Tom: This is in response to your recent e-mail.
1) We have some information on the ring road. Bud Osmundson, Public Works Director, will
be forwarding that information to you as soon as possible.
2) The City is responsible for assigning addresses. Addresses are based on the location
of the building on the lot. You must submit your site plan in order for the City to
determine the proper address.
3) I am faxing and mailing a site plan application, which addresses the type of
information that must be submitted. This application also addresses the number of copies
you must submit. City review of your application will take approximately 2-3 weeks once
we have received a complete submittal.

Dear Mr. Aggen:
The City of Prior Lake staff has attempted to review the plans submitted for the Prior
Lake Post Office site. Unfortunately, the plans submitted were incomplete and
inconsistent from one page to the next. In a meeting with Mr. Anthony Pini and Mr.
Robert Sorensen on July 31, 2000, City staff were advised these plans were only a
"10% progress layout" and were subject to change. At that meeting they presented
another layout.
A complete and consistent set of plans will be necessary before City staff can provide
you with a thorough review. However, I am providing comments based on the
information we have received so far. Attached are memorandums from Building Official
Robert Hutchins and City Engil~eer Sue McDermott identifying building code and
engineering issues. The following are the Planning and Zoning issues:
. This site is subject to the Tre"" Preservation requirements of the Zoning Ordinance \\ u4-
(see attached). This require$ an inventory of the significant caliper inches on the JO
site, and identification of the trees and caliper inches to be removed. The Ordinance
allows removal of up to 25% of the significant caliper inches without replacement.
Anything above that must be replaced at the rate of 1/2" for each 1" removed. If
necessary, a tree replacement plan must also be submitted.
. This site is subject to the Landscaping requirements of the Zoning Ordinance. The
number of trees required for perimeter landscaping is one tree per 40' of linear
perimeter or one tree per 1,000 square feet of gross floor area, whichever is greater.
The required size and mix of plantings is found in the attached copy of the
landscaping ordinance. A Bufferyard Type B and a 30" berm are required where the
parking lots abut the streets. a description of the bufferyard is also found into the
landscape requirements.
· Parking lot lighting is required and must provide an average horizontal illumination ~
between 0.4 and 1.0 foot candles. ~
· A signage plan identifying the location and the size and type of signs must be ~;~J>

A meeting between CMA staff and consultants and City of Prior Lake Staff was held July 31 at the Prior Lake
Maintenance Facility to review the present situation of the United States Postal Service post office project.
The group discussed the current site plan as it had been presented to USPS on July 20, as a '10% progress' layout.
Differences between the 10% layout and the earlier layouts provided the city were noted.
Discussions began with the question ofthe city's proposed 'ring road'. Osmanson reported the city council had not
yet authorized the preparation of an outside consultant feasibility study; it was estimated such a report would
take some 1 to 2 months to complete. There is a (politically) sensitive property east of Toronto Avenue
consideration of which has delayed the alignment of the 'Ring Road'. Additionally, there is some possibility of
a project by the Park-Nicollet Clinic, east of the subject property, for which the council is waiting, prior to
proceeding with the 'ring road'. Osmanson stated his belief that the feasibility report will be accomplished
within the next six months.

It was remarked that construction of the 'Ring Road must be begun prior to January 2001 in order to be able to use
available state aid funding for the work. It was noted this provides the city with approximately three months to
complete construction documents.
Osmanson stated the city mayor (not) be able to have an alignment for the north (center) portion of the ring road
in time for construction bidding. He and McDermott indicated (and later in the meeting affirmed) they will
have prepared a preliminary 'ring road'alignment around the northwest comer of the postal site within a few
weeks. Osmanson indicated the city's current thinking as intending to utilize a portion of Duluth Avenue along
the west side of the postal site, cutting the comers at the northwest and southwest, in order to reduce the
amount of property the city must acquire.
It was noted that if a reliable alignment of the north section of the ring road is not available, the north lot access
must be shown to Duluth Street in order to provide direction to contractors bidding the postal project. Pini
requested the alignment to be developed by the city, extend at least to I past the center of the north line of the
site, since there may be a large grade difference between the USPS lot and the future road. It was noted that
changes in design of the lot access during or after construction would entail additional construction and design
costs to USPS. Sorensen indicated he has, and will again, discuss with USPS the question of connections from
the north parking lot to the 'ring road' and I or Duluth Street.
The possibility of putting notes on the documents to notify contractors of a potential street change was mentioned;
Sorensen indicated since the drawings presently underway are contruction documents, such a note would not
aid in defining the contracted-for work, and should not be considered.
The actions ofthe watershed district board were discussed. Pini reported he was 'on top' of the items (primarily
minor 'housekeeping' points) listed by the watershed district board when tabling the USPS submittal earlier.
The question of the prospective 'downstream' water treatment reservoir to be provided by the city to provide for
treatment of water from the west side of the USPS site was discussed. Osmanson suggested he would meet
with Paul Nelson of the watershed district to review the proposed method of handling the water off-site. The
city staff persons indicated their belief there would be no major problem obtaining district approval. Pini will
submit the additional data required to perfect the submittal to the district.
~ The southeast pond (pond number 2) was discussed; it was agreed that neither CMA nor the city need interface
with the developers off site to the east regarding water control, but that the pond will be constructed by USPS
as a matter of mutual benefit to USPS and the city. Access to the pond will be agreed between USPS, the city
and the developers as their interests may appear, separate from the wetland I pond construction process.
Kansier indicated she believes the city attorney and USPS have been in contact regard the question of
easements on the pond. Kansier mentioned the possibility the city may request easements over the entire
wetland area.
Hutchins stated he had several comments from the fire department regarding the site layout. The fire department
would like a PIV located a distance away from the building equal to the building height (20'); present city fire
hydrants do not provide the distance to all parts of the building or to the building sprinkler system inlets
required by city codes. It was generally agreed that a solution would be to locate a hydrant and PIV in the
south (employee) parking lot in a closed off parking space. It was noted it appears somewhat difficult to get a
fire pumper into the south parking area; CMA will 'fool around' with the entrances to ease access (the
maximum width of curb cut for commercial work was noted as 30'). McDermott, Osmanson and Hartman
agreed it is possible and permissible to 'wet tap' the existing 30" water line running across the south of the
property.
Kansier mentioned the Metropolitan Council sewer and water access charges ('SAC and WAC') and a city 'water
tower' charge; she indicated there may be a Met Council storm water 'area charge'. Sorensen will pass the
information on to USPS.

There was discussion of the size and possible necessity to rebuild one of the two sanitary manholes to the south side
of the building; it was noted in passing that the city does not permit inside drops within its manholes.
McDermott will verify which is the undersized manhole and notify Pini.
After some discussion of the lightweight fill in the southwest comer of the site, it was agree that since it has
supported Tower street in the years since its installation, it is probably acceptable under the USPS parking lots.
It was noted that all the curb and gutter in the area of the rubber fill contain reinforcing and therefore should
be cut rather than being lifted in jointed sections.
Kansier noted the preliminary landscape plans indicated 11/2" caliper trees while city code requires 2 1/2";
Kansier requested copies of the 30% drawings when they are ready. Sorensen indicated the preliminary plans
indicated only landscaping related to the wetland modification, and that the west area across from Rl zoning
will be additionally landscaped. Kansier noted the city requires comer vision triangles of 50' sides.

The following are recommendations for the building pertaining to the Fire Code requirements.
Our review was based on the 1998 Minnesota State Fire Code (MSFC) which adopted with
amendments the 1997 Uniform Fire Code (UFC).
. Buildings with a sprinkler system require one hydrant within 150 feet of the fire department
connection and a hydrant( s) within 300 feet of all portions of the exterior. It appears one Fire
Hydrant should be added by the front of the Building to meet this requirement. The fire

department connection shall be located on the front of the building. The Post Indicator Valve
(PN) must be located a minimum of the height ofthe building away.
· All hydrants shall be accessible to the fire department apparatus by roadways meeting above
requirements. Hydrants shall be located within 5 feet of the curb so that apparatus can pull
along side for the connection.
· Provide fire lanes for fire apparatus response. Signage should read: ''No Parking Fire Lane
by order of the Fire Department." Location and number to be determined.
· Provide numbers of addresses in such a way to be plainly visible from the street or road
fronting the property per UFC Section 901. Numbers shall contrast with their background.
· Provide approved key box to be installed in accessible location per UFC Section 902. This is
required when access to a structure is unduly difficult or where immediate access is necessary
for life safety or fire fighting purposes. Key boxes shall contain keys to gain necessary
access. Key boxes also recommended for building where entry may be delayed and to
prevent damage as result of forcible entry. Obtain order forms from the Building Inspection
Department.
· Submit 8-112 x 11 inch site plan for development of emergency response plan.
This is a preliminary review only. Other code items will be addressed when the final plans are
submitted. The building plans must be reviewed by the Cites Developmental Review Committee
(DRC) which consists of representatives of Planning, Engineering, Parks, Finance, and Building
Departments. The DRC must approve the plans before Utility hookup and Sewer and Water
permits can be issued.

