FINDINGS
1. Dennis & Ramona Johnson have applied for a variance from the Zoning Ordinance in
order to permit the construction of a single family dwelling on property located in the
R-1 (Suburban Residential) District and the SD (Shoreland Overlay) District at the
following location, to wit;
14530 Pine Road NE, legally described as Lot 5, Block 1, North Shore
Crest, Scott County, MN;
2. The Board of Adjustment has reviewed the application for variance as contained in
Case File #99-058 and held hearings thereon on August 23, 1999.
3. The Board of Adjustment has considered \he effect of the proposed variance upon the
health, safety, and welfare of the community, the existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, the effect on property
values in the surrounding area and the effect of the proposed variance on the
Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding property, the
proposed variance will not result in the impairment of an adequate supply of light and
air to adjacent properties, unreasonably increase congestion in the public streets,
increase the danger of fire, and danger to the public safety, unreasonably diminish or

impair health, safety, comfort, morals or in any other respect be contrary to the
Zoning Ordinance and Comprehensive Plan.
5. The special conditions applying to the subject property are unique to such property
and do not generally apply to other land in the district in which such land is located.
The unique circumstances applicable to this property include the substandard lot size,
and the fact the property was platted prior to adoption of the zoning ordinance.
6. Without variances, there is no buildable area located on this lot.
7. The granting of the variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant. The variance will not serve merely as a
convenience to the applicant, and is necessary to alleviate demonstrable hardship.
8. The contents of Planning Case 99-058 are hereby entered into and made a part of the
public record and the record of decision for this case.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment J1erebyapproves the
following variances for the proposed structure (as shown in ~ttache~ Exhibit A);

1. A 3,254 square foot variance to permit a lot area of 4,246 ~quare feet Jor th,e.Iot to be
buildable instead of the required 7500 square feet minimum; a 40.2 foot variance to
permit 34.8 foot setback from the ordinary high water mark (OHWM) of 904 foot
elevation instead of the required 75 foot minimum; a 12.47 foot variance to permit
12.53 foot front yard setback instead ofthe required 25 foot minimum; a 19.98 foot
variance to permit a 5.02 foot rear yard setback instead of the required 25 foot
minimum; a 7.3 foot variance to permit 7.7 foot structure separation instead of the
required 15 foot minimum required and include a 2 foot variance to permit eave and
gutter encroachment to within 3 feet ofthe lot line instead ofthe 5 feet minimum
required to allow a 5 foot side yard setback.
2. The City Engineer shall approve the applicants' plan for storm run-off and drainage
of the proposed irnprovements.
3. A revised survey compliant with all other Ordinances and Resolution conditions be
submitted prior to the issuance of a demolition permit for the existing structures and
building permit for the proposed structure.
4. Removal ofthe retaining wall and submit a planting and erosion control plan
approved by the Department of Natural Resources.
5. The resolution must be recorded and proof of recording submitted to the Planning
Department. An Assent Form must be signed and, pursuant to Section 1108.400 of
the City Code, the variance will be null and void if the necessary permits are not
obtained for the proposed structure within one year after adoption of this resolution.

1108.413 Revocation and Cancellation of a Variance. A Variance may be
revoked and canceled if the Zoning Administrator determines that the
holder of an existing Variance has violated any of the conditions or
requirements imposed as a condition to approval of the Variance, or has
violated any other applicable laws, ordinances, or enforceable regulation.
1108.414 After One Year. No Construction Required. All Variances shall be
revoked and canceled if 1 year has elapsed from the date of the adoption
of the resolution granting the Variance and the holder of the Variance
has failed to make substantial use of the premises according t6 the
provisions contained in the Variance.
1108.415 After One Year. New Construction Required. All Variances shall be
revoked and canceled after 1 year has elapsed from the date of the
adoption of the resolution granting the Variance if a new structure or
alteration or substantial repair of an existing building is required by the
Variance and the holder has failed to complete the work, unless a valid
building permit authorizing such work has been issued and work is
progressing in a.11 orderly way.
1108.416 Upon Occurrence of Certain Events. If the holder of a Variance fails
to make actual use of vacant land, or land and structures which were
existing when the Variance was issued and no new structure, alteration
or substantial repair to existing buildings was required; or if a new
structure was required by the Variance and no building permit has been
obtained, the Variance shall be deemed revoked and canceled upon the
occurrence of any of the following events:
(1) A change in the Use District for such lands is made by amendment to
the Zoning Ordinance by the City Council.

