The Lake Advisory Committee (LAC) Meeting was called to order at 4:30 P.M. Members
present: Dan O'Keefe, Char Jasan, Tom Voll, Liz Weninger.
Others present: Mike Myser (City Council Liaison), Ross Bintner (Water Resources
Engineer), Stacy Sass (PLSLWD Technician), Paul Nelson (Scott WMO Administrator)
Troy Kuphal (SWCD Administrator), and Bret Krick (Sheriff Deputy).
CALL TO ORDER
II. APPROVAL OF MINUTES
A. There were no minutes to present.
III. OLD BUSINESS
SurFace Water Regulation (Ordinance 703) Public Hearing: O'Keefe
introduced Ross Bintner, Water Resources Engineer and asked him to
start the Public Hearing and explain the proposed change to the
ordinance. Bintner stated the only change was the addition of 703.406,
No Wake Zone. The change in ordinance would affect the following six
areas of the lake: The Wagon Bridge, east of Reeds Island, Lords Street
Bridge, the surface areas of Boudin's Bay and Candy Cove, and the
entrance of Crystal Bay. No changes were made to either definitions or
the general speed limit.
O'Keefe opened the Public Hearing.
Mike Myser, 3857 Island View Circle N.W. stated that the daytime speed
limit is 45 m.p.h. He stated that barefoot skiers would be impacted by the
speed limit since they need to exceed that while barefoot skiing. He
asked for reconsideration of any speed limit change on behalf of those
skiers.
Weninger motioned to close the Public Hearing. Second by Jasan.
Approved 4-0. The Public Hearing was closed.
Weninger questioned whether there was a DNR speed limit set on Prior
Lake. Bintner said the DNR doesn't set a limit on Prior Lake but City
Ordinance does. Bintner reiterated that no speed limit change had been
proposed to the ordinance and added that City ordinance states that
daytime watercraft speed limitations are 40 m.p.h. from sunrise to one
hour after sunset, on all weekends and legal holidays occurring from
Memorial Day through Labor Day. Nighttime speed limits are set at 20
m.p.h. Weninger questioned if it applied to Spring Lake as well as Prior
Lake. Bintner said no. Weninger asked how they could address Myser's
concerns about barefoot skiing.
O'Keefe questioned Deputy Krick about accommodating barefoot skiers
in the eariy morning hours.
Scott County Deputy Krick said that early morning hours are not a
problem. He added that on weekend or holidays, there is more boat
traffic in general and that creates chop. Barefoot skiing cannot be done
under those conditions. He also said that barefooters are generally not a
problem. But he added that if we were to make exceptions for them, that
we have to accommodate slalom skiers, etc. and that would confuse the
issue further.
Jasan mentioned that the ordinance only stipulates the speed limit from
Memorial Day to Labor Day.
Deputy Krick stated that there is no daytime speed limit on Prior Lake
right now and that the nighttime speed limit is the only one in effect.
O'Keefe said people would not be impacted this summer.
Jason stated barefooters usually ski a straight line and do not go all over
the lake.
Weninger was concerned that the ordinance did not address Spring Lake.
Binter stated that the City of Prior Lake only has jurisdiction over Prior
Lake but that the DNR has jurisdiction over Spring Lake. Weninger asked
if the ordinance would be in effect for Spring Lake once the area was
completely annexed and Binter answered that if the entire shore along
Spring Lake was annexed, then the ordinance would apply.
Weninger made the motion to pass the ordinance and forward it on to the
City Council. Second by Jasan. Approved 4-0.
IV. OTHER BUSINESS
1. Scott WMO Update - Paul Nelson
Paul Nelson, Natural Resource Program Manager for Scott County,
presented a map of Scott County portraying the different water resource
management organizations, their designated areas, and each of their
individual functions. He talked about the projects that the groups have
been partnering on, and WMO vision for water resources.
Bintner mentioned the grant from the Scott County WMO and the
assistance that has been provided for various projects: the Brooksville
Hills Rain Gardens, the Grainwood Bio-Retention Project, the street
sweeping project, and the sand iron filtration system. These projects
were partnered by the Prior Lake/Spring Lake Watershed and the Scott
County WMO.
2. Scott Sheriff's Deputy Update - Bret Krick
Deputy Krick provided a copy of the report that was done for the DNR and
the U.S. Coast Guard. He talked about staffing concerns. He said that
there are over 2000 manhours spent on water patrol. Main water patrol
problems include: lack of personal floatation devices and life jackets,
registrations, and underage consumption. Weninger asked if
patrolling was done on just Prior Lake or was Spring Lake included. Krick
answered that patrolling is done on all the lakes in Scott County. Jasan
asked about manpower concerns for 2010. Krick answered that they
would have the same level of manpower for this coming year. He stated
that could be less traffic due to low water levels.
3. Scott SWCD Update - Troy Kuphal
Troy said that SWCD main emphasis was soil conservation work. Within
the last decade, their role has been evolved into water quality. The goals
of the SWCD are to promote healthy land and clean water through the
various organizations that they interact with. Their expertise is in
technical and engineering assistance, inventory studies, conservation
projects, and helping to design, engineer and supervise those projects.
The organization provides a conduit for financial assistance and cost
sharing of resources. Weninger asked about grant provision and Kuphal
explained how grant inquiries are handled.
4. PLSLWD Update - Stacy Sass, Water Resources Technician
Stacy started with the PUSL Watersheds Mission Statement which is to
manage and preserve water resources. She referred to their upcoming
projects: Channel Restoration, Outlet Structure, and Upper Watershed
Assessment. The PL/SL Watershed is working on a Water Management
Plan and the Upper Prior Lake TMDL and implementation. She talked
about the progress that has been made on the outlet channel which has
been an effort of the City of Prior Lake, Shakopee, and SMSC. She also
talked about partnering with the other agencies on educational projects
and the progress being made.