The Engineering Department has reviewed the plans for the subject project and we have
the following comments:
1. The site layout conflicts with the plans for the proposed Ring Road.
2. The southernmost driveway off of Duluth is too close to the intersection. This
driveway should line up with Maplewood Street.
3. Private storm sewer system is located in a drainage and utility easement as well as the
area containing lightweight fill. No excavation is to take place in the lightweight fill
area.
4. Show baffled weir details in the plans.
5. Call out class and quantity of rip rap at each flared end.
6. All manholes will have to be adjusted to grade which will require additional concrete
sections at two of the sanitary manholes and one of the storm manholes.

This e-mail is principally for Steve, with copies intended for Frank, Jane, Sue and Don.
Obviously I hit the wrong key and the e-mail is going to all of you as an original.
Steve, we exchanged voice mails last week before I left for California concerning the need
to have you prepare an easement for the Stoneface/Post Office project. I believe this is
one of the projects I diagramed for you when we met. Let me briefly describe the facts, in
order for you to prepare an easement that protects the City and does what it needs to do to
protect the City.
If I misstate any of the facts or leave out any important facts please feel free to contact
Steve directly, but please provide me with a copy.
Steve--a developer has applied for a Conditional Use Permit to construct an apartment
building. In considering the project, the Council expressed concerns about several issues,
including a retaining wall, parking and storm water management. The Council is concerned
about the storm water drainage issue.
The apartment project is located across the street from a parcel of land that is under option
to the Post Office (closing is almost certain). The Post Office has agreed to provide the
developer and City with an easement to allow the storage of storm water on their property.
When the Post Office constructs its facility it will oversize a holding pond and the size of an
outlet pipe.
The City will also be draining some water into the pond and that is why the City needs to
also be a party to the easement. I'm not sure if the easement should run to the benefit of
the public, I seek your advise on that matter.
Additionally, both the City and developer will be compensating the Post Office for use of
their pond and overriding their pipe. Does the easement need to contain any language
about reimbursement or compensation.
As I told you last week, we need a draft easement to provide to the Post Office. The draft
will be a working draft or a starting point. Once we provide it to the real estate person at
the Post Office, Mr. Aggies, I anticipate you will eventually need to have direct discussions
with Mr. Aggies.

Dear Mr. Luttig:
Authority is hereby granted for the U.S. Postal Service to
grade and fill 0.38 acre of an isolated, shallow marsh-Type 3,
wetland to facilitate the development of a 4.5 acre parcel for
postal services. The project site is in the S 1/2 of Section 2,
T. 114 N., R. 22 W., of Scott County, at Prior Lake, Minnesota.
The authorized work is to be done as shown on the enclosed
drawings labeled 5194GAE1 and 5194GAE2 which are hereby
incorporated as part of this Letter of Permission. This
authorization is issued under the provisions of GP/LOP-98-MN (MN
LOP-C) .
This action is based upon the recommendation of the Chief of
Engineers and under the provisions of Section 404 of the Clean
Water Act (33 U.S.C. 1344). The authorization is subject to the
enclosed Generpl, Standard, and following Special Conditions:
1. As mitigation for the proposed wetland alteration
work, the permittee shall provide the St. Paul District, Corps of
Engineers, with written documentation or evidence that it has
purchased 0.40 acre of in-kind (Type 3) wetland mitigation credit
from the Sibley 1 Wetland Bank. This bank has been approved by
the Minnesota Board of Water and Soil Resources and the Corps of
Engineers and is owned and operated by Mr. Michael Mueller at a
site in Section 22, T. 113 N. ,R. 30 W., of Sibley County,
Minnesota.
2. The permittee shall provide proof of purchase of
wetland credits by submitting the appropriate documentation or
receipt of credits for this project to the Corps of Engineers
prior to or concurrent with the proposed placement of fill
material in the wetland. The documentation shall not only,
include the name and locp.tion of the bank, but the beginning and
ending balance of wetland credits that remain in the bank, by
wetland type, at the conclusion of this transaction.
3. If the permittee is unable to purchase wetland
mitigation credit as required in Special Condition 1, it shall
contact the Corps of Engineers prior to the start of work and

provide a mitigation plan for replacement of the wetland acreage
lost as a result of this project,
4, The permittee shall take all necessary precautions
to minimize soil erosion and sediment loading of the remaining
wetland on the property during the construction of the proposed
facility. Sedimentation and erosion control devices shall be
used during construction activities to prevent siltation of the
wetland.
5. If the borrow material for the proposed development
is to come from a site other than an approved, licensed facility,
the permittee shall inform the Corps of Engineers of the location
of the borrow area or source of the fill material at ~east five
days before commencing work.
6. To protect and maintain the integrity and
environmental values associated with the remaining wetland on the
property, the permittee shall not use this wetland as a
stormwater management basin. An upland stormwater management
system, located outside the limits of this wetland shall be
constructed by the permittee for this purpose. Where stormwater
pond(s) will be constructed in an upland area adjacent to the
remaining wetland on site, the following construction
methods/procedures shall be used:
a. The stormwater pond shall be designed and
maintained as a wet detention stormwater management system
constructed to meet National Pollutant Discharge Elimination
System (NPDES) permit outflow rates, which is 5.66 cubic feet per
second (cfs) or meet the Walker 60% P removal, i.e. contain the
total volume of the runoff from a 2.5 inch storm, before
discharge to the wetland.
b. The stormwater pond discharge to the wetland
shall be designed to cause no more bounce in water level of the
existing wetland than would be considered acceptable for a ten
year storm event in relation to the relative susceptibility of
wetlands to stormwater impacts as specified in the document,
"Storm-Water and Wetlands: Planninq and Evaluation Guidelines for
Addressinq Potential Impacts of Urban Storm-Water and Snow-Melt
Runoff on Wetlands" prepared by the State of Minnesota Storm-
Water Advisory Group, dated 1997.
7. The permittee shall apply to the Minnesota
Pollution Control Agency (MPCA) for coverage under a general
National Pollutant Discharge Elimination System (NPDES) permit
for construction activities specifically requiring Best
Management Practices (BMP) to control erosion during construction
and a stormwater management plan to manage pollutants in
stormwater runoff from the site that will occur after
construction is complete. The NPDES permit requires that these
BMP be prepared for the project and incorporated into the plans
and specifications prior to the start of construction. The

The time limit for completing this authorized work ends
January 31, 2005 OR two years from the date of this letter,
whichever occurs later.
This Federal authorization does not permit you to commence

like to appeal the permit decision, please follow, the directions
in paragraph 2 of the enclosed Notification of Applicant Options.

