Staff met with the Kop family on March 5, 1997 to discuss the
acquisition ofland and a life estate. At this meeting John Kop stated
that he would like $500,000.00 for his property.
The Parks Advisory Committee sllggested that the City should offer
the Kop's $300,000.00 and a life estate. Tom Scott drafted an offer,
conditioned upon Council approval, but there was no response.
Following this letter the family informed the City that they had hired
an attorney and that all communications should go through him.
Another appraisal was suggested by Kop's attorney. The next
appraisal firm which the family selected was C.B. LaSalle &
Associates. This appraisal was completed on October 15, 1997 with
an appraised value of$970,000.00. A complete chronology of the Kop
Farm acquisition process is attached as Figure 2.
Council Involvement
On May 6, 1996 there was ajoint meeting of the City Council and the
Parks Advisory Committee. At this meeting the P.A.C. presented to
the Council the Lakefront Master Plan and the conceptual plan for the
Community Park/Athletic Complex. At this meeting the P.A.C. and
City Council discussed the acquisition of land. At the January 21, 1997..
City Council meeting the Council authorized conducting a referendum
vote which included the acquisition of the Kop property and the
purchase of land for a Community Park/Athletic Complex. The
information provided to the residents regarding the referendum clearly
identified the purchase of the Kop property and the purchase ofland
for the Community Park/Athletic Complex.

At the January 12, 199~ Council Work Session the Council and
staff discussed the properties which were identified for purchase and at
that time the staff suggested that the O'Loughlin property in the
Northwest comer of Prior Lake would be and ideal location for the
Community Park/Athletic Complex. Though Mr. O'Loughlin had
been contacted numerous times it was clear that he was not interested
in selling his property. Mr. O'Loughlin thought that the Dakota
Community may eventually purchase this land. Staff suggested the
possibility of eminent domain (condemnation), however, the Council
did not appear comfortable at that time and directed staff to continue
the search as well as talk to Hennepin and Scott Counties regarding
the use ofland at Spring Lake Regional Park.
Council also directed staff to negotiate with the Kop's in an effort to
purchase the property within the referendum budget. If it is not
possible to acquire the property within the budget then we pursue the
eminent domain of the property which would be needed for the new
roadway only.

Current Circumstances
Kop Farm
While doing the Lakefront Park Survey, we also surveyed the Kop
Property and the official survey indicates that the parcel is actually
15.18 acres. On March 12, 1998 an appraisal was completed by Frank
J. Wicker with an appraised market value of $455,000.00. A copy of
this appraisal was sent to Allen Barnard, the Kop's Attorney. We
understand Attorney Barnard had a meeting with the family and
contacted Tom Scott to inform him that they are asking $750,000.00
with a life estate for the property. The outlook for acquisition at this
time are poor as $750,000.00 is well beyond our means.
Brauer and Associates has informed us that to build the roadway and a
NURP pond we would need approximately 3.9 acres and if we decide
to expand the athletic fields according to the Master Plan we would
need an additional two acres. This would mean that our eminent
domain total would be 5.9 acres. However, depending on the eminent
domain costs we could adjust the athletic fields to fit on our existing
park property and condemn only that property which is needed for the
roadway and NURP pond.
Community Park! Athletic Complex
The attached graphics show the twenty parcels we have considered for
this project. We have reviewed and re-reviewed the potential land
options which may be available. The following are the three most
likely land acquisition alternatives.
Berens property
The only person that seems to be willing to sell their property is Gene
Berens. His property is located north of Highway 42 and is on both
sides of McKenna Road. This property is too small for our complex as
the D.N.R. purchased 20 acres right in the middle ofthe property to
preserve a wetland. The East side of McKenna road has rolling terrain
and would be difficult to grade. Ifwe were to buy Gene's property
this may accommodate our baseball/softball field but we would need
to purchase another piece of land of about 20 acres elsewhere to build
our soccer fields. This would mean duplicating many amenities such
as parking, irrigation, utilities, etc. and would not make good
economIC sense.
Spring Lake Park
In the last few weeks we reopened our discussions with Hennepin
County Parks Administrator Doug Bryant and also contacted Scott
County Administrator Dave Unmacht to try to work out some type of
arrangement to use land in Spring Lake Regional Park. Sketches were
prepared of potential park layouts using this property (figure 3). We
encountered many roadblocks with this option. Hennepin County

