RE: Driveway
The homeowner at 16176 Evanston Avenue made an inquiry as to the pavement of the
existing gravel driveway. A variance was granted in 1994 regarding the setback of the
garage from HWY 13. The site plans indicate a driveway that is setback 2 feet from the
property line to the south. Considering that the current ordinance requires driveways to
be setback 5' from the property line, the following determinations have been made. The
property owner can pave the gravel driveway as shown on the site plan in Variance
94-37 based on the following rationale:
· Gravel driveway exists, the property owner could have paved it years ago without
incident.
· The city requires and encourages all driveways to be paved for erosion and run-off
control.
· The property owner is not encroaching the setback any further than already exists.