January Workshop Review - Watershed Game/NEMO and February
Workshop Review - Water Quality Utility Budget/Cost Efficiency
Bintner talked about the two workshops that were shared with Scott
WMO, Scott SWCD, the City of Prior Lake and the Prior Lake Spring Lake
Watershed. Items discussed were: What is a watershed, nutrient
impairment, and different solutions. The Watershed Game was played
and we learned what the various agencies roles were in solving the
problems. In February, we talked about storm water uti~ity, the budget,
cost efficiency and the plan for how the City of Prior Lake can be brought
into compliance. Bintner also spoke about various grant opportunities in
2011.
O'Keefe said that a lot of information was presented and mentioned the
progress in water quality that has been made.

Jason made a motion to adjourn. Second by Weninger. Approved 4.0.

NOTICE OF PUBLIC HEARING TO CONSIDER AN AMENDMENT TO CHAPTER 703 OF THE
PRIOR CITY CODE
You are hereby notified that the Prior Lake Lakes Advisory Commission will hold a
public hearing at the Prior Lake City Hall, located at 4646 Dakota Street SE, on:
Tuesday, Apri 1 20, 2010, at 4:30 p. m or as soon thereafter as possi bl e.
The purpose of this public hearing is to consider an amendment to Chapter 703, Public
Waters, of the City Code. The amendment establishes specific slow no-wake zones in
the following locations:
l. The channel located directly North and South of the County Road
21/Eagle Creek Avenue Bridge starting and ending at the navigational
red and green channel markers placed at both ends.
2. The navigational channel marked by red and green navigational
channel markers and no-wake buoys to the east of Reed's Island.
3. The navigation channel marked by slow no-wake buoys at both ends
north and south of the Lords Street Bridge.
4. The navigational channel marked by slow no-wake buoys entering and
exiting from Boudin's Bay, including the entire surface area of
Boudin's Bay.
5. The entire surface area of Candy Cove, starting and ending at the no-
wake buoy placed approximately one hundred fifty (150) feet west of
the entrance point to Candy Cove.
6. The channel located at the entrance/exit point to Mud Bay, marked by
slow no-wake buoys at either end of the navigable channel at said
entrance/exit point.
If you are interested in this issue, you should attend the hearing. Questions related to this
hearing should be directed to the Prior Lake Public Works Department by calling 447-
9832 between the hours of 8:00 a.m. and 4:30 p.m. Monday through Friday. The Lakes
Advisory Commission will accept oral and/or written comments.

703.100: TITLE: This Section shall be known and cited as the PUBLIC WATERS Code.
703.200: PURPOSE, INTENT, AND APPLICATION: Consistent with authoritv provided
to the Citv pursuant to Minnesota Statutes 86B.201, 86B.205, and 459.20,
and Minnesota Rules 6110.3000 - 6110.3800, as may be amended from
time to time, the purpose of this section is intended to control and regulate
the use of the waters of Upqer and Lower Prior Lake in the Citv of Prior

703.300: DEFINITIONS: For the purposes of this Section, the definitions set out in
Minnesota Statute Section 866.005 are incomorated herein and made part of this
Section. ~g TEerms not defined bv said Statute shall have the following
meanings:
High Water. An elevation of 904.0' or greater above mean sea level on Prior Lake,
as determined by the Prior Lake/Spring Lake Watershed District gauge.
Prior Lake: The body of water given that name and assigned the lake numbers 70-
2 and 70-72 by the Department of Natural Resources.
Shore: The line separating land and water which shifts as lake levels increase and
decrease.
Slow No-Wake: The operation of a watercraft at the slowest possible speed
necessary to maintain steerage and in no case greater than five (5) miles per hour
or such lesser speed so as not to cause a wake.
Wafercraft. Any contrivance used or designed for navigation on water, except: 1)
a duck boat during the duck hunting season; 2) a rice boat during the harvest
season; or 3) a seaplane.