Parks is not receptive to this idea as it is contrary to their passive
recreation philosophy. The Park District does not believe they should
reduce the size of Spring Lake Park. They also believe selling portions
of already acquired park property will reduce their ability to get grants
for future land acquisition. Doug Bryant stated he would provide a
letter expressing his concerns. The letter will be distributed once we
receive it. The staff position coupled with the numerous agencies
which would have to approve the proposal minimizes our chances for
success.
Menden Property
In our search for land one of the most ideal pieces of property from a
topography and location perspective for the Community Park/Athletic
Complex is the Menden property located on Howard Lake Road just
South of County Road 82. This property is 94.74 acres and borders
Spring Lake Regional Park. Half ofthe property is located in Prior
Lake and the other half is in Spring Lake Township. The land is flat
and would be very easy to develop. The land is outside of the
M.U.S.A. and is zoned agricultural. However, one of the problems
that we have encountered is that the property is owned by three
different family members and it has been nearly impossible to try to
get them together for any discussions. The family did agree to have
the City conduct an appraisal. We hired Frank Wicker who appraised
the property at $1,092,500.00. There is $2,500,000.00 identified for
the purchase of land and development of this Park. We originally
estimated $1,000,000.00 for land costs and $1,500,000.00 for
development. Ifwe have to spend a small amount more than the
$1,000,000.00 we could do so with minimal impact to the park
development, as this site will be easy to grade. The Menden's have
failed to return our phone calls so the City Attorney's office sent them
a letter (Figure 4) on June 12, 1998 requesting that they contact our
offices by Friday June 19, 1998. The Menden's lack of response may
be an indicator that they are not interested in selling their property.
The Issues
Though it would be ideal to reach an agreement for the purchase of
these two properties we cannot afford to continue our efforts with no
light at the end ofthe tunnel. Eminent domain may be our only
alternative at this point. Through eminent domain the owners of the
property will receive fair market value for their property and the City
can proceed with its plans for the development of these properties.
There are two types of eminent domain:
Quick Take: This type of procedure would enable us to secure the
properties within 90 days but it is not without risk. If the commission
determines that the property is worth more than our appraisal we are

obligated to pay the amount the commissioners award or appeal to
District Court.
Conventional: This method takes longer but the City has the ability to
back out of the deal if the award is too high. However, ifthe City
backs out, it is obligated to pay the property owners legal fees and
appraisal costs. This method would take approximately six months
which would allow us to begin our work in the spring of 1999.
ALTERNATIVES
AND CONCLUSION: Kop Farm
With the Kop Farm it seem pointless to continue discussions, given the
price expectations. Even if a settlement could be reached the process
is likely to be time consuming (8-12 months). Though the entire piece
of property is very desirable it is not essential to the completion of
Lakefront Park and the only portion that would be essential at this time
is the property needed to construct the park access roadway and NURP
pond. It would be a good idea to also acquire the portion of property
needed to expand the athletic fields. The property needed for the
access road is on the south edge ofthe Kop parcel and includes about
3.9 acres. The acreage required for the playfields is on the north
boarder of the parcel and includes 2 acres. The roadway and field
expansion areas are identified as residential and appraised at
$30,000.00 per acre.
Menden property
The Menden's were asked to contact our offices and did not do so. As
mentioned in the letter, if they did not contact us we would assume
that they are not interested in selling their property. The majority of
this property (69.78 acres) is owned by Francis the eldest brother, who
is a cement contractor from Shakopee. Mrs. Menden (the mother)
owns 13.96 of the acres and she lives in Shakopee. The youngest son
Robert still lives on the family farm and owns 11 acres and the
buildings. Robert farms the entire property but has told staff that ifhis
brother sells his property he too would sell. Francis split his property
into 7 lots with the intention of selling them in the future. At this time
it doesn't seem as if the family is in any hurry to sell their property
although they will eventually do so. Ifwe were to pursue eminent
domain we should probably use the conventional method which would
allow us to begin construction in the spring of 1999.
Berens property
Though Gene may be a willing seller the property is not ideal and as
mentioned we would spend a great deal of our development money on
grading. We would also have to purchase another 20 acres elsewhere
to meet our athletic field needs. At this point this property does not
seem to be a viable option.