The statement shall describe the land involved or state the resolution

with the provisions of such Variance.

PLANNING COMMISSION MINUTES
MONDAY, AUGUST 23, 1999
1. Call to Order:
The August 23, 1999, Planning Commission meeting was called to order by Chairman
Stamson at 6:30 p.m. Those present were Commissioners Cramer, Criego, Kuykendall,
Stamson and Vonhof, Planning Director Don Rye, Zoning Administrator Steve Horsman
and Recording Secretary Connie Carlson.

3. Approval of Minutes:
The Minutes from the August 9, 1999 Planning Commission meeting were approved as
presented.
4. Public Hearings:
Commissioner Stamson read the public hearing statement and opened the first item.
A. Case File #99-053 Joseph and Carolyn Morgan are requesting a front yard
setback variance and a lot area and width variance to construct a single family house
with attached garage for the property at 3868 Green Heights Trail.
The City received a letter from the applicants requesting a continuance ofthe variance
hearing to September 13, 1999.

Vote taken indicated ayes by all. MOTION CARRIED.
B. Case File #99-058 Dennis and Ramona Johnson are requesting variances for
lot area, minimum building separation, setback from property boundaries and the
ordinary-high-water mark for the property at 14530 Pine Road.
Zoning Administrator Steve Horsman presented the Planning Report dated August 23,
1999, on file in the office ofthe City Planner.

The Planning Department received a variance application from Dennis & Ramona
Johnson for the construction of a single family dwelling with attached garage on the
property located at 14530 Pine Road NE. Five variances have been requested.
With respect to the lot area, building separation and setback variances, staff felt all of the
variance hardship criteria had been met and recommended approval with the following
conditions:
1. The City Engineer shall approve the applicants' plan for storm water run-off and
drainage of the proposed improvements.
2. A revised survey compliant with all other Ordinances and Resolution conditions be
submitted prior to the issuance of a building permit.
The DNR commented the proposed structure is an improvement over the existing
structure and impervious surface conditions which outweighs any objections to the
applicants' request subject to the conditions of erosion control. The DNR also suggested
some landscaping be applied to screen the new structure form the lake.
A letter from an adjacent property owner (Sue G. Dirkes, Aspen Colorado) objected to the
setback variances requested and was submitted into the record.
Resolution 99-19PC was revised to include a 2 foot variance to permit eave and gutter
encroachment to within 3 feet of the lot line instead of the 5 foot minimum required in
order to allow a 5 foot sideyard setback.
Comments from the public:
Applicant Ramona Johnson, 13008 Irving Avenue South, Bumsville, said they had owned
the cabin since 1970 and have been involved in the community. After conversations with
staff, the Johnsons felt they were doing their best to comply with the ordinances and still
be able to construct a home. Mrs. Johnson said they will also correct the retaining wall
which is partially on the neighbor's property.
Lucy Griffith Shepherd, stated her family has owned the property next to the Johnsons
since 1917 and have been good neighbors. Their concern for the wall in the past was to
keep the erosion under control. Now with the new construction, the Griffiths would like
to see Johnson's blocks of concrete removed from their property. Ms. Shepherd
presented pictures of the property pointing out the retaining wall. She would like to see
the wall taken out and did not object to any of the requested variances. Ms. Shepherd
also reported the neighbors are in support of the variances.

