 2 of the Brooksville Hills
Reconstruction Project. Currently these neighborhoods do not have any ponding
as the stormwater flows onto the Water Treatment Facility. The existing pond
within the Cardinal Ridge Park was created to serve the stormwater needs of the
Cardinal Ridge Development and is not sized to handle the Brooksville Hills
neighborhoods. The proposed pond would provide treatment of stormwater prior
to flowing into the Cardinal Ridge Park pond. The Master Park Plan does not
include Cardinal Ridge Park for programmed events.

A separate Neighborhood Meeting for properties adjacent to Cardinal Ridge Park
was held on December 12, 2007. These property owners were afforded an
opportunity to comment and provide feedback for the proposed storm water pond
to be located on the west end of Cardinal Ridge Park. Comments and
suggestions from this Neighborhood Meeting will be presented at the Public
Hearing.
Voluntary Rain Garden Proaram
As an additional stormwater component for this project, City staff is proposing a
volunteer raingarden program. While the proposed pond will help with water
quality in the region, it cannot be sized to completely handle the stormwater for
these neighborhoods. By implementing this program, stormwater can be
intercepted by individual raingardens, meaning less water would flow to the
downstream ponds. Property owners could choose to participate in the program
and thereby have a raingarden in the boulevard in front of their home. City staff
would consult with property owners on the design and placement. Once
constructed property owners must provide the maintenance for these gardens.
ALTERNATIVES: The alternatives are as follows:
1. Conduct the Public Hearing and approve a resolution that orders the 2008
Improvements and authorizes City staff to prepare plans and specifications.
2. Table the Resolution for a specific reason.
3. Deny the Resolution.

the Prior Lake City Council on its own initiative has determined that it desires to
complete the 2008 Public Improvement Project; and
on November 19,2007, the City Council adopted Resolution 07-193 accepting the
Feasibility Report and calling for a Public Hearing to be held on the 2008 Improvement
Project which includes the reconstruction of Brooks Circle, Fillmore Avenue, Franklin
Trail, and Itasca Avenue including sanitary sewer, water main, storm sewer, aggregate
base, concrete curb and gutter, bituminous surfacing, storm water pond, and
appurtenant work; and
ten days mailed notice and two weeks published notice of the hearing was given, and
the hearing was held on the 1th day of December, 2007, at which time all persons
desiring to be heard were given an opportunity to be heard thereon; and
since the project is initiated by the City Council it must be approved by 4/5ths vote in
accordance with Minnesota Statutes 429.031 Subdivision 1 (t).
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements
delineated in City Council Resolution 07-193 adopted November 19, 2007 and by the required
statutory 4/5ths vote does hereby order the project.
3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer
shall prepare plans and specifications for the making of such improvements.
4. The City Engineer is hereby authorized to develop a rain garden program within the 2008
Improvement Project funded wholly or in part by the Water Quality Fund.

""\"'E50~" PRIVJ~TE DRIVEWAY RECONSTRUCTION GUIDELINES
As part of the street reconstruction, a portion of your driveway will be impacted. The extent
of the impact depends on a number of different factors including location of utilities, location
of the proposed street, and slope of the driveway. When the street is reconstructed, the
City's Contractor will saw cut the driveways just beyond where they have been impacted or if
necessary at the point required to maintain a certain driveway slope. The driveways will be
removed between the saw cut line and the street. Lastly the driveways will be reconstructed
with the same surfacing material and at the same width. For example if you have an 18 foot
wide concrete driveway, the City's Contractor will reconstruct the removed section of
driveway with an 18 foot wide concrete section.
During the reconstruction process, some property owners at an additional cost beyond the
assessment decide to have the remaining portion of their driveway removed as well and
have their full driveway reconstructed. The guidelines below detail the steps necessary to
coordinate full driveway reconstruction using the City's Contractor:
1. Property owners must decide whether they intend to have their full driveway
reconstructed using the City Contractor by January 30, 2008. Please
communicate this decision with Seng Thongvanh at 952-447-9834. In addition,
please communicate whether you would like to make any changes to the width or
surface material of your driveway. All changes in driveway widths must meet
City Ordinances. All additional costs for increasing driveway widths or changing
from bituminous to concrete will be the property owner's responsibility. Seng can
provide some rough cost estimates based on your driveway material, width, and
length. City S1aff will also use the communicated information to compute private
driveway quantities for bidding purposes.
2. Once the contractor bids are received, City Staff will use the private driveway
quantity bid prices to compute the property owner's additional cost for removing
and constructing their driveway beyond the point where it would have been saw
cut. If no changes were made to the driveway width or surface material this will
be the property owner's only additional driveway cost. If the property owner
requests changes to the driveway width or surface material, other bid prices will
be used to compute the cost differential and the property owner's extra cost for
constructing the driveway from the street to the point where it would have been
saw cut. Staff will communicate the property owner's total cost for the private
driveway reconstruction by May 1st, 2008.
3. The property owner's total cost for the full driveway reconstruction must be
received by June 15, 2008. If this private driveway cost is not received by the
City by this date, the City will follow its standard procedure and reconstruct and
replace the driveway from the street to the saw cut line.
When removing the driveway beyond the right of way, the City accepts no liability for
damaged sprinkler systems, invisible dog fencing, deteriorated garage block, landscaping, or
other unforeseen site conditions. These driveway reconstruction guidelines do not include
replacement of specialty driveways such as paver driveways, stamped concrete driveways,
or exposed aggregate concrete driveways. If you have any additional questions regarding