FISCAL IMPACT:
There is money included within the referendum to acquire the Kop
property which is needed for the roadway for Lakefront Park. If we
were to use eminent domain to acquire property needed. for the
roadway and the expansion of the fields we would likely spend most of
the $300,000.00 which was budgeted for the purchase ofthe entire
property.
If we were to use eminent domain to acquire the Menden property
there would be sufficient money to pay the appraised value. However,
as explained, condemnation commissioners can determine that the land
is worth more or less than the appraised value.
Alternatives:
Each of the following alternatives assume that the staffwill continue to
work with property owners to acquire the property:
1. Initiate conventional eminent domain proceedings for the entire Kop
property (15.18 acres) and the entire Menden Property (94.74 acres).
2. Initiate conventional eminent domain proceedings on the Kop
property for the access road and NURP pond (3.9 acres) and ball
fields (2 acres) and the entire Menden property (94.74 acres).
Recommendation:
The staffis seeking Council direction on this matter. We believe that
either alternate 1 or 2 are appropriate and should be pursued
Regardless of the alternative chosen, the staffwill continue to work
with each of the property owners in hopes of acquiring both parcels
through open market transaction.
The initiation of eminent domain is important because:
1) It establishes a final date and process for acquisition of parcels.
2) It conveys to the owners the City's conviction to acquire the
property.
The City needs to move forward with these actions in order that the
construction projects can be completed on schedule. The City Attorney
will be at the Joint Meeting to respond to any questions which may
arise. We will have full size graphics at the August 10 meeting
showing the Lakefront Park and Community Park/Athletic Complex
Layout on the subject properties.

KOP FARM ACQUISITION PROCESS
AUGUST 19, 1981:
City Council approves the Comprehensive Plan Land Use which identifies the Kop
property as future Open Space/Recreational.
DECEMBER 17, 1995: City Council approves Comprehensive Plan which identifies the acquisition of the Kop
property.
JANUARY 17, 1996: Lakefront Park Master Plan public meeting. Participants support the acquisition ofKop
property.
FEBRUARY 12, 1996: Lakefront Park Master Plan public meeting. Participants again support the Kop farm
acquisition and like the idea of a Historic Farm Site.
MARCH 11, 1996: Lakefront Park Master Plan public meeting. The Kop farm was included as a part of
the Master Plan and would be preserved as a Historic Farm Site.
APRIL 11, 1996: City Council approves the Lakefront Master Plan which includes the acquisition of the
Kop property and preservation of the Historic Farm Site.
MAY 1, 1996: Meeting with the Kop family to discllss appraisal.
MAY 6, 1996: Joint meeting of City Council and Parks Advisory Committee to present referendum
items. Acquisition of Kop farm was discussed.
JUNE 1996: Property identified by PAC and community as key piece of property that City should try
to acquire as part of referendum.
JULY 1996: The City initiates an appraisal ofKop property, done by Orion Appraisals, Inc.
Property appraised at $237,000. With the anticipated purchase date being 1998 or
perhaps 1999, $300,000 was programmed into the referendum for the purchase price of
the Kop property.
JANUARY 21,1997: City Council authorizes $7.8 million referendum be put before the voters on 2/25/97.
This referendum includes $300,000 for acquisition ofKop property.
FEBRUARY 25,1997: Referendum passes.
MARCH 5,1997:
Staff met with Kop family to discuss acquisition. John Kop stated that he would like
$500,000.00 for his property.
APRIL 7,1997:
City Council approves plan for starting referendum projects which included the
following statement "negotiate the acquisition of land and make recommendation to the
City Council."
MAY 21,1997:
Letter from City Attorney to Kop's offering $300,000 for their property along with
outline of potential "life estate" options.

JULY 24, 1997: Letter from City Attorney to Kop' s indicating that no response has been received.
Please respond soon.
AUGUST 1, 1997: Letter from Best and Flanagan to City indicating that they will now be representing the
Kop's and that the Kop's would like the City' to pay for another appraisal from another
firm to be selected by the Kop's.
AUGUST 25,1997: Letter from Best and Flanagan to City indicating that the Kop's have chosen C.E.
LaSalle & Associates to do the appraisal and confirming that this would be paid for by ,
the City.
OCTOBER 15, 1997: Appraisal completed by C.E. LaSalle & Associates -- appraised value $970,000.
JANUARY 12,1998: City Council Work Session to discuss land acquisition options. City Council informed
of both appraisals ($235,000 and $970,000) and reminded of the amount of money
programmed into the referendum for this purpose ($300,000). Comments from the City
Council indicated that there was no reason to pay more than what was originally .
programmed in the referendum. The offer has been made. If they do not accept, than
look at the options of condemning the roadway for the new access.
MARCH 6,1998: Parks and Recreation Director authorizes Frank Wicker & Associates to review both
appraisals that have been done and provide his input.
MARCH 12, 1998: Frank Wicker & Associates appraised the property at $455,000.
Lakefront Park survey information indicates the Kop property is 15.18 acres. Original
appraisals estimated the property to be 15.75 acres.
MARCH 16, 1998:
City Council approves application to apply to DNR for Natural and Scenic Area Grant.
MARCH 27, 1998:
City applies for DNR natural and scenic area grant in the amount of $200,000.
