In regards to a recent building permit application submitted (#97-122) to build a two-story addition in place
of an existing deck, the denial of the permit application is due to a few factors.
1. The Zoning Ordinance requires structures to be located 75 feet from the Ordinary High Water (OHW)
level. In this particular case the OHW of Prior Lake is 904. The setback indicated on the survey for
the proposed addition is 32 feet. Additionally, the ordinance allows for the use of setback averaging
for the OHW setback. However, using the averaging provision requires a minimum setback from the
OHW of 50 feet.
2. In 1980 a variance was granted for this property to construct a deck. The motion approving the
variance is attached and reads as follows: "Motion was made by Commissioner Arnold to grant
approval of the variance requested as per the diagram submitted and marked Exhibit "A", seconded by
Roseth. Upon a vote taken, the motion duly passed." Exhibit A. specifically refers to a 20' by 10'
deck in the location shown. The proposed addition and removal of the deck exceed the variances
granted as shown in Exhibit A.
Your option to continue pursuing the future addition is to apply for a setback variance to the OHW for the
proposed addition. In addition to the OHW setback variance, it appears that a variance to impervious
surface may be needed. The maximum impervious surface coverage on a lot is 30%. This includes all
paved surfaces, patios, structures, etc. The actual impervious surface coverage is not indicated on your
survey.

The November 20, 1980 meeting of the Prior Lake Planning Commission was called to
order at 7:30 P.M" by Chairman Fitzgerald. Present at the meeting were Commission-
ers Fitzgerald, Wilker, Foster, Roseth, Arnold, City Planner Graser and Councilman
Bissonett.
The Minutes of the October 16, 1980 Planning Commission meeting were reviewed.
Motion was made by Arnold to approve the minutes as published, seconded by Wilker.
Upon a vote taken, the motion was duly passed.
Chairman Fitzgerald opened the organizational meeting and called for nominations
for a vice-chairperson on the Prior Lake Planning Commission. Commissioner Arnold
nominated Commissioner Wilker, seconded by Commissioner Foster. Nominationof
Commissioner Arnold was made by Commissioner Wilker with no second to the nomina-
tion. Upon a vote taken, motion to elect Commissioner Wilker as the Vice-Chair-
person was duly passed.
At 7:45 P.M., the variance request by Frank Miller was called to order by Chairman
Fitzgerald. Mr. Miller was present at the meeting to answer questions.
City Planner Graser gave a presentation noting that Mr. Miller is requesting a
rear yard lakeshore variance for Lot 11, Shady Beach Number Two.to enable him to
construct a 10' x 20'deck on to the back of his home. Staff made a recommendation
for approval of the variance due to the hardship caused from the shallow lot.
Mr. Miller made no comments regarding this request but stated that he would answer
questions from the Commission members.