No watercraft towing a person on waterskis, innertube, aquaplane or similar device
shall be operated at any time within one hundred fifty feet (150') of shore; provided,
however, that any watercraft launching or landing a person on waterskis, innertube,
aquaplane or similar device by the most direct and safe route to open water or
shore shall be exempt from this provision.
703.402 General Speed Limit: No person shall operate a watercraft, any time, at qreater
than a slow no-wake speed within one hundred fifty feet (150') from shore.
703.403 Davtime Speed Limit: No person shall operate a watercraft at greater than forty
(40) miles per hour, from sunrise to one hour after sunset, on all weekends and
legal holidays occurring from Memorial Day weekend through Labor Day weekend.
703.404 Niqhttime Speed Limit: No person shall operate a watercraft at greater than
twenty (20) miles per hour, from one hour after sunset to sunrise the following day,
at any time during the year.
703.405 Hiah Water Slow No-Wake: No person shall operate a watercraft at greater than a
slow no-wake speed on the entire Lake when the water level reaches nine hundred
four feet (904.0') sea level, as measured by the City at the Prior Lake/Spring Lake
Watershed District gauge.

When the water level of Prior Lake reaches 904.0' sea level, the City Manager or
designee shall arranged to have notice of the no-wake provision televised on the
City's cable channel. The slow no-wake restriction shall become effective as of the
first televised notification. All public water accesses shall be posted prior to and
during the time the restrictions are in place. In addition, notice of said restrictions
shall be posted at Prior Lake City Hall.
When high water levels have subsided and have remained below an elevation of
nine hundred four feet (904.0') sea level for three (3) consecutive days, said
restriction shall be promptly removed.
.Marked Slow No-Wake Zones: No person shall. at any time, operate a watercraft Formatted: Font: Bold, Underline
at qreater than slow no-wake speed in any marked no-wake channel/zone. The
City of Prior Lake or County of Scott shall install or cause to be installed buoys
markinq naviqable channels and/or no-wake zones. These channels and zones are
intended to maintain a safe lake environment and protect the lives and propertv of
all lake users and owners. These channels/zones shall be oosted at the followinq
locations:
• The Channel located directlv North and South of the Countv Road 21/Eaqle~
Creek Avenue Bridqe startinq and ending at the navigational red and qreen
channel markers placed at both ends.
• The naviQational channel marked bv red and preen naviQational channel
markers and no-wake buoys to the East of Reed's Island.
• The navigational channel marked by slow no-wake buoys at both ends
North and South of the Lords Street Bridqe.
• The navigational channel marked by slow no-wake buoys entering and
exitinp from Boudin's Bay including the entire surface area of Boudins Bav.
• The entire surface area of Candv Cove startina and ending at the no-wake
buoy placed approximatelv one hundred fiftv (150) feet West of the entrance
point to Candy Cove.
• The channel located at the entrance/exit point to Mud (Crystal) Bav, marked
by slow no-wake buoys at either end of the navigable channel at said
entrance/exit qoint.
703.500: ADDITIONAL RESTRICTIONS: No person shall use an inflatable water toy, air
mattress or innertube more than one hundred fifty feet (150') from shore, unless
accompanied by a watercraft. No person shall swim more than one hundred fifty
feet (150') from shore, unless accompanied by a watercraft.
703.600: EXEMPTIONS: All authorized resource management, emergency and enforcement
personnel, while acting in the performance of their assigned duties, are exempt
from the restrictions set forth in this Section.
A temporary exemption from the restrictions set forth in subsection 703.401 may be
allowed under certain circumstances. To qualify for a temporary exemption, an

application for a permit must be completed, which shall include: the purpose of the
exemption, the organization or persons being exempted, the location of the
exemption, and the date and time of the exemption. The temporary exemption
permit shall be issued by the Scott County Sheriffs Department.
703.700: NOTIFICATION: The City shall notify the public of this Section, which shall include
but not be limited to placing a sign at each public watercraft launching facility
outlining the essential elements of this Section, as well as placing other necessary
buoys and signs.
703.800: ENFORCEMENT: The enforcement of this Section shail be the primary
responsibility of the Scott County Sheriff's Department. Other licensed peace
officers, including conservation officers of the Minnesota Department of Natural
Resources, are also authorized to enforce the provisions of this Section.
703.900: PENALTIES: Any person who violates any provisions of this Section shall be guilty
of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not
more than seven hundred dollars ($700.00), or by imprisonment of not more than
ninety (90) days, or both.