General Information.
As a general rule, all discharges of fill
or dredged material into any wetland or
water area require a Section 404 permit
from the Corps of Engineers. Persons
proposing such work should especially
note that, in ALL cases including the
non-reporting general permits, GP/LOP-
98-MN requires that adverse impacts on
water and wetland resources be avoided
and minimized to the maximum extent
practical. Discharges that would
adversely affect Federal endangered
plant or animal species or certain
cultural or archaeological resources, or
that would ,impinge or abrogate reserved
Native American treaty rights including,
but not limited to, reserved water rights
and treaty fishing and hunting rights,
are not eligible for authorization under
GP/LOP-98-MN.
The St. Paul District WWW site
(http://www.mvp.usace.army.mil) will
contain information that is helpful for
applicants.
General Conditions.
1. The time limit for completing work
authorized by the GP provisions of
GP/LOP-98-MN ends upon the expiration
date of GP/LOP-98-MN. The time limit
for completing work authorized by the
LOP provisions herein ends upon the
expiration date of GP/LOP-98-MN or
two years after the date of the Corps
authorization of the work under GP/LOP-
98-MN, whichever occurs later. If you
find that you need more time to
complete the authorized activity, submit
your request for a time extension to this
office for consideration at least three
months before the expiration date is
reached.
2. You must maintain the activity
authorized by GP/LOP-98-MN in good
condition and in conformance with the
terms and conditions of this permit. You
are not relieved of this requirement if
you abandon the permitted activity,
although you may make a good faith
transfer to a third party. Should you
wish,to cease to maintain the authorized
activity or should you desire to abandon
it without a good faith transfer, you
must obtain a modification of this permit
from this office, which may require
restoration of the area.

GP/LOP-98-MN CONDITIONS
3. If you discover any previously
unknown historic or archaeological
remains while accomplishing the activity'
authorized by GP/LOP-98-MN, you must
immediately stop work and notify this
office of what you have found. We will
initiate the Federal and state
coordination required to determine if the
remains warrant a recovery effort or if
the site is eligible for listing in the
National Register of Historic Places.
4. You must allow representatives from
this office to inspect the authorized
activity at any time deemed necessary
to ensure that it is being or has been
accomplished in accordance with the
terms and conditions of GP/LOP-98-MN.
5. Refer to the GP/LOP-98-MN
Standard Conditions at the end of this
document.
Further Information :
1. Congressional Authorities: You have
been authorized to undertake the
activity described above pursuant to
Section 404 of the Clean Water Act (33
U.S.C. 1344).
2. Limits of this authorization.
a. GP/LOP-98-MN does not obviate
the nee'd to obtain other Federal, state,
or local authorizations required by law.
b. GP/LOP-98-MN does not grant any
property rights or exclusive privileges.

Government does not assume any
liability, including for the following:

or uses thereof as a result of other
permitted or unpermitted activities or
from natural causes.
b. Damages to the permitted project
or uses thereof as a result of current or
future activities undertaken by or on
behalf of the United States in the public
interest.
c. Damages to persons, property, or
to other permitted or unpermitted
activities or structures caused by the
activity authorized by this permit.

d. Design or construction deficiencies
associated with the permitted work.
e. Damage claims associated with
any future modification, suspension, or
revocation of this permit.
4. Reliance on Applicant's Data: The
determination of this office that
issuance of this permit is not contrary to
the public interest was made in reliance
on the jnformation you provided.
5. Reevaluation of Permit Decision.
This office may reevaluate its decision
on this permit at any time the
circumstances warrant. Circumstances
that could require a reevaluation
include, but are not limited to, the
following:
a. You fail to comply'with the terms
and conditions of this permit.
b. The information provided by you in
support of your permit application .
proves to have been false, incomplete,
or inaccurate (see 4 above).
c. Significant new information
surfaces which this office did not
consider in reaching the original public
interest decision. Such a reevaluation
may result in a determination that it is
appropriate to use the suspension,
modification, and revocation procedures
contained in 33 CFR 325.7 or
enforcement procedures such as those
contained in 33 CFR 326.4 and 326.5.
The referenced enforcement procedures
provide for the issuance of an
administrative order requiring you to
comply with the terms and conditions of
your permit and for the initiation of legal
action where appropriate. You will be
required to pay for any corrective
measures ordered by this office, and if
you fail to comply with such directive,
this office may in certain situations
(such as those specified in 33 CFR
209.170) accomplish the corrective
measures by contract or otherwise and
bill you for the cost.
6. Extensions. General condition 1.,
above, establishes a time limit for the
completion of the activity authorized by,
this permit. Unless there are
circumstances requiring either a prompt
completion of the authorized activity or
a reevaluation of the ptlblic interest
decision, the Corps will normally give
favorable consideration to a request for
an extension of this time limit.
GPlp-98-MN CONDITIONS (ContinU!
Standard Conditions.
In addition to the preceding general
conditions, GP/LOP-98-MN authoriza-
tions are subject to the following
standard conditions, as applicable.
These conditions must be satisfied for
any GP/LOP-98 authorization, both GPs
and LOPs, including the non-reporting
GPs, to be valid:
1. Compliance Certification. Under all
LOP authorizations of GP/LOP-98-MN
authorizations, the permittee must
submit a compliance certification to the
St. Paul District within 30 days of
completion of the work. The District
will include a certification form with its
authorization letters. Permittees may
also obtain this form by contacting the
St. Paul District. This requirement does
not apply to GP authorizations under
GP/LOP-98-MN.
2. Case-by-caseconditions. The activity
must comply with any special conditions
which may have been added by the
District or by a state, tribe, or the U.S.
Environmental Protection Agency in its
section 401 water quality certification
or consistency determination under the
Coastal Zone Management Act. Such
conditions will be specifically identified
in any LOP issued for the project.
3. Mitigation/Sequencing. Discharges of
dredged or fill material into waters of
the United States must be minimized or
avoided to the maximum extent
practicable, unless the District approves
a compensation. plan that the District
determines is more beneficial to the
environment than minimization or
avoidance measures.
4. StateITribal Water Quality
certification and Coastal ~
management (CZM) consistency
determination. Some GP/LOP-98-MN
authorizations may not be valid unless
and until an individual Section 401
water quality certification or CZM
consistency determination is obtained
from or waived by the appropriate
agency. If this condition applies, it will
be so noted in the District letter of
permission.
5. Suitable material. No discharge of
dredged or fill material may consist of
unsuitable material (e.g., trash, debris,
car bodies, asphalt, etc.,) and material
discharged must be free from toxic
pollutants in toxic amounts (see Section
307 of the Clean Water Act).
6. Proper maintenance. Any structure or
fill authorized shall be properly
maintained, including maintenance to
ensure public safety.
7. Erosion and siltation controls.
Appropriate erosion and siltation
controls must be used and maintained in
effective operating condition during
construction, and all exposed soil and
other fills, as well as any work below
the ordinary high water mark must be
permanently stabilized at the earliest
practicable date. Work should be done
in accordance with state-approved,
published practices, such as defined in
Minnesota Pollution Control Agency
Document, PROTECTING WATER
QUALITY IN URBAN AREAS: BEST
MANAGEMENT PRACTICES FOR
MINNESOTA.
8. Removal of temporary fills. Any
temporary fills must be removed in their
entirety and the affected areas returned
to their preexisting elevation.
9. Endangered Species.
a. No activity is authorized which is
likely to jeopardize the continued
existence of a threatened or endangered
species or a species proposed for such
designation, as identified under the
Federal Endangered Species Act, or
which is likely to destroy or adversely
modify the critical habitat of such
species. Non-federal permittees shall
notify the District if any listed species or
critical habitat might be affected or is in
the vicinity of the project, and shall not
begin work on the activity until notified
by the District that the requirements of
the Endangered Species Act have been
satisfied and that the activity is
authorized.
b. Authorization of an activity under
GP/LOP-98 does not authorize the take
of a threatened or endangered species
as defined under the Federal
Endangered Species Act. In the absence
of separate authorization (e.g., an ESA
Section 10 Permit, a Biological Opinion
with incidental take provisions, etc.)
from the U.S. Fish and Wildlife Service
or the National Marine Fisheries Service,
both lethal and non-lethal takes of
protected species are in violation of the
Endangered Species Act. Information

