To Whom It May Concern:
In a letter dated April 4, 2007, Dennis Christensen of Meridian Land Services asked me
to comment on the impact of the taking of 6,524 square feet from the existing parcel
described above. Specifically, he requested I review an aerial photograph to determine
whether the proposed taking will preclude the property owner from expanding the
existing building.
This parcel is zoned C-5 (Business Park Use District). Section 1102.1405 of the Zoning
Ordinance lists the minimum dimensional standards as follows:
1102.1405
Dimensional Standards. The minimum lot size in the "C-5" Business
Park Use District shall be 1 acre, and the minimum lot width shall be 1 00
feet. No more than 50% of any lot shall be covered by structures.
Maximum Floor Area Ratio is 0.50. No structure shall exceed 4 stories or
45 feet in height, whichever is less, except as provided in subsection
1101.508.
Section 1102.1406 lists the required setbacks:

Required Setbacks. Within the "C-5" Business Park Use District, the
following minimum setbacks shall apply:
FRONT SIDE REAR ARTERIAL &
COLLECTOR ROADS
Structure 30 ft. 20 ft. 30 ft. 50 ft.
Structure abutting 30 ft. 75 ft. 75 ft. 50 ft.
an "R" Use District
Parking Lot, Drive 15 ft. 6 ft. 10 ft. 30 ft.
Aisle, Ground Sign
In all cases, setbacks are measured from the right-of-way line or roadway easement
line, rather than the curb.
Based on the dimensions provided on the aerial photograph, the square footage of the
existing building is below the maximum 0.50 floor area ratio. The setback of the building
along CSAH 21 will be less than the required 50' with the property acquisition. There is

no setback shown along Fish Point Road, which is classified as a collector Street.
There may be room to locate an addition along Fish Point Road which will still meet the
required 50' setback. Any addition, of course, will require additional parking, which must
also comply with the required setbacks.
This letter shall not be considered approval or implied approval of any future
construction on this site. In order to determine whether any addition is consistent with
the Zoning Ordinance requirements, a certificate of survey will be required. This survey
must include, at a minimum, the existing setbacks of the building, the proposed size of
the addition, the proposed location and setbacks for the addition, and the number and
location of any additional required parking spaces.

Dear Ms Kansier:
I have talked to Mr, Reynolds about his plans for expanding the building on the above
property. He currently has no specific plans for expansion. However, he wants to know if
the taking of an additional 15 t016 feet of right of way for County 21 along the north side
of the property will preclude him from expanding the building if he decided to do so.
Therefore, I am asking that you review the enclosed air photo. It shows: 1) the distance
from the proposed new right of way line to the north edge of the existing building; 2) the
area in square feet of the entire parcel; 3) the area in square feet of the existing building;
4) the area in square feet of the two parking areas; 4) the area in square feet of the new
permanent highway easement ( cross hatched in yellow); and the area in square feet of
the proposed temporary construction easement (cross hatched in green).
Please note that the distance from the north edge of the existing building to the new right
of way line will be 37 feet at the northwest corner of the building and 34,3 feet at the
northeast corner of the building. The distance to the existinq right of way line is
approximately 52 feet at the northwest corner of the building and approximately 49,3 feet
at the northeast corner of the building. The distance from the north edge of the building
to the curb of the newly constructed County 21 is approximately 64 feet. The distance
from the north edge of the building to the south edge of the new walkway is approximately
45 feet.
The existing building contAins a totAl of approximAtely 28,709 squme feet and the lot
contains 158,041 square feet for an existing floor area ratio of 18%.

The concern Mr. Reynolds has with the proposed taking of An additionAl 15 to 16
foot right of way along the north side of the property is whether or not that taking
will impact his ability to expand the building if he ever decides to do so.
Therefore, I am asking you to review the enclosed air photo and constructions
plans and determine if the County's proposed taking of the permanent highway
easement by itself will impact Mr, Reynolds ability to expand the building at a
future date. If it will not have An impact, please state that in a letter, If it will
have an impact, please describe to the extent possible what that impact will be
in terms of expanding the building to the north. While making this
determination, please consider the cross sections from the construction plans
that show that the north edge of the existing building will be approximately 64
feet from the south edge of the curb and gutter of the newly re-constructed
County 21 and about 45 feet soutll of the newly constructed \Nalkway,
