Upon review of the survey submitted, it appears that no variance will be necessary. The proposed porch and deck meet the side yard setback requirement of 10 feet. Using setback averaging of the adjacent structures from the Ordinary High Water Level (OHWL) results in an average setback of 57 feet. The proposed deck and porch are setback 57 feet and more from the OHWL. The maximum impervious surface coverage allowed in 30%. The survey indicates that the net proposed impervious surface is 21.3%. Additionally, the bluff in your yard does not meet our definition of bluff. Among other criteria to be considered a bluff, the slope of the yard must rise a minimum of 25 feet from the OHWL. The slope of the bluff in your yard only rises 21 feet. Therefore, we do not consider it to be a bluff under the criteria of the City Code and there is no setback required from the bluff.