on the location of threatened and
endangerec:jspecies and their critical
habitat can be obtained directly from
the offices of the U.S. Fish and Wildlife
Service and National Marine Fisheries
Service or their world wide web pages
on the Internet.
c. If it becomes apparent that a
Federally listed endangered plant or
animal species will be affected by work
authorized by this permit, work must be
stopped immediately and the St. Paul
District of the Corps of Engineers must
be contacted for further instruction.
10. Historic properties, cultural
resources. No activity which may affect
historic properties listed, or eligible for
listing, in the National Register of
Historic Places is authorized, until the
District has complied with the provisions
of 33 CFR Part 325, Appendix C. The
prospective permittee must include
notification to the District in the permit
application if the authorized activity may
affect any historic properties listed,
determined to be eligible, or which the
prospective permittee has reason to
believe may be eligible for listing on the
National Register of Historic Places, and
shall not begin the activity until notified
by the District that the requirements of
the National Historic Preservation Act
have been satisfied and that the activity
is authorized. Information on the
location and existence of historic
resources can be obtained from the
State Historic Preservation Office and
the National Register of Historic Places.
11. Spawning !!!!!!!. Discharges in
spawning areas during spawning
seasons must be avoided to the
maximum extent practicable.
12. Obstruction of high flows. To the
maximum extent practicable, discharges
must not permanently restrict or impede
the passage of normal or expected high
flows or cause the relocation of the
water (unless the primary purpose of
the fill is to impound waters).
13. Adverse effects from
impoundments. If the discharge Creates
an impoundment of water, adverse
effects on the aquatic system caused by
the accelerated passage of water and/or
the restriction of its flow shall be
minimized to the ma~imum extent
practicable.
GPlp-9S-MN CONDITIONS (ContinU!
14. Waterfowl breeding areas.
Discharges into breeding areas for
migratory waterfowl must be avoided to
the maximum extent practicable.
15. Navigation. No activity may cause
more than a minimal adverse effect on
navigation.
16. Aquatic life movements. No activity
may substantially disrupt the movement
of those species of aquatic life
indigenous to the waterbody, including
those species which normally migrate
through the area, unless the activity's
primary purpose is to impound water.
17. Equipment. Heavy equipment
working in wetlands must be placed on
mats, or other measures must be taken
to minimize soil disturbance.
18. Tribal rights. No activity or its
operation may impinge or abrogate
reserved treaty rights, including, but not
limited to, reserved water rights and
treaty fishing and hunting rights.
19. Wild and Scenic Rivers. No activity
may occur in a component of the
N.ational ,Wild and Scenic River System;
or in a river officially designated by
Congress as a "study river" for possible
inclusion in the system, while the river
is in an official study status; unless the
appropriate Federal agency, with direct
management responsibility for such
river, has determined in writing that the
proposed activity will not adversely
effect the Wild and Scenic River
designation, or study status. Information
on Wild and Scenic Rivers may be
obtained from the appropriate Federal
land management agency in the area
(e.g., National Park Service, U.S. Forest
Service, Bureau of Land Management,
U.S. Fish and Wildlife Service.)
20. Water Quality standards. All work
or discharges to a watercourse resulting
from permitted construction activities,
particularly hydraulic dredging, must
meet applicable Federal, State, and local
water quality and effluent standards on
a continuing basis.
21. Preventive measures. Measures
must be adopted to prevent potential
pollutants from entering the
watercourse. Construction materials
and debris, including fuels, oil, and
other liquid substances, will not be
stored in the construction area in a
manner that would allow them to enter
the watercourse as a result of spillage,
natural runoff, or flooding.
22. Disposal sites. If dredged or
excavated material is placed on an
upland disposal sight (above the
ordinary high-water mark), the site must
be securely diked or contained by some
other acceptable method that prevents
the return of potentially polluting
materials to the watercourse by surface
runoff or by leaching. The containment
area, whether bulkhead or upland
disposal sight, must be fully completed
prior to the placement of any dredged
material.
23. Erosion control. Upon completion
of earthwork operations, all exposed
slopes, fills, and disturbed areas must
be given sufficient protection by
appropriate means such as landscaping,
or planting and maintaining vegetative
cover, to prevent subsequent erosion.
Coffer dams shall be constructed and
maintained so as to. prevent erosion into
the water. If earthen material is used
for coffer dam construction, sheet
piling, riprapor a synthetic cover must
be used to prevent dam erosion.
24. Suitable fill material. All fill
(including riprap),' if authorized under
this permit, must consist of suitable
material free from toxic pollutants in
other then trace quantities. In addition,
rock or fill material used for activities
dependent upon this permit and
obtained by excavation must either be
obtained from existing quarries or, if a
new borrow site is opened up to obtain
fill material, the State Historic
Preservation Officer (SHPO) must be
notified prior to the use of the new site.
Evidence of this consultation with the
SHPO will be forwarded to the St. Paul
District Office.
25. Cultural resources. If cultural,
archaeological, or historical resources
are unearthed during activities
authorized by this permit, work must be
stopped immediately and the State
Historic Preservation Officer must be
contacted for further instruction.
26. Water intakes/activities. An
investigation must be made to identify
water intakes or other activities that
may be affected by suspended solids

and turbidity increases caused by work
in the watercourse. Sufficient notice
must be given to the owners of property
where the activities would take place to
allow them to prepare for any changes
in water quality.
27. Spill contingency plan. A
contingency plan must be formulated
that would be effective in the event of a
spill. This requirement is particularly
applicable in operations involving the
handling of petroleum products. If a
spill of any potential pollutant should
occur, it is the responsibility of the
permittee to remove such material, to
minimize any contamination resulting
from this spill, and to immediately notify
the State Duty Officer at 1-800-422-
0798 and the U.S. Coast Guard at
telephone number 1-800-424-8802.
28. Other permit requirements. No
Corps GP/LOP-98-MN authorization
eliminates the need for other local, state
or Federal authorizations, including but
not limited to National Pollutant
. Discharge Elimination System (NPDESI
or State Disposal System .ISDSI permits
from the Minnesota Pollution Control .

As you know, the Postal Service plans to purchase the Boderman site on the north side
of Tower Street between Duluth and Toronto Avenues. This letter summarizes the
Postal Service position about stormwater matters.
The Postal Service has reviewed stormwater data in the course of preparing its wetland
alteration and replacement applications. Based upon existing on-site grades,
preliminary grading plans, and preliminary calculations involving off-site stormwater,
and based upon Postal Service needs for using the entire site, the Postal Service is
prepared to physically accommodate approximately 100% of the rate control
requirements and approximately 60% of the water quality requirements of certain off-
site lands.
The Postal Service has allowed for these maximum impacts from off-site lands in its
wetland applications. If the need is less, then so much the better.
At present 2.89 acres are drained through a 15 inch storm sewer that traverses the
vacant Soderman site. Following conversations between City engineers and Postal
Service consultants, I understand this stormwater feature will remain unchanged. As
such it is only marginally relevant to the remaining issues we all face.
The drainage of 8.53 additional acres near the Tower and Toronto intersection requires
attention. This area includes what I have come to know as the Stonegate development.
It is this area that is the subject of the our future discussions. While the Postal Service
is prepared to accommodate the approximate quantities mentioned above, the terms of
such accommodation need to be the subject of further discussions.
Those conversations will logically include timing, documentation, compensation and
financial security for the same. The Postal Service's future general contractor can

make those improvements upon the site that the Postal Service plans to purchase. Off-
site improvements should be made under the direction of another party.

2.2 MATERIALS
A. Fencing:
1. The materials for fence framework (Le., pickets, rails, swing gates, and posts) shall be
manufactured from coil steel having a yield strength of 50,000 psL The steel shall be galvanized to
meet the requirements of ASTM A516 with a minimum zinc coating weight of .90 ounces per square
foot (coating Designation G-90), hot dip process. Galvanized framework shall be subject to six-
stage pretreatmentlwash (with zinc phosphate) followed by an electrostatic spray application of two
coat powder system. The base coat is a thermosetting epoxy powder coating (gray in color) with a -
minimum thickness of 2-4 mils. The top coat is a "no-mar" TGIC polyester powder coat finish with a
minimum thickness of 2-4 mils. The color shall be black. Coated galvanized framework shall have
a salt spray resistance of 3,500 hours using ASTM B117 Test Method without loss of adhesion.
2. Material for fence pickets shall be1" square by 16 ga. tubing. Post spacing shall be a maximum of 8
feet o.c. Posts shall be a minimum of 2-112" square x 12 ga. Pickets shall be spaced a maximum
of 5" o.c. Picket retaining rods shall be 0.125" dia. galvanized steel.
3. Concrete for fence post base. ASTM C-94, using 0/,." maximum size aggregate, and having
minimum compressive strength of 3,000 psi at 28 days. Grout shall consist of one part Portland
Cement to three parts clean, well-graded sand, and the minimum amount of water to provide a
workable mix.
2.3 FABRICATION
A. Pickets, rails and posts shall be precut to specified lengths.
B. Completed sections (Le., panels) shall be capable of supporting a 600 lb. Load applied at midspan without
permanent deformation. Panels shall be biasable to a 25% change in grade.
C. Swing gates shall be fabricated using the same panel material as the fencing. Each upright and rail
intersection shall be joined by welding. Each picket and rail intersection shall also be joined by welding.
Gates shall be locked with a keyed padlOck.
D. Finish - Black enamel baked on finish.
PART 3 EXECUTION
3.1 PREPARATION
A. Carefully inspect areas where fencing and gates are to be installed. Advise Contracting Officer of any
conditions which would adversely affect the installation. Do not proceed with work until unsatisfactory
conditions are corrected.
3.2 INSTALLATION
A. General: Install fence in accordance with the fence manufacturer's written instructions.
B. Excavation: Excavate for concrete-embedded items to the dimensions indicated. Remove loose material
from excavations, and remove waste material from job site. .
C. Metal Posts: Set posts plumb and in alignment in concrete bases. Thoroughly compact concrete to
prevent voids, and finish top in a dome shape approximately 1" above adjacent grade to shed water.
Allow concrete to cure at least 72 hours before proceeding with the work.
D. Fence Panels: Attach fence panels to post and masonry using brackets and hardware supplied by the

