RE: Use of Easement
Dear Mr. Long:
According to a survey you have provided (attached) there is a 10 foot drainage and utility
easement located along the north side of your lot. Your intent to pave a 9 foot parking
drive and parking area along the north side of your garage and in the easement (as
indicated) is not in violation in any City Code.
Verlyn Raaen, Engineering Technician, has concluded that there will be no conflict with
such a use of the easement. From a planning perspective, all drives must be setback 5
feet from the property line. Your proposed drive/parking area will be setback 5.7 feet.
Therefore, the is no encroachment on any setbacks. The setback for structures is 10 feet,
not allowing for such an expansion of your garage without a variance. Additionally, your
lot is located within the Shore1and District. This requires total impervious surface
coverage on your lot to be less than 30%. It appears that your lot will have less coverage
than 30% with the proposed drive/parking area.
Considering that there will be no violation of City Code, your proposed drive/parking
area is conforming to the Zoning Ordinance and acceptable. Please be aware that if
future utility or drainage work needs to be done in the easement, that the possibility of
removal of your drive/parking area will exist.