Comments from the Commissioners:
V onhof:
. Questioned staff in regard to building a structure below the street level. Horsman
responded it could be done. The street in question meets the requirements. Rye
explained the new code is to reflect positive drainage. There are no code issues.
. Explained hardship criteria and each case and property is unique. The variances go
with the land not the property owner.
. The proposed structure is moving back from the lake to a higher elevation.
. The wall is a non-conforming structure below the 904 ordinary-high-water mark. A
condition of the variance should be removal of the wall.
. A structure cannot be built without variances. The hardship criteria have been met.
Kuykendall:
. Agreed with V oOOof.
. Pine Road is a private road.
. This is a reasonable proposal and an improvement over the existing structure. There
are no hardships to the neighbors.
. No objections.
Stamson:
. Concurred with Commissioners.
. Without variances the lot is unbuildable. Support the variances as requested.
. Require applicants work something out with Pat Lynch from the DNR. It might be a
better measure. Rye explained any work below the 904 would require a permit from
the DNR.
Criego:
. The applicant did a wonderful job in proposing the new structure. It is a small lot and
the house meets the hardship requirements.
. Applicant took steps to reduce the impervious surface.
. Agreed with staff and should approve the requests.
. The DNR should help with the reconstruction of the wall.
Cramer:
. Agreed with all the Commissioners.
. All criteria has been met.
. Work with the DNR to comply.
Open Discussion:
. Kuykendall pointed out approval of these requests prohibits the addition of a deck.
. Stamson referred to the DNR's recommendation of removing the concrete wall.
Horsman explained that would be taken care of at the building permit stage.

· Kuykendall said the DNR's comments also included vegetation screening and should
be a condition of the variance approval. There should be riprap control. Add sod and
two trees as part ofthe condition.
· Stamson suggested submitting an erosion control and vegetation plan approved by the
DNR.

· Must have approval by City Engineer.

The Planning Department received a variance application from Dennis &
Ramona Johnson for the construction of a single family dwelling with attached
garage on the property located at 14530 Pine Road NE (see attached survey
Exhibit A). The following variances are requested:
1) A 3,254 square foot variance to permit a lot area of 4,246 square feet for the
lot to be buildable, rather than the required 7,500 square feet minimum, City
Code 1104.900; and
2) A 40.2 foot variance to allow a 34.8 foot setback from the ordinary high water
mark (OHWM) elevation of 904 feet, rather than the required of 75 feet
minimum, City Code 1104.302; and
3) A 12.47 foot variance to allow a 12.53 foot front setback rather than the
minimum 25 foot setback allowed, City Code 1102.405; and
4) A 19.98 foot variance to allow a 5.02 foot rear setback, rather than the
minimum of 25 feet, City Code 1102.405; and
5) A 7.3 foot variance to allow a 7.7 foot structure separation, rather than the
minimum separation of 15 feet required to allow for the proposed 5 foot side
yard setback on nonconforming lots, City Code 1101.502.
DISCUSSION:
North Shore Crest was platted in 1950. There are existing structures on the lot
which will be removed prior to any new construction. Access to the property is
by private driveway dedicated to all lot owners of the platted subdivision. The