The meeting was held to discuss and seek resolution regarding city review comments. See attached copy
of those comments. The Architect noted the following items.
CITY OF PRIOR LAKE CORRESPONDENCE dated February 12.2001
1. The landscaping plan will be revised to include the additional three (3)- 2-1/2" caliper trees.
2. Fencing is not allowed by city ordinance in front yard setbacks. Since the property will front on
streets on all sides (after the completion of the ring road) the fences are objectionable to the city.
The USPS stated that this issue is important to them and fencing is necessary due to the fact that

public access, for children playing on site, is a pattern from the past. The USPS stated that they will
review and provide more aesthetic design solutions for city review. City staff is willing to consider a
fence in these areas given further design consideration. It was suggested that more opacity (50%)
and use of brick walls and ornamental fencing would be preferred. At this time the south side has
ornamental fence and the north side has chain-link.
3. The City requested some added shrubbery and trees along the north property line and offered to
consider some city landscaping on the new ring road right-of-way as a possible addition to the
project. This will be considered by the USPS.
4. P. Blees provided one copy of the exterior lighting plan to J. Kansier, with footcandle levels noted.
She said that the levels must not exceed 1.0 footcandle at the property line, but said that the plan, as
presented was acceptable. There are two locations where the 1.0 footcandle line passes over the
north property line.
5. The USPS provided rough information regarding the sign sizes and they are acceptable to the City.

6. The City has requested changes to the driveway locations and curb cuts based on the ring road
preliminary plan. This redesign effort should be acceptable to the USPS but the redesign will likely
not be accomplished until the ring road design is further developed.

7. There was much discussion regarding vacating and dedicating easements. The City would prefer to
do all of the easement changes at one time. Easements requested or required include: Major utility
easement on the southwest comer of the site (existing), Major drainage easement on the east half of
the site (modified from the current easement), small easement on the northwest corner to
accommodate the curve of the ring road (new), easement for new storm pipe being installed by the
USPS and carrying water from off-site (new) and vacation of easements that run north-south through
the center of the site. The city requested a formal application for the easement changes and stated
that they would define the legal descriptions for the easement areas they are requesting and graphic
representations of the changes requested. The City suggested that the easement changes should be
accomplished prior to start of construction.

9. Item three on the comments is not an issue as the pipe referenced is existing to remain.
10. The storm pipe that runs across the dock maneuvering area will become City property and will
require a new easement. There are 4 catch basin structures along this and downstream pipes that are
an issue with the watershed district. The district has indicated that the two new structures and two
existing downstream structures need to be sumps for collection of sediment. The City will review
this with the watershed district to see if the existing structures could remain as is. This issue was
apparently a condition of the watershed approval that was granted for the project.

11. Fire lane/no parking signs will be added on the two curbed islands near the new hydrant.
12. The City will designate an address number and the USPS will include the required sign over the main
entry.
13. CMA will clarify the water meter size for fee purposes.
14. P. Blees indicated that Jody Edwards ofMCES indicated a preliminary calculation of 5 SAC units.
15. The USPS will not provide a key box on the outside of the building. The City will accept this.
16. CMA will specify signs placed at 100 foot intervals around the east half of the property indicating
"U.S. Property, No trespassing.
17. The City expects that the ring road will be constructed during the 2002 construction season.
This Memorandum documents the author's understanding of the items discussed during the meeting.

A meeting was held at the Prior Lake Minnesota municipal office building on April 6,2000 for the purpose of
coordinating Postal Service building planning and the city's planning for construction of an adjacent 'ring road'.
The meeting was attended by representatives of the City of Prior Lake, representatives of the Postal Service, the
city's consultant for wetland submittals (BRW), the Postal Service consulting architect (CMA) and the consulting
architect's civil engineering consultant (V AA).
The primary points to be addressed included the alignment of the proposed 'ring road' adjacent to the prospective
future Postal Service property, wetland replacement on the property, storm drainage, utility relocation and
easement vacations, and zoning requirements.

1. Municipal engineering has scheduled construction of the proposed ring road in three segments, the first,
adjacent to the prospective postal property, to be built in 2001, the remainder of the road to be built in
subsequent years.
2. The 'ring road planning at this date has not proceeded past conceptual design; several layouts have been
presented to the city council which approved Layout No. 2 be developed. That concept was refered to at this
meeting.
3. Utility lines in the old Tower Street easement at the southwest corner of the postal site can be relocated, except
the 20" water line, which serves too large an area to be moved.
4. The 30" storm sewer draining the SW corner area of the postal site runs west and eventually north to empty
into Prior Lake.
5. The southwest corner portion of the Postal site, south of the old Tower Street RO.W. was filled 6-7' in depth
sometime in the past, with a 'lightweight fill' comprised of ground tires.
6. The city has a need to remediate a storm water condition at the intersection of Toronto and Tower streets
(surface water flow down adjacent streets to the intersection, then down Tower). The suggestion was made that
the city and USPS coordinate the respective projects.
7. The watershed district currently requires control of quality and rate flow of runoff, but is working on volume
control requirements. Storm water controls on-site are preferred.
8. Wetland banking I credit registration and exchange is recorded and approved by the state. Existing or
constructed wetlands are approved by the state for inclusion in the state-recorded 'bank'; once agreement is
reached for the purchase I sale of wetland credits between individual parties, the transaction is recorded by the
state. Once the wetland is reviewed and accepted by the state, the process becomes an administrative transfer.
9. The area within which wetland credits would be accepted as substitute for wetland construction for the Prior
Lake postal site comprises the Shakopee basin.
10. 75% of the surface area of runoff control ponding, in excess of existing wetland area, can be counted as the
equivalent of wetland for remediation credit purposes. If wetland is reconstructed, credit is available for the
area of associated upland buffer provided
II. Termination of the Postal Service consideration of this site is July II, 2000. To allow time for review, wetland
permit documents should be submitted to the Army Corps of Engineers in early May .
12. It was agreed a submittal to the watershed district should be made concurrently with or prior to the submittal
to the Corps, since modification of the wetland proposal could require an entirely new submittal (rather than
~". merely a modification).
13. The question of storm runoff control in the vicinity of Tower and Toronto probably looms larger to the city
council, than the wetland mitigation issue. Wetland replacement by credits for near to 100% of the
remediation requirement would probably be acceptable to the city in consideration of a joint storm runoff
control situation by easement or other mechanism involving postal property.
14. It was generally agreed to pursue the potential for stormwater control ponding on postal property; assuming
wetland mitigation will be provided by off-site purchase to the extend necessary; the replacement by credits of
up to 100% of the wetland is probably acceptable to the city.
15. City engineering staff will gather data and delineate the storm control area and runoff, CMA I V AA will
provide the necessary calculations. An initial engineering planning meeting will be held Monday 4/10.
16. Ms. Kansier verbally provided several data regarding city requirements for setbacks, parking, tree preservation
and documentation, general and perimeter landscaping, exterior materials. Ms. Kansier provided a copy of the
municipal zoning ordinance to CMA for reference.
17. Generally all planning approval requirements are administrative in nature, requiring no public hearings.
18. Courtesy review should be afforded the city council (and planning commission)(possibly injoint session).
19. It was generally agreed the triangular corner easements would not interfere with the developments; vacation
could be pursued if desired by the Postal Service, at a later time.
20. The site plan will be adjusted after the question of ring road alignment (especially at the northwest corner) is
more settled; in the interim, the ponding I storm water control I wetland issues on the eastern part of the site
will be pursued.

