This letter is to inform you that we are aware of the rear yard setback issue at the home to be
constructed at 14484 Waters edge Trail NE, Prior Lake, MN. At no time do we intend to build
any type of deck or add on to the structure into this setback. The future terrace or patio that is
proposed is to be constructed of paver patio blocks or similar. Access to the terrace will be
from an approved landing area with stairs to grade. Weare also aware of the fact that the

The Planning Commission held a public hearing on August 9, 2004 to consider
variance applications to allow the construction of a single family home at 14484
Watersedge Trail. After review of the applicant's request with respect to
variance hardship criteria, the Planning Commission directed staff to draft
Resolution 04-09PC and Resolution 04-010PC, approving the following
variances subject to certain conditions:
1. A 3.5 foot elevation variance from the required minimum of not more than
2 feet below the regulatory flood protection elevation for a vehicular
access within the flood plain.
2. A 25 foot variance from the required 75 foot setback from the ordinary
high water mark in the R-1SD (Low Density Residential Shoreland)
district.
The following conditions are included in the attached resolutions:
1. The building permit is subject to all other City Ordinances and applicable
County and State agency regulations.
2. The applicant must provide an emergency evacuation plan.
3. The applicant must relocate or remove all sheds to meet setback
requirements.

4. The variance must be recorded and proof of recording submitted to the
Planning Department within 60 days. An Assent Form must be signed
and, pursuant to Section 1108.400 of the City Code, the variance will be
null and void if the necessary permits are not obtained for the proposed
structure within one year after adoption of this resolution.
ALTERNATIVES:
1. Adopt attached Resolution #04-09PC and #04-01 OPC approving the
variances subject to the listed conditions the Planning Commission deemed
appropriate under the circumstances.
2. Table or continue discussion of the item for specific purpose.
3. Deny the application because the Planning Commission finds a lack of
demonstrated hardship under the Zoning Ordinance criteria.
RECOMMENDATION
Staff recommends alternative #1.