elevation of the private driveway at the lot's access is 910.7 feet, 2.8 feet above
the 907.9 foot elevation as required under the Flood Plain Management
Ordinance. The lowest floor elevation of the new structure will be at 910.1' and
the minimum grade elevation of 908.9 shall be maintained within 15 feet of the
proposed structure. The existing impervious surface on the lot totals 79.35
percent. This surface shall be removed prior to the construction of the proposed
structure, and the new impervious surface will be 30% or less, as consistent with
the Zoning Ordinance.
Lot 5, Block 1, is a riparian lot located within the R-1 (Suburban Residential) and
the SO (Shoreland Overlay) districts. The lot dimensions are 50.9 x 76.3 feet;
therefore, this lot is considered substandard and nonconforming. The applicant
does not own either of the adjacent lots. If all required setbacks are applied to
this lot, there is no buildable area.
The proposed two story structure consists of a finished main level of 680 square
feet and includes a living room, dining room, kitchen, 1/2 bath and laundry room.
The 476 square foot tuck-under two stall tandem garage completes the ground
level area of 1156 square feet. The 2nd floor includes a master bedroom, bath
room and closet, with two additional bedrooms and bath room.
The lowest floor level is proposed to walk out to the lake side. Any proposed
deck will require a wood platform with a minimum of 1/4 inch deckboard
separation and a maximum height of 29 inches to avoid structure setback
requirements and not meet the definition of an impervious surface.
In addition, the Uniform Building Code requires a minimum separation of 6 feet
between buildings of less than one hour fire resistant construction, a minimum of
4 feet between eaves and overhangs, and a minimum of 3 feet to a lot line are
required. As proposed the building separation between the new structure and
the existing garage is 7.7 feet. The existing garage adjacent to this property has
2 foot eaves and to maintain the required 4 foot minimum separation between
eaves the proposed structures eaves cannot exceed 1.5 feet on the north side.
The remaining eaves shall not exceed 2 feet, this avoids increases to the
impervious surfaces.
In order to utilize the 5' sideyard setback allowed on a substandard lot, a
minimum 15 foot building separation between all buildings is required. The
existing garage on the lot to the north is 2.6 feet from the common lot line. The
proposed garage on Lot 5 will be located 7.8 feet from this structure, rather than
the required 15 feet.
In addition, the city code on yard encroachments restricts mechanical (AlC) and
electrical equipment (lights), ornamental features (flag poles), and awnings from
the front, side and rear yard areas.

The DNR comments on this request are attached. In essence, the DNR feels the
proposed structure is an improvement over the existing structure and impervious
surface conditions and this outweighs any objections to the applicants' request
subject to the conditions of erosion control. The DNR also suggests some
landscaping be applied to screen the new structure from the lake.
VARIANCE HARDSHIP STANDARDS
1. Where by reason of narrowness, shallowness, or shape of a lot, or
where by reason of exceptional topographical or water conditions or
other extraordinary and exceptional conditions of such lot, the strict
application of the terms of this Ordinance would result in peculiar and
practical difficulties or exceptional or undue hardship upon the owner
of such lot in developing or using such lot in a manner customary and
legally permissible within the Use District in which said lot is located.
The lot area is a condition of which the applicant has no control. The land
was developed when current ordinances did not exist. Without the variance
to lot area and setbacks the lot remains in violation of city code (setbacks and
impervious surfaces). If all required setbacks are applied, there is no
buildable area on this lot.
2. Conditions applying to the structure or land in question are peculiar to
the property or immediately adjoining property, and do not apply,
generally, to other land or structures in the Use District in which the
land is located.
The existing conditions of the lot area and dimensions are peculiar to the
property, and generally do not apply to most other lots within the Shoreland
district. The existing structures are dated and improvements needed. If all
required setbacks are applied, there is no buildable area on this lot.
3. The granting of the proposed Variance is necessary for the preservation
and enjoyment of a substantial property right of the owner.
Without a variance to lot area and setbacks the lot is not buildable.
4. The granting of the proposed Variance will not impair an adequate
supply of light and air to the adjacent property, unreasonably increase
the congestion in the public streets, increase the danger of fire, or
endanger the public safety.
The granting of any of the requested variances (lot area and setbacks) will
not impair light and air to adjacent properties or increase congestion, danger
of fire or endanger public safety as the access is private.