21. Jane Kansier will be the city contact for development and city submittal issues; Ms. Kansier provided a
copy of the Prior Lake zoning code for reference.

As requested, we provide the following responses to the comments received from the City of Prior Lake
regarding City staff review of the solicitation documents. The comments are not numbered or organized in a
specific manner, so we will reference the comments to the best of our ability relative to our responses. We
have attached a copy of the City comments for your reference.
LANDSCAPE ITEM:
Regarding the addition of three 2 1/2" caliper trees: We can comply and will ask the Landscape Architect to
provide the required documentation. The LA requests answers from the City to the following questions.
1. Does the City prefer a specific species or location for the three additional 2 1/2" caliper trees?
2. Are the additional trees needed to satisfy a tree replacement requirement in the City Ordinance or is
there another reason such as a desire for more screening or buffering somewhere on the site?
INSPECTOR ITEM:
Regarding the chain link fence: The fences were included as a USPS requirement. The constricted site does
not allow us to include the fence without being within the setback. We would prefer to eliminate the fence,
but this is the domain of the Inspection Service. Perhaps Inspector GautreaUx could provide a possible
solution. We will need to have some feedback from him before meeting with the City.
ELECTRICAL ITEM:
Regarding exterior lighting plan: We will coordinate this with the electrical engineer. Will comply.
ARCHITECTURAL ITEMS:
Regarding exterior signage: We will communicate the sign sizes to the City.
Regarding the Interoffice Memo and comments relating to the parking area drives. All of the requested
changes relate to the changes to the roadway alignment and the "Ring Road". We see no problem with the
suggested changes but redesign will be considered additional service. We will await further direction from

USPS ITEM:
We expect right-of-way and easement issues to be coordinated by the USPS.
ARCHITEcruRAL ITEMS;
Regarding the fire and life-safety issues on the Memo from J. Kansier. We can provide design claritication
for the four items on the last page of the memo; fire lane signs, address numbers, key box, and drawing of
site plan.
PERMIT ITEM:
The last item is the comments regarding fees and charges. We recognize the requirement to pay SACIW AC
charges, etc. We are not certain that the USPS or its contractor is required to pay the Sewer and Water
permit. That permit cost could exceed $26,000 and I am not sure that any of the offerors would have
included this cost in their offer. The MCES charge is about $5750.00 and the added charges for SAC and
WAC, from the City, ($3,000 per unit) would not be a surprise (This would amount to $15,(00).
CIVIL ITEMS:
The following comments all appear on page 2 of the Interoffice Memo from Bud and Sue to Jane Kansier,
dated 2/2/01 under the heading of Utilities. Our responses are as follows:
Comment: Private storm sewer system is located in a drainage easement and utility easement as well as the
area of lightweight fill.
Response: Last week I confirmed with Lani Leichty at the city that there are no proposed utilities located in
the area of lightweight fill based on a. drawing showing the extent of lightweight fill provided to us by the
city. We do show on our drawing private utilities in the utility easement. Assuming that water and sanitary
building services are not an issue the primary focus of discussion with the city would relate to the storm
sewer that originates at the existing wetland and connects to the city main.
All other comments on this referenced memo (Interoffice Memo, Page 2).
Response: Will comply.
Based on our conversation, we anticipate that you will share this response letter with the City as you
communicate with them to set up a meeting.

Dear Mr. Aggen:
The City of Prior Lake staff has completed review of the plans submitted for the
Prior Lake Post Office site. We have the following comments:
. The tree inventory indicates removal of 20 caliper inches of significant trees.
This is equal to 100% of the total caliper inches of significant trees. The
Ordinance allows removal of up to 25% of the significant caliper inches
without replacement. Anything above that must be replaced at the rate of
1/2" for each 1" removed. This will require 3 trees, at least 2 % caliper inches
in size, for replacement. The landscaping plan does not include enough
trees to meet this requirement.
. The plan indicates a chain link fence along Tower Street. Fences are not
permitted in the front yard setback.
. An exterior lighting plan must be submitted. Parking lot lighting is required
and must provide an average horizontal illumination between 0.4 and 1.0 foot
candles.
. The signage plan does not indicate the sizes of the proposed signs on the
site. The freestanding sign may not exceed 100 square feet. The wall signs
may not exceed 20% of the building face.
Also attached are comments from the City Engineering Department and from the
City Building Department. These issues must be addressed prior to site plan
approval.
We would like to schedule a meeting with you and your design engineers to
discuss these issues. Please contact me so we can arrange a date and time.

At your request, we have reviewed the proposed Post Office site plan, including the impacts the proposed
ring road on the Post Office site, and have the following comments:
1. POST OFFICE DRIVEWAY ACCESSES:
With the proposed Ring Road curving onto Duluth Avenue and between the Post Office and bank,
the following driveway modifications are recommended:
. The north parking lot, which we understand is the employee/truck parking area, should have
its access provided by a driveway on the east side of the lot and then connected directly to
the proposed Ring Road on the north. No connection should be provided between this lot
and other driveways or parking lots.
. The northern driveway onto Duluth, which serves both the employee lot, the public lots and
the drive-thru, box loop, should be moved farther south to avoid the curve and the future
intersection of Duluth Avenue and Ring Road. This driveway could serve both the public
parking lot and the drive-thru loop, but it should not be connected to the employee lot.
. The southerly driveway on Duluth Avenue, which is currently shown as an exit only from the
drive-thru lane, should be eliminated completely. The exit for the drive-thru could loop back
to the driveway on Tower Street.
. The two driveways on Tower Street could remain as designed. Both of these could be two-
way driveways. These two driveways could be connected through the southerly parking lot.
These recommended driveway modifications would enable the Post Office site to work better with the
proposed Ring Road while still providing three full accesses and one partial access to the site, which
is the same number of access shown on the proposed site plan.

RIGHT-OF-WA Y/EASEMENTS
Additional right-of-way/easements for the Ring Road are required from the post office site, as follows:
. Approximately 800 square feet will be needed in the northwest comer of the site to allow for
the Ring Road 25 mph curve required.
. A small area will be needed in the southwest comer for the new connection of Tower Drive
to Duluth Street, although this area is within the existing drainage and utility easement.
3. UTILITIES
. The proposed utility (sewer and water) connections to the site are acceptable.
. Show elevations of boards on the baffled weir details (for construction purposes).
. Private storm sewer system is located in a drainage and utility easement as well as the area
containing lightweight fill. No excavation is to take place in the lightweight fill area.
. Add the following note regarding CB G & H: 'Slide new manhole slab under the existing
pipe, construct new manhole over the pipe. Remove top portion of existing pipe by
sawcutting. Grout all voids with non-shrink grout.'
. Remove the proposed storm pipe leading into Pond B from the southeast, along with the
note.
. Reword the note referring to the existing catch basin at the west entrance on Tower Street to
read, 'Replace existing casting with a Neenah R-3510, or equivalent.'
. Add the following notes to Detail 9-C21.1: 1) 'Make connections to existing sanitary
manhole by core-drilling the holes.' 2) '20 foot minimum D.I.P. pipe length from the outside
drop tee-fitting.
. Page C1.3 - Change the 3rd sentence in Note 17 to read: 'Remove existing rings, add a 2.7
ft. barrel section, 66" 1.0., and adjust to grade with plastic rings. Remove existing 30" storm
pipe to the north and bulkhead hole in manhole wall with solid concrete block and non-shrink
mortar.'
. Page C1.3 - Add to Note 18: 'Remove existing rings, add a 4.0 ft. barrel section, and adjust
casting to grade with plastic rings.'
. Page C1.3 - Add to Note 19: 'Remove existing rings, add a 2.7 ft. barrel section, and raise
casting to grade with plastic rings.'
We would recommend that a meeting be set up with the Post Office as soon as possible to discuss
these issues.

