WHEREAS, the Applicants and the City have agreed that Applicants will grant the City the necessary additional easement. NOW, THEREFORE, IT IS HEREBY AGREED that the City will not file an Answer in this proceeding so as to allow the Applicants to proceed by default so long as the judgment and decree to be entered herein shall preserve, the City's current easement dated February 9, 1979, and filed for record on August 11, 1980, with the Scott County I Recorder as document 176976 and the additional easement attached hereto as Exhibit A, as memorials on the Certificate of Title.