5. The granting of the Variance will not unreasonably impact on the
character and development of the neighborhood, unreasonably
diminish or impair established property values in the surrounding area,
or in any other way impair the health safety, and comfort of the area.
The granting of the variance to lot area and setbacks will not adversely affect
the neighborhood or impair the health safety or comfort of the area as the
conditions are existing. The elimination of existing impervious surfaces will
improve the current storm water run-off into Prior Lake. In addition, the new
structure will not diminish established property values in the surrounding
area.
6. The granting of the proposed Variance will not be contrary to the intent
of this Ordinance and the Comprehensive Plan.
The granting of the variance to lot width and setbacks on nonconforming lots
of record is not contrary to the intent of the ordinance or the Comprehensive
Plan as long as all other ordinance criteria can be met, such as impervious
surface.
7. The granting of the Variance will not merely serve as a convenience to
the applicant but is necessary to alleviate a demonstrable undue
hardship or difficulty.
Without the variances, the existing structures on the lot exceed impervious
surface percentages and do not meet setback requirements. No new
structures can be built without variances. A hardship exists and is not merely
a convenience to the applicant.
8. The hardship results from the application of the provisions of this
Ordinance to the affected property and does not result from actions of
the owners of the property.
The lot area and dimensions are existing conditions and not a result of
actions of the property owner. The provisions of the ordinance affect the
property and the owners options.
9. Increased development or construction costs or economic hardship
alone shall not be grounds for granting a Variance.
The hardship is caused by the existing conditions on the lot. Financial
considerations alone are not the grounds for granting any variance
requested.

RECOMMENDATION:
With respect to the lot area, building separation and setback variances, staff
feels all of the variance hardship criteria have been met and recommends
approval as shown on the attached survey (Exhibit A), with the following
conditions:
1. The City Engineer shall approve the applicants plan for storm water run-off
and drainage of the proposed improvements.
2. A revised survey compliant with all other Ordinances and Resolution
conditions be submitted prior to the issuance of a building permit.
ALTERNATIVES:
1. Approve the variances requested by the applicant, or approve any variances
the Planning Commission deems appropriate in the circumstances.
2. Table or continue discussion of the item for specific purpose.
3. Deny the application because the Planning Commission finds a lack of
demonstrated hardship under the zoning code criteria. In this case, the
Planning Commission should direct staff to prepare a resolution with findings
denying the variance requests.

Dear Mr. & Mrs. Johnson:
It was a pleasure visiting with you yesterday at your property on Prior Lake, located at 14530 Pine Road
Northeast. At your request, we inspected the existing concrete retaining wall along your shoreline, and
discussed how best to address it from both a function and appearance perspective. We also briefly
discussed the contents of my August 17, 1999 letter to the city of Prior Lake, in which I responded to your
variance application.
.
Your existing retaining wall, consisting of poured and block concrete, is non-compliant with current
regulation, and is in a state of deterioration. There are two practical options for dealing with the wall. The
first option is to break up the concrete and remove the wall from the lake bed, followed by bank
stabilization in form of rock riprap. The shallow depth of your lot, along with your future building plans,
render sloping the bank back and naturalizing it with aquatic vegetation very difficult.
The preferred option, to which you seemed agreeable, is to leave the existing poured section in place,
remove the upper portion consisting of cinder block (along the west wall), and to place natural rock riprap
in front and on top of the remaining poured wall. Removing the existing wall in its entirety has the
potential to result in a significant erosion problem once the bank behind it is exposed. Leaving it in place
eliminates the risk, as well as the project cost. The concrete is inert material which does not pose a water
quality concern.
Rock riprap can consist of field stone or quarried limestone, must average 12" in diameter or larger, and
have a tinished slope of 3 to 1 (horizontal to vertical) or flatter. This is depicted on the riprap brochure
I left with you. A geotextile fabric beneath the stone is critical to prevent undermining of the soil behind
and beneath the rock. The ends of the riprap section at your east and west property lines should be
"wrapped" as I have exaggerated on the enclosed drawing. I also recommend the top of the riprap be at
elevation 905' to prevent wave erosion from behind during high water events.
If you can accomplish the riprap in accordance with that which I outlined above, the project will not
require a DNR permit.