As requested, we provide the following responses to the comments received from the City of Prior Lake
regarding City staff review of the solicitation documents. The comments are not numbered or organized in a
specific manner, so we will reference the comments to the best of our ability relative to our responses. We
have attached a copy of the City comments for your reference.
LANDSCAPE ITEM:
Regarding the addition of three 2 1/2" caliper trees: We can comply and will ask the Landscape Architect to
provide the required documentation. The LA requests answers from the City to the following questions.
1. Does the City prefer a specific species or location for the three additional 2 1/2" caliper trees?
2. Are the additional trees needed to satisfy a tree replacement requirement in the City Ordinance or is
there another reason such as a desire for more screening or buffering somewhere on the site?
INSPECTOR ITEM:
Regarding the chain link fence: The fences were included as a USPS requirement. The constricted site does
not allow us to include the fence without being within the setback. We would prefer to eliminate the fence,
but this is the domain of the Inspection Service. Perhaps Inspector Gautreaux could provide a possible
solution. We will need to have some feedback from him before meeting with the City.
ELECTRICAL ITEM:
Regarding exterior lighting plan: We will coordinate this with the electrical engineer. Will comply.
ARCHITECTURAL ITEMS:
Regarding exterior signage: We will communicate the sign sizes to the City.
Regarding the Interoffice Memo and comments relating to the parking area drives. All of the requested
changes relate to the changes to the roadway alignment and the "Ring Road". We see no problem with the
suggested changes but redesign will be considered additional service. We will await further direction from
the USPS.

USPS ITEM:
We expect right-of-way and easement issues to be coordinated by the USPS.
ARCHITECTURAL ITEMS;
Regarding the fire and life-safety issues on the Memo from J. Kansier. We can provide design clarification
for the four items on the last page of the memo; fire lane signs, address numbers, key box, and drawing of
site plan.
PERMIT ITEM:
The last item is the comments regarding fees and charges. We recognize the requirement to pay SAC/W AC
charges, etc. We are not certain that the USPS or its contractor is required to pay the Sewer and Water
permit. That permit cost could exceed $26,000 and I am not sure that any of the offerors would have
included this cost in their offer. The MCES charge is about $5750.00 and the added charges for SAC and
WAC, from the City, ($3,000 per unit) would not be a surprise (This would amount to $15,000). I don't
know if this cost was in the offers that we reviewed, but the low offer from ECI, Inc. seems to have included
most of the SAC & WAC charges.
CIVIL ITEMS:
The following comments all appear on page 2 of the Interoffice Memo from Bud and Sue to Jane Kansier,
dated 2/2/01 under the heading of Utilities. Our responses are as follows:
Comment: Private storm sewer system is located in a drainage easement and utility easement as well as the
area of lightweight fill.
Response: Last week I confirmed with Lani Leichty at the city that there are no proposed utilities located in
the area of lightweight fill based on a drawing showing the extent of lightweight fill provided to us by the
city. We do show on our drawing private utilities in the utility easement. Assuming that water and sanitary
building services are not an issue the primary focus of discussion with the city would relate to the storm
sewer that originates at the existing wetland and connects to the city main.
All other comments on this referenced memo (Interoffice Memo, Page 2).
Response: Will comply:
Based on our conversation, we anticipate that you will share this response letter with the City as you
communicate with them to set up a meeting.

by order of the Fire Department." Locate by Fire Hydrant and back up lane in front of
building.
. Provide numbers of addresses in such a way to be plainly visible from the street or road
fronting the property per UFC Section 901. Numbers shall contrast with their background.
. Provide approved key box to be installed in accessible location per UFC Section 902. This is
required when access to a structure is unduly difficult or where immediate access is necessary
for life safety or fire fighting purposes. Key boxes shall contain keys to gain necessary
access. Key boxes also recommended for building where entry may be delayed and to
prevent damage as result of forcible entry. Obtain order forms from the Building Inspection
Department.
. Submit 8-1/2 x 11 inch site plan for development of emergency response plan.
The building plans must be reviewed by the Cites Developmental Review Committee (ORC)
which consists of representatives of Planning, Engineering, Parks, Finance, and Building
Departments. The DRC must approve the plans before Utility hookup and Sewer and Water
permits can be issued.

relationship with the proposed Ring Road at your earliest convenience.
We have hired a WSB & Associates, an engineering consultant, to design the Ring Road. The project manager is Dave
Hutton. The preliminary design is far enough along to discuss the affects on the Post Office site. We have successfully
applied for and received a variance from MnDOT State Aid rules to decrease the radius length for the curve in the
northwest corner of the site, which lessens the impact on the Post Office property. We would like to discuss this ring road
plan, plus we have other comments on the proposed site plan.

Jane Kansier with the City of Prior Lake suggested that we attend the end of their regularly scheduled
department meeting to discuss the survey and process for amending the site easements. The Architect
noted the following items.
1. CMA presented the site survey with the proposed easement changes.
2. The city indicated that a specific schedule for the reconstruction of Duluth Ave. could not be
determined at this time due to legal proceedings. They estimated that the project would be bid in
October. The City indicated that they were not sure the project would be completed by July, 2004.
The City was open to having temporary connections as necessary.
3. Duluth Avenue along the West side of the site may have a different name after the reconstruction of
the road. The City refers to it as "the Ring Road".
4. The City presented a revised legal description for the changes along Duluth Ave. The drawings are
correct but the legal description will need to be redone.

5. The City requested that CMA be present at a future City Council meeting to provide some drawings
and descriptions of the project to the Council. The most likely date is October 20th to allow time to
publish in advance and accomplish the easement changes at the same meeting.
6. We need to submit our survey and application for vacation of easements by next week to get on the
schedule for the Council meeting on October 20th.
7. "Quit claim deeds" will need to be completed and signed related to the changes along Duluth Ave.
The City said they could have the documents prepared. CMA offered to forward them to the
appropriate USPS personal.
8. The City asked how the SAC and WAC charges would be coordinated. CMA will inform the
contractor to insure they contact and coordinate through Jane.
9. The Fire Marshall indicated that the PN valve on the South side of the building needs to be at least
as far from the building as the adjacent building is tall. (No dimensions are indicated on the
drawing.)
This Memorandum documents the author's understanding of the items discussed during the meeting.

The following are recommendations for the building pertaining to the Fire Code requirements.
Our review was based on the 1998 Minnesota State Fire Code (MSFC) which adopted with
amendments the 1997 Uniform Fire Code (UFC).
. Provide Water Meter size

. Provide fire lanes for fire apparatus response. Signage should read: ''No Parking Fire Lane
by order of the Fire Department." Locate by Fire Hydrant and back up lane in front of
building.
. Provide numbers of addresses in such a way to be plainly visible from the street or road
fronting the property per UFC Section 901. Numbers shall contrast with their background.
. Provide approved key box to be installed in accessible location per UFC Section 902. This is
required when access to a structure is unduly difficult or where immediate access is necessary
for life safety or fire fighting purposes. Key boxes shall contain keys to gain necessary
access. Key boxes also recommended for building where entry may be delayed and to
prevent damage as result of forcible entry. Obtain order forms from the Building Inspection
Department.
. Submit 8-112 x 11 inch site plan for development of emergency response plan.
The building plans must be reviewed by the Cites Developmental Review Committee (ORC)
which consists of representatives of Planning, Engineering, Parks, Finance, and Building
Departments. The DRC must approve the plans before Utility hookup and Sewer and Water
permits can be issued.

This Memorandum serves as an official record ofthe meeting held at 9:00 am on April 9, 2003. Through
the course of the proceedings CMA noted the following comments, concerns, and directives.
1. Watershed Requirements:
a. Jim Eggen indicated that it was the USPS responsibility to determine if the USPS is
exempt from local watershed district review. Jim has discussed this with Martin Hansen,
USPS by phone. Jim indicated he is waiting for a letter from Martin if the USPS is not
going through the normal review processes.
b. CMA indicated that we are required to design within the most stringent regulations.
c. There are new water infiltration requirements that will need to be met. Watershed
regulations have been modified since the previous design.
d. During the previous design (In 2000) a watershed permit was not obtained, but was
approved with contingencies of surety and easements.

