DRAINAGE EASEMENT
FOR VALUABLE CONSIDERATION Gary H. Schwartz and Laura E. Elletson,
husband and wife, ("Grantors"), hereby grant unto the City of Prior Lake, a municipal
corporation under the laws ofthe State of Minnesota, its successors and lor assigns
("Grantee") a perpetual easement for storm sewer and drainage purposes over, across,
under and upon the following described property located in the County of Scott, State of
Minnesota, to-wit:
A permanent easement for storm sewer and drainage purposes over, under an
across the northeasterly 10.00 feet of the following described property:

The total consideration of this transaction is $1.00 or less.

The Northeasterly 30.00 feet of Lot 8 (measured at right angles to the Northeasterly
line thereof) and Lot 9, "FAIRLA WN SHORES", Scott County, Minnesota. Together
with that part of Government Lot 2, Section 25, Township 115, Range 22, Scott
County, Minnesota, described as follows: Beginning at the northwest comer of said
Northeasterly 30.00 feet of said Lot 8; thence northwesterly, along the northwesterly
extension of the southwesterly line of said Northeasterly 30.00 feet, to the shore line
of Prior Lake; thence northeasterly along said shore line to its intersection with the
northwesterly extension of the northeasterly line of said Lot 9; thence southeasterly

STIPULATION
To Register the Title to Certain Land.
WHEREAS, the Applicants have commenced this proceeding to register the title to
the following described premises, to-wit (Property):
The Northeasterly 30.00 feet of Lot 8 (measured at right angles to the Northeasterly
line thereof) and Lot 9, "F AIRLA WN SHORES", Scott County, Minnesota.
Together with that part of Government Lot 2, Section 25, Township 115, Range
22, Scott County, Minnesota, described as follows: Beginning at the northwest
comer of said Northeasterly 30.00 feet of said Lot 8; thence northwesterly, along
the northwesterly extension of the southwesterly line of said Northeasterly 30.00
feet, to the shore line of Prior Lake; thence northeasterly along said shore line to its
intersection with the northwesterly extension of the northeasterly line of said Lot
9; thence southeasterly along said northwesterly extension to the northeasterly
comer of said Lot 9; thence southwesterly along the northwesterly line of said Lots
8 and 9 to the point of beginning.
WHEREAS, The City of Prior Lake ("City") has been named as a defendant in this
proceeding because it has an easement for storm sewer and drainage purposes across the
Property .
WHEREAS, The City requires an additional easement for storm sewer and
drainage purposes across the Property if this application is granted.
WHEREAS, the Applicants and the City have agreed that Applicants will grant the
City the necessary additional easement.
NOW, THEREFORE, IT IS HEREBY AGREED that the City will not file an
Answer in this proceeding so as to allow the Applicants to proceed by default so long as
the judgment and decree to be entered herein shall preserve, the City's current easement
dated February 9, 1979, and filed for record on August 11, 1980, with the Scott County

Recorder as document 176976 and the additional easement attached hereto as Exhibit A,
as memorials on the Certificate of Title.
