To Whom It May Concern:
The City of Prior Lake has been asked to comment on the impact of the taking of 6,524
square feet from the existing parcel described above. According to a letter from Dennis
Christianson of Meridian Land Services, dated February 22, 2007, the major concern is
how this taking will affect a future addition to the existing building.
This parcel is zoned C-5 (Business Park Use District). Section 1102.1405 of the Zoning
Ordinance lists the minimum dimensional standards as follows:
1102.1405
Dimensional Standards. The minimum lot size in the "C-5" Business
Park Use District shall be 1 acre, and the minimum lot width shall be 1 00
feet. No more than 50% of any lot shall be covered by structures.
Maximum Floor Area Ratio is 0.50. No structure shall exceed 4 stories or
45 feet in height, whichever is less, except as provided in subsection
1101.508.
Section 1102.1406 lists the required setbacks:

Reauired Setbacks. Within the "C-5" Business Park Use District, the
following minimum setbacks shall apply:

Neither the letter nor the attachments provide enough information to make any
determination on the effect of the proposed taking. To make such a determination, we
will need, at a minimum, the existing setbacks of the building, the proposed size of the
addition, the proposed location and setbacks for the addition, and the number and
location of any additional required parking spaces.

Section 1107.2303 (3) of the Zoning Ordinance states:
Non-Conformity as a Result of Government Action. If a governmental
body takes land by exercise of its right of eminent domain and by that
taking creates a parcel which does not conform to the width, area, or yard
requirements of this Ordinance, the non-conforming parcel shall become
a legal non-conformity and may be used thereafter only by complying
with the provisions of this section, however, such a legal non-conformity
is exempt from the amortization provisions as contained in this
Ordinance. The same non-conforming status of the non-conforming
parcel will result if the governmental body acquired the land by
negotiation rather than by condemnation.
If the owner of a property which becomes a legal non-conformity as the
result of a governmental taking applies for a variance to reinstate the
legal status to the property, the governmental taking shall constitute a
hardship for the purpose of the variance.

Dear Ms Kansier:
Scott County desires to obtain a Permanent Highway Easement and a Temporary
Construction Easement for the reconstruction of County Road 21 in the area of the above
property. Mr. Reynolds has verbally agreed to a recent offer made to him by Scott
County for the needed easements subject to one condition. He wants a letter from the
City of Prior Lake stating the taking of the new 6,524 square foot Permanent Highway
Easement along the north edge of his property will not cause a reduction in the size of a
building addition he is contemplating. The taking of a Temporary Construction Easement
should not be a factor in this situation as it terminates December 31, 2008.
I ask that you consider Mr. Reynold's request to determine if no change to the current
status regarding building expansion under Prior Lake ordinances will occur because of
the new Permanent Highway Easement. In other words will the situation in the after
taking situation be the same as it was in the before taking situation? If this is the case, I
think a letter from you (or the appropriate City Official if not you) so stating will be
sufficient for Mr. Reynolds to agree to sign the Permanent and Temporary Highway
Easements for this project.
I understand that a future change in zoning ordinances or a change in the zoning of the
property itself due to other circumstances will not be limited by any statements made in a
letter written now. That would be another matter entirely in my opinion.
Please review this request and the enclosed information to determine if it is possible to
respond to Mr. Reynolds in a way that will be agreeable to him. If you have questions, call
