CONSIDER APPROVAL OF A RESOLUTION APPROVING THE 2007 PRIOR
LAKE OUTLET CHANNEL JOINT POWERS AGREEMENT REIMBURSEMENT
Introduction
The purpose of this agenda is to approve payment the City of Prior lakes cost
share reimbursement for the 2007 Prior lake Outlet Channel Improvements and
Maintenance.
Historv
On June 18, 2007 the City Council approved the Joint Powers Agreement with
the City of Shakopee and Prior lake Spring lake Watershed District and a
Memorandum of Understanding with the City of Shakopee, Watershed District
and Shakopee Mdewakanton Sioux Community (SMSC) for the improvement
and maintenance of the outlet channel. The agreements included detailed cost
share estimates and cost sharing provisions for each party over the next several
years.
The agreements identified an estimated cost share of $140,000 for channel
improvements and maintenance for the City of Prior lake for 2007.
Current Circumstances
The Joint Powers Board met on December 11 to review the 2007 costs and
approved the cost share allocations. I represented the City of Prior lake at this
meeting as the Council-designated alternate to Councilor Hedberg who was
unable to attend.
There are no issues. The City has allocated sufficient funds in CIP and Water
Quality budget to account for the cost share. The improvement and perpetual
maintenance of the channel are very important to the City of Prior lake.
The 2007 CIP budgeted $140,000 for the City's cost share. The funding
breakdown included $25,000 and $115,000 from the Water Quality Budget and
Trunk Reserve respectively.
The actual costs to the City are lower due to the delay of projects and
reallocation of cost apportionment due to final land area calculations updated to
reflect property acquisitions by the SMSC prior to December 2007. The City's
cost share is $56,429 for 2007. The Water Quality and Trunk Reserve funds will
contribute $25,000 and $31,429 respectively.

It should be noted that the above costs are for 2007 only. Annually the City will
be making contributions to the improvement and maintenance of the channel as
detailed in the agreement.
ALTERNATIVES: 1. Approve a resolution authorizing reimbursement to the Prior lake Spring
Lake Watershed District in the amount of $56,429.
2. Deny this agenda item for a specific reason and provide staff with direction.
3. Table this item to a certain date in the future

WHEREAS, On June 18, 2007 the City Council approved the Joint Powers Agreement and
Memorandum of Understanding for the Outlet Channel improvement and maintenance;
and
WHEREAS, The improvement and maintenance of the Prior lake Outlet Channel is vital to the City
of Prior lake; and
WHEREAS, The City's cost for 2007 is less than budgeted; and
WHEREAS, The City's 2007 cost share is $56,429; and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City shall reimburse the Prior lake Spring lake Watershed District $56,429 from the following
funds: $25,000 (602-49420-530) and $31,429 (502-50081-501).