As for erosion control during your project, I recommend the slabs nearest the lake be removed as soon as
is practical, so that a double row of silt fence paralleling the lake shore can be trenched in to the ground.
If this is inadequate, the city may direct you to take other or additional erosion control measures.
I also provided the city comments in my letter relative to vegetative screening and landscaping. After
walking the site with you, it is less a concern to me. In addition to the 24" ash tree which is situated on
your lot between the existing home and the lake, there are two trees (species I could not identify) on the
southeast comer of your lot which did not show up on the survey. . There are also several trees along the
shore to the west of your lot which are currently providing additional screening of your property, making
it difficult to see your structure from the west unless one is directly in front of the lot (when viewed from
the water). I am comfortable rescinding the recommendation to the city to require additional tree planting
on the lakeward side of your proposed home, provided the existing ash and trees on the southeast comer
of your lot are not removed.

Dear Commission,
I'm writing to you as the representative of owners of 14500 Meadowlawn Trail NE (Lot I,
Meadowlawn), due west of the Johnson parcel back yard perimeter. The purpose of this letter is
to express concern regarding the variances requested for the above referenced property.
The redevelopment of this parcel directly affects our property rights. Set backs are established for
reasons of privacy, safety and character. None of the variance requests honor these premises.
Currently Mr. and Mrs. Johnson encroach with their retaining wall upon our property's (mean
high water level) lakefront. This encroachment is evident in: the Certificate of SUIVey, May 17,
1999. The encroachment was done without our permission. It is imperative that this retaining
wa.ll is removed from its current location and is not part of the redevelopment plan.
Historically, this property was subdivided in the 1920's and sold in the 1950's. The Johnson's
parcel was the least desirable and cheapest lot in the whole subdivision. It sat low in the gully
through which drained all the run-off' from the higher ground on the north. east and west. On the
lake side the parcel was subject to flooding, hence the construction of the retaining wall. The
summer cabin was built with non-conforming setbacks. These conditions still exist today.

will be removed. Please ensure the low floor of a new structure (including hasemcnt or crawl spacc) i!'i

The lake side grade will be significantly altered. An erosion control plan should he developed fl.)r the site,
as the potential for erosion is great for the site, given the removal of the concrete slabs and significant
grading. Silt fence, at a minimum, should be installed parallel to the lake shore.
Finally, the grading and slab removal on the lake side of the structure wiJJ result in a ~t.eri1e, manufactured
look. Ple(lse consider requiring a landscaping plan which incorporates the pi anting of trees which, in rime,
provide some screening of the structure as viewed from the waler.

To Prior Lake Planning Commission:
Dennis and I have fond hopes of being able to turn our summer cabin on Prior
Lake into our retirement home. The present structure is not livable for year-round
use. There is a dirt floor and dirt side & back walls in the basement, with a step
down from the door of905.6. With two small open (no glass or frame) windows,
making it almost impossible to winterize. The wood joist have had black carpenter
ants eating at them over the years. This originally was an old fishing shack, with
many additions added on and incorporated into an outside shell, before we ever
bought it in 1971 as a lake cabin. Because we have a very small lot we understand
we will have to be granted many variances to make this work.
We have proposed plans for a 34 X 34 ft. structure which will bring the
impervious surface back under 30 %.
The building will be 20 ft. wide house and 14 ft. garage by 34ft. deep, with a
34 X 34 ft. second floor.
Since the lot is only 75 ft. deep from the lake, we propose to place the
building as close to the side lot line (away from the lake) as possible, like 5 ft.
This would put us 36 ft. back from the lake side of our lot.
At the side of the lot away from the lake, we have 50.9 ft. from front to back.
We propose to place the building as far back as possible, again like 5 ft.
This will give us 11.9 ft. for front yard and driveway, on the street front of
our lot.
Our proposed lowest floor level will be 910.1 to move us up and out of the
flood zone. This will be the 20 X 34 ft. of house and the 14 X 34 ft. garage portion
will be up 4 steps to 912.7 elevation. The 34 X 34 ft. second floor will be all at the
same level.
