RE: Flood Plain Requirements for the Property at 14390 Watersedge Trail
Dear Mr. Minnich:
The purpose of this letter is to summarize our discussion on Wednesday, April
15, 1998, about the flood proofing requirements for your property at 14390
Watersedge Trail. We have agreed that you will only be required to flood proof
the property to an elevation of at least 908.9 feet, rather than the current
requirement of 909.9 feet. As you may recall, we also discussed the several
options available to you for flood proofing this property. These options are
outlined below:
1) Flood proof the entire structure to what is known as the FP-1 standard. This
means the structure must be elevated on fill so that the lowest floor, including
a basement is at or above the 908.9' elevation. If you choose this method,
you must maintain the existing structure. Once the structure is elevated, the
elevation of the lowest floor must be certified by a registered land surveyor.
2) Flood proof the entire structure to what is known as the FP-2 standard. In
this instance, the lowest floor of the structure does not have to be elevated;
however, the structure must be built so that in the event of a flood, no water
will be allowed into the building, and the walls will not collapse under the
pressure. This method of flood proofing requires a design and certification by
a registered professional structural engineer.
3) We also discussed the possibility of maintaining a crawl space under the
lowest floor of the building. We have determined the crawl space is allowable
with two conditions:
. All portions of the lowest floor, including the floor joists must be above the
908.9' elevation.
. The walls of the crawl space must be designed to withstand the pressures
of flood waters. This design must be prepared and certified by a
registered professional structural engineer.

All of the above methods assume you will be maintaining the original structure on
the site. If the existing structure is removed completely, the new structure must
be elevated on fill to an elevation of at least 909.9 feet, in compliance with the
current flood plain requirements.

Dear Mr. and Mrs. Minnich,
As a follow-up to the meeting on February 13, 1998 with myself and Planning
Director Don Rye, the following determinations have been made on your
proposed construction:
. Normal repair and maintenance of the structure and repairs and alterations
necessary for health and safety are permitted below the regulatory flood plain
elevation. Therefore, you can replace the damaged roof, update electrical,
install new windows, reside the structure, and repair the plumbing of the
existing structure without having to flood proof the structure.
. The addition of the second floor is permitted without flood proofing the entire
structure, as it is above the regulatory flood protection elevation and is not
increasing the flood damage potential of the structure. Should the second
floor differ from the first floor footprint, then all setbacks and impervious
surface must meet current ordinance requirements.
. Considering the language in the flood ordinance (Section 5A-1-11) is specific
to the cost of structural alterations on non-conforming structures, only the
cost of structural alterations or additions are considered when compared to
the value of the structure. Structural alterations and additions cannot exceed
50% of the assessed value of the existing structure without having to flood
proof the entire structure.
Normal repairs and repairs for health and safety are not counted as structural
repairs. They are considered independently. Based on our meeting and this
interpretation you will not have to flood proof the existing structure. I understand
you intend to raise the lowest floor to an elevation of 908.9. Please be advised
while this is decreasing the potential for flood damage to your structure, your
house will not be at the minimum required regulatory flood protection elevation
(909.9 elevation). Variances are not necessary for the proposed project. I have

Dear Mr. and Mrs. Minnich,
The Planning Department is in receipt of your application for a variance. Your
application is incomplete because the application does not specifically state the
variances requested and the survey and building plans are missing pertinent
information.
Considering your property is in the flood zone, you can do alterations to the
structure, up to 50% the value of the structure only, without having to flood proof
the entire structure. These alterations include cumulative structural and non-
structural changes. You stated the recent assessed value of the structure was
$45,600. Therefore, you may be able to replace the roof only if the value of the
replacement is less than half the value of the structure or $22,800.
The total cumulative value of all alterations cannot exceed half the assessed
value, as on record at Scott County Recorders office, without flood proofing the
entire structure. The recently revised Flood Plain Ordinance determined the
flood protection elevation to be 1 foot above the regulatory flood elevation (908.9
for Prior Lake). Therefore, flood proofing of the structure must be to the 909.9
elevation.
You have the option of adding a second story, without cantilever or deck, of the
same size as the first floor without setback variances. If you increase the size of
the second story with proposed cantilever and the addition of a deck, then
setback variances will be necessary. In any event, if the cumulative value of all
work exceeds 50% of the value of the structure, then the entire structure must be
f1oodproofed.
In order to continue with review of the variance request (to add second story and
deck as proposed), the following must be submitted:

. A revised survey indicating cantilever and proposed deck and their setbacks
to all property lines. This is needed to determine exactly what variances are
needed. It appears sideyard setback variances are necessary and possibly
lakeshore setback, depending on the width of your proposed deck.
. An impervious surface worksheet is required with the survey (indicate existing
and proposed).
. The survey must indicate proposed lowest floor elevation. This elevation
must be at least 909.9 or other flood protection techniques must be utilized.
The 908.9 elevation must extend for 15' beyond the structure.
. Your building plans must include structural information on the deck. The
letter states your plans to construct a deck. The deck does not show up on
the surveyor plans.
If you choose to just replace the roof, then a copy of the actual bid must be
submitted with your building permit application. The Planning Department
cannot proceed with your variance request until all of the required information is
received. Please call me if you have any questions.

Dear Sirs:
Your building permit submitted November 7, 1997 is being denied for the following reasons:
· The existing structure is located within the 100 year flood plain. It is therefore,
nonconforming. City Code Section 5A-I-I 0 (enclosed) states that alterations or additions to
nonconforming structures within the flood plain cannot exceed 50% of the assessed value of
the structure. If the addition exceeds this amount, then the entire structure must be made
conforming to the flood plain regulations. No variances are granted to the flood ordinance.
To proceed with the project as planned, the following must be completed or approved:
. The valuation of the repairs cannot exceed 50% of the assessed value. The project may have
to be scaled down to meet this criteria; or
· The entire structure must be flood proofed.
All other City Code requirements must be adhered to. Prior to submitting another building
permit, we recommend that you meet with city staff to discuss your options and proposal. This
will help to expedite the review of your project and will help to eliminate and unforeseen issues.
Please be advised that the City of Prior Lake is in the process of adopting a revised Zoning
Ordinance. The Planning Commission has recommended that City Council adopt the revised
ordinance. City Council action is anticipated in January. The revised ordinance may have an
effect on the proposed development on this lot. Please call me if you have any questions.

Purnose of reauest: The resIdence in question was buiit in the 1960's and purchased bv
the Dresent ov,rners in i 984. It has not been moditled since \Ve Durchased the nronertv. We
have alwavs nimmed to H1mrove and to move to this resIdence on a fhii time basis after
retirernent. In Januaf',' j 997 the roof was disco'/ered to be seriouslv damaged \vhich
moved the decIsion to imorove the residence forward in time The snow load caused the
NW corner roof rafter to Dartianv collanse pushing out the NW \valL In order to ascenain
the level of damage and to gain the necessarv information for the insurance c1aim and to
gain the citv permit the insulation was removed tJ'orn the living room ceiling and waHs
oreveming use and DroDer heating of the DroDenv. In order to DroDerlv reDair the damage
and to prevent a future damage it is recommended to fitHv renlace the entire roof structure
with oretabricated trusses and to tie in the wails according to currem building codes. In
addition to the repair work required I am reauesting permission to add the foHowing
imDrovements to the residence. All work relating to tlus reDair: stmcturaL electrical.
