Dear Mr. and Ms. Jacques and Mr. and Ms. Pint:
I recently spoke with Mr. Jacques about his concern over the County's valuation of the
parcels adjacent to his property. I also spoke with Mr. Pint about this same concern
earlier this year.
The County Assessor is responsible for determining the taxable value for all properties
in the City of Prior Lake. You will have the opportunity to discuss your valuation
concerns with the City Council when the Council conducts the Board of Equalization
hearing on May 5, 2008. Before that meeting, I would encourage you to meet with
County Assessor Bob Schmitt (952-496-8115) to discuss your questions. City staff will
be happy to facilitate that meeting at your request.
In the meantime, I have researched the information we have on the original transactions
for these parcels. Since this occurred more than 20 years ago, the only information I
could find was City Council meeting minutes. I am attaching excerpts from the minutes
of May 21, 1984, June 4, 1984, April 1, 1985, and October 7, 1985. I am also attaching
a map of the site for your information.

The next item on the agenda was to review the options to
settle the Lawsuit with Mike Benedict. City Planner Graser
and city Attorney Kessel reviewed and commented on this item.
Mr. Tom Jox commented on behalf of two property owners who
would like to settle this and purchase the parcel that the
easement is on. He made his proposal to the council and staff,
Ci ty Attorney Kessel s"!:.ated that he could either make a legal
opinion in the form of a letter or during an executive session
since this is a pending lawsuit.

issuing of building permits to either the O:!.son or Morlock/-
Erickson parcels. It was the consensus of the council that a
building permit could not be issued to either parcel until
that parcel was subdivided.

City Attorney Kessel stated that several ~eks ago, Mr. Pent and Mr. Jox
made a proposal for settling that Lawsuit. At that tirre they indicated
that they had negotiated a purchase of the property from Mr. Erlandson for
a price of $15,000.00. They proposed that they would pay $10,000.00 for
the property, then split it off aml attached it to their lots. There
would then be no need for access to that property, 'l'he tempor ilry roadway
would then be vacated. He further stated that. he was asked to check with
Mr. Benedict's attorney to see if sore settlement could be arrived at. Mr.
\ Benedict's attorney, indicated that after n:Niewing the file, a m?i:'nS of
settlement could be that Mr. Benedict would contribute $2500.00 of the
\purChase price, the City would contribute $2500.00, the land owners
contribute $10,000.00 and Mr. Erlmdson would then receive his $15,000.00
for the property. Mr. Erlandson thought. that it was a good idea and said
he 'would talk to Mr. Benedict. After Me. Erlandson discussed the proposal
with Mr. Benedict, Mr. Benedict's attorney called Mr. Erlandson and told
him that he himself would like to purchase the property. tofu:. !3enedicts
attorney suggested that he would pay !v'.r. Erlandson $12, 500 . 00 , the City
would contribute $2500.00 and then he would own and vacate the roadway.
City Attorney Kessel further stated that if the City ,;ras to go this route
we would be paying $2500.00 to vacate a roadway and that would be helping
him acquire the property. He st1'lted that he would feel m::>re comfortabl ~
if Mr. Pent and Mr. Jox acquired the property and t.he city contribute
toward that settl(~nt rather than Mr. Benedict's attorney's proposal.

conditions that 'M2re spelled out at a previous council mceting. The
proper-ty v.Dulc1 be purchased by Mr. Pent <1.'1d Mr. ,Tox and that the entire
lawsuit bet'M2en Mr. Erlandson, the city and Mr. Benedict v.Duld be dismis-
sed. The City v.Duld t.hen go along with vacating that roadway since there
would be no need for that access an:~re.
Mayor Johnson asked if there 'M2re any questions or. cc:mrents.
City Planner Graser stated that one of th8 stipulations was that all
asses~ments would be removed from the Erlandson property.
Motion by Schweich to direct City Attorney Kessel t.o draw up the agreement
and authorizing the p2yrrent of $3000.00 and tilt: removal of the assessments
in the amount of approximately $400.00 and that the agref'..rrent be between
Mr, Pent and Mr. Jox, seconded by Busse and upon a vote taken it. was duly
passed.

The next item on the agenda was to dis~us the Street OVerlay and Patching
Project. City F~gineer Anderson reviewed this for the council.
City Engineer Anderson stated that tonight's purpose WiJS an information
presentation, with a request for direction. 'I'he intent is to cane back on
June 11, 1984 with a feasibility study for overlaying of street.s for 1984.
The streets laid out for overlay are the :streets in the WillowS area,
Green Heights area, Anna Trail, Ridgenunt Aver.ue ann. streets in oaJ<wo<X1
Hills. He then displayed and carmented on 3 different alterr.atives. The
alternatives would be l)Rolled CUrbs at $20.64 per foot, 2)Shoe Forrred
Curb at $24.25 per foot and, 3)Concrete Curb and Gutter at $33.f:7 per foot.
After City Engineer Anderson's presentation there were questions and
corrments by Council and Staff.

Attorney Kessel recommended acceptance. Motion was made by Thorkelson, seconded

City Attorney Kessel also informed the Council that the U.s. Court of Appeals
grMted our Stay in the case of Shakopee M:::!ewakanton Sioux versus the City of
Prior Lake.
The next Council meeting will be Tuesday, October 15, 1985 at 7:30 p.m.