2. Wetlands Mitigation:
a. COE approval letter is complete and on file. (Dated July 7, 2000)
b. Wetland credits have been approved by the Board of Water & Soil.
c. The City has given notice to the necessary parties of the mitigation.
d. Mitigation still requires City Council approval. Sue McDermott indicated that Council
approval should not be difficult.
3. On-site water ponding and infiltration:
a. Infiltration is required under the new watershed standards.
b. The previous design included storm water input into pond 'B' from off-site. The storm
water entered pond 'B' from the comer of Tower Street and Toronto Avenue. The City
will no longer require this connection. There is some existing storm water that enters the
site on the East from curb cuts and catch basins on Toronto Avenue. This storm water
will still need to be controlled and pond 'B' is the most likely possibility. Water
infiltration and storm water management will be redesigned.
4. Parking and Curb Cuts:
a. The City is planning to start construction on the redesigned Duluth Avenue mid to late
summer. This project will affect both curb cuts off Duluth Avenue shown in the previous
design. The curb cut at the Northwest comer of the property is a combined entrance for
customer parking, snorkel lane (mail drop) and mail carriers. This curb cut will need to
move south to accommodate the changes to Duluth Ave.
b. If the redesign of the parking layout cannot accommodate a connection to the carrier
parking on the West end or if the layout needs to be changed to one way traffic the City
will allow an additional curb cut at the East end of the carrier parking. CMA will
coordinate with the City to stay with in the new right-of-way for Duluth Ave.
c. It may be necessary to change the parking to one-way traffic to accommodate changes to
Duluth Ave. The entrance would be off of Duluth and the exit would be on Tower.
d. The City expressed concern with the exit of the snorkel lane as shown in the previous
design. The City expects there will be more traffic on Duluth and suggested that the
snorkel lane tie back into the parking near the exit on Tower Street.

5. City Permits and Fees:
a. CMA indicated its intention to try and identify and list as many of the required permits
and fees as possible before the project is sent out to bid. The intent is to make sure all
bids reflect these fees equally and avoid having the City providing the information to
each of the contractor's independently.
b. The City provided a list of 'Development Fees'. Several of these were discussed and
some fees were identified that were not on the list. The following is a list of the fees

x. Storm Water Area Charge as part of utility permit = $6092.00/acre (This is based
on net acrage - area less ponds & wetlands)
6. Fencing / Security:
a. CMA indicated that the USPS would like to fence the entire perimeter of the site.
b. The City will allow the fencing of the entire site. However, the City wants ornamental
fence where the fence is going to be adjacent to the public right-of-way. In addition,
landscaping should be used along the public right-of-way.
c. The city will look at adding some plantings along the North property line as part of the
redevelopment of Duluth Ave.
7. Easements:
a. The drainage and utility easement between lot 1 and lot 2 has been vacated but not
recorded.
b. The major utility easement across the Southwest corner will stay as is.
c. The existing drainage and utility easements adjacent to Duluth Ave., along the North
edge of the property and adjacent to Toronto Ave. will be vacated if a new drainage and
utility easement can be established on East half of the USPS property to include, as a
minimum, the delineated wetlands and potentially the other new storm water retaining
ponds. The USPS is responsible for defining and documenting the existing and the
changes to the utility and drainage easements.
d. Changes to the property definition due to the changes in Duluth Ave. will be defined and
documented by the City. Some property will be added to the USPS lot in the Southwest
corner. Some property will be subtracted at the Northwest corner. A small amount of
property may be added along the North edge on the property on the West end. This may
happen at a later date.
This Memorandum documents the author's understanding of the items discussed during the meeting.

Notes from phone conversation with Martin Hansen following the meeting referenced above:
1. Martin stated that the USPS intends to meet the new watershed requirements and directed CMA
to propose and proceed with the necessary changes.
2. Martin directed CMA to proceed with the redesign of the customer parking and curb cuts off
Duluth Ave. based on comments from the meeting. Martin agreed that the entrance to the carrier
parking should be moved to the East end of the parking area. Maintaining two-way traffic in the
customer parking would be preferred.
3. Martin suggested that the height and style of the ornamental fence be simplified along the
perimeter of the site and USPS standard ornamental security fence be used in areas where
additional security is required.
4. Martin directed CMA to get a proposal for the required survey work / easement definition. Martin
stated that any easement changes should include documentation of the existing easements,
vacated and new proposed easements.

Like the 34-cent stamp, the Prior Lake Post Office building on Anna Trail will soon become a thing of the past.
Funding for the construction of a new building to house the United States Postal Service operations in the city of
Prior Lake was approved last month by USPS headquarters. The decision to green-light the project came more
than two years after the federal government in February of 2001 placed a freeze on all new construction projects
proposed by the USPS.
For Postmaster Gayle Ozment and City Manager Frank Boyles, the news that Prior Lake had been selected as one
of only two cities in the USPS's entire west region to receive funding for a new construction project was
welcomed with open arms.
In fact, both said the timing was close to perfect, with Ozment pointing to the crowded conditions inside the
current building and Boyles noting that the construction of the new post office - expected to begin in June or July
and take approximately 12 months to complete - will coincide with the construction of the ring road between
Franklin Trail and Panama Avenue.
The new post office will be built on an approximately 4-acre piece of property on the south side of Highway 13
and behind the Wells Fargo Bank and Priordale Mall. It will be bordered on the west by Duluth Avenue, on the
east by Toronto Avenue, and on the south by Tower Street, with the ring road serving as one of the main
accesses to the property.
USPS take
Built in 1979, the current post office on Anna Trail has about 5,000 square feet. The new one will have
approximately 19,000 square feet. The extra space is badly needed, said Ozment.
"We've got stuff in every nook and cranny of this building," said Ozment on Tuesday (April 1). She pointed out
that the post office added two portable trailers in the loading dock area and that both get used for temporary
storage.
The need for more space and resources has grown with the city around it.
When asked about traffic, Ozment said the Prior Lake Post Office is visited by an average of 4,000 customers per
week during regular business hours, which are Monday through Friday from 8 a.m. to 5 p.m. and Saturday from 9
a.m. to 12:30 p.m.
That equates to about 1.3 customers per minute.
"It used to be that the second clerk didn't have to be at the window all the time helping customers and could be
used to do a lot of other things around the office," said Ozment. ''That's not the case anymore. Because of the
heavier traffic, the second clerk is just about always at the window now, helping along with customers.
"In addition to that, there are often cars lined up in the street, waiting to get into our parking lot."

Ozment speculated that one of the reasons funding was approved for the Prior Lake project may have been
because a number of the costs have already been paid by the USPS, with the biggest being the land purchase
which was finalized two years ago.
Ozment said she currently has 46 employees working out of the Prior Lake Post Office, but she added that the
number is likely to grow once operations are relocated to the new building and as the city - and the public's
demand for postal services - continues to grow.
''The new building will benefit every customer and our employees so much," she said. "Right now, there is not
one little corner of this building that doesn't have something in it."
City pleased
Boyles said that with traffic estimates of one customer per minute, the new post office "will be a real asset" for
the area and for the other businesses in the area, all of which will be served by the new ring road.
The ring road was designed to run parallel to Highway 13 and serve as a "backage" road for businesses between
Franklin Trail and Panama Avenue/Country Road 23.
The road is being constructed in phases. The first phase, stretching from Franklin Trail nearly to Toronto Avenue,
was completed last year in connection with the Keystone Communities senior housing complex.
Phases two and three of the project are to be done by the city, with the second phase connecting Toronto and
Duluth avenues and the third phase connecting Duluth and Panama/CR 23 and realigning the Panama/CR 23
intersection with Highway 13.
The city is currently pursuing easements for the second and third phases and is confident construction work will
begin this year.
Boyles said that as a federal agency, the USPS will not be required to obtain a building permit or go through the
planning review process, but that he is hopeful that the USPS will be a good neighbor and act in the best interest
of the neighborhood.
"So far, they have been very responsive," said Boyles.
Planning Coordinator Jane Kansier said the USPS had finished designing the new building and was taking bids
when the funding freeze went into effect.
Like Boyles, Kansier said it's a plus that the post office construction and ring road construction will apparently
coincide, adding, however, that there could be some complications resulting from the level of construction activity
taking place at the same time.
