Development Contract.
16. GITY eDNSTRUCTION OBSERVATION. Construction observation shall include, but is
not limited to, part or full-time inspection of proposed grading, public utilities and street construction and
City consultant expenses. The Developer shall deposit an amount equal to five percent (5%) of the
estimated construction cost, less sewer extension costs to Industrial Circle as detailed in paragraph 29, for
construction observation performed by the Cit}�s authorized personnel. This amount shall be maintained
by the City in escrow until final acceptance of all Developer Installed Improvements by the City. Any
balance remaining in the escrow account will be returned to the Developer at that time. Extraordinary costs
incurred by the City over and above the five percent (5%) Construction Observation fee shall be billed to
the Developer. Extraordinary costs are defined as costs resulting from change orders applied to the project,
project delays or costs incurred as a result of unknown conditions at the tixne of design.
17. TRUNK STORM WAT�R ACRFAG� CHARGE. A trunk stormwater acreage charge
of $9,768.00 shall be paid by the Developer at the time of the building permit. The amount will be
calculated as follows: 1.69 acres at $5,780.00 per acre. This calculation was determined by the Trunk
Storm Water Fee Study adopted by City Council Resolution #OS-18 on January 18, 2005.
18. TRUNK WATER A�CREAGE �A,R�F. A trunk water acreage charge of $9,295.00 shall
be paid by the Developer at the time of the building permit. The amount will be calculated as follows:
1.69 acres at $5,500.00 per acre. This charge was determined by the Trunk Water System Fee Study
adopted by the City Council Resolurion #OS-07 on January 3, 2005.

Sewer Fee Study adopted by City Council Resolution on #OS-18 on January 18, 2005.
20. .SANITARY.4F_WF.R AND WAT�R CONNECTION CHARGE. The Developer sha11 pay
a sanitary sewer and water connection charge of $50,000 for connection to the sanitary sewer and water
systems. The amount was calculated as part of the City feasibility study approved May 7, 2007 as the cost
per unit to provide sewer and water to the Industrial Park. This amount shall be adjusted by the 4% City
Administration and 5% Construction Observation Cost ($16,180.00).
21. PARK AND TRAIL DEDICATION. A Park and Trail Dedication Fee of $10,816.00 shall
be paid by the Developer at the time of the building pernut. The amount will be calculated as follows:
1.69 acres at $6,404.00 per acre. This calculation was determined by the Park Fee Study adopted by City
Council Resolution #OS-18 on January 18, 2005.
22. LANDSCAPING. Landscaping for this Site Plan sha11 comply with Plan C. The cost of
the landscaping requirements shall be provided by the Developer, subject to approval by the City. Subject
to approved Plan C, the Developer shall provide a financial guarantee based on an amount equal to 125%
of the estimated cost, as set out in Plan C, to furnish and plant the required landscaping and irrigation
system. The City shall maintain the Security for at least one (1) year after the date the last replacement tree
has been planted. At the end of such year, or such longer period as the City determines to be reasonable,
the portion of the Security equal to 125% of the estimated cost of the replacement trees, which are alive and
healthy may be released. Any portion of the Security not entitled to be released shall be maintained and
sha11 secure the Developer's obligation to remove and replant replacement trees, which are not alive or aze
unhealthy, and to plant missing trees. Upon completion of the replanting or planting of these trees, the
Security shall be maintained for at least one (1) year after the date of the replanting or planting of these

The ARS Aluminum Railing System utilizes aluminum extrusions and glass infill
to construct building guards and rails for decks, balconies, stairs, fences and
similar locations. The systern is intended for interior and exterior weather
exposed applications and is suitable for use in all natural environxnents. The
ARS may be used for residential, commercial and industrial applications. T'he
ARS is an engineered system designed for the following criteria:

The ARS Glass Infill system will meet or exceed all requirements of the 1997
Uniform Building Code, 2000, 2003 and 2006 International Building Codes,
Florida Building Code (non-hurricane zones), 2007 California Building Code and
2000 and 2005 Aluminum Design Manual. Stainless steel components are
designed in accordance with SEI J ASCE 8-02 Specification for the Design of Cold- -
� Formed Stainless Steel Stxuctural Members. Wood components and anchorage to
wood are designed in accordance with the National Design Specification for
Wood Construction.

SCOPE: This review is limited to the design this particular project only insofar as the provisions of the
Minnesota Plumbing Code, as amended, apply, and does not cover the water supply or sewerage system to which
this plumbing system is connected. The review is based upon the supposition that the data on which the design is
based are correct, and that necessary legal authority has been obtained to construct the project. The
responsibility for the design of structural features and the efficiency of equipment must be taken by the project
designer. Approval is contingent upon satisfactory disposition of any requirements included in this report.
Special care should be taken to insure that the material and installation of the plumbing system are in accordance
with the provisions of the Minnesota Plumbing Code. A copy of the approved plans and specifications should
be retained at the project location for future reference.
A set of the identified plans and specifications is being returned to Dakota Mechanical. Enclosed is a copy of the
report and transmittal letter to be forwarded to the project owner.
INSPECTIONS: All plumbing insta.11ations must be tested and inspected in accordance with the requirements of
the Minnesota Plumbing Code. As specified in Minnesota Rules, part 4715.2830, no plumbing work may be
covered prior to completing the required tests and inspections. Provisions must be made for applying an air test
at the time of the roughing-in inspection as outlined in Minnesota Rules, part 4715.2820, subpart 2, of the code.
A manometer test, as specified in Minnesota Rules, part 4715.2820, subpart 3, is required at the time of the
finished plumbing inspection. It is the responsibility of the contractor/installer to notify the Minnesota
Department of Labor and Industry when an installation for a state contract job, licensed facility, or project in an
area where there is no local administrative authority is ready for an inspection and test. To schedule inspections,
contact the state plumbing standards representative for your region, or call Jim Peterson at 651/284-5889.
REQUIItEMENT(S):
1. The installation of reduced pressure zone backflow preventers is permitted only when periodic testing is
done by a trained backflow preventer tester acceptable to the administrative authority. Testing intervals
shall not exceed one year, and records must be kept. All devices must be tested after initial installation to
assure that debris from the piping installation has not interfered with the functioning of the device. The
devices shall be overhauled at least once every five years. The installation of new backflow preventers must
be at least 12 inches, but not more than 6 feet above the finished floor or ground level.
2. The flammable waste interceptor outlet is more than 25 feet from a vented drain. Therefore, the discharge
line must be provided with a 2-inch minimum vent pipe installed within 25 feet of the interceptor (see
Minnesota Rules, part 4715.1120). This vent must not connect with the vent serving the flammable �vaste
interceptor.

3. The flammable waste interceptor shall be constructed in accordance with the Minnesota Plumbing Code,
Minnesota Rules, part 4715.1120. The interceptor shall include:
a. A minimum holding capacity of 35 cubic feet.
b. At least 3 feet of depth below the invert of the discharge pipe.
c. A water seal of not less than 3 inches on the inlet and not less than 18 inches on the outlet.
d. Drains that discharge into the interceptor shall be designed to drain dry, and be at least 3 inches in size.
e. The interceptor sha.11 be located so it is readily accessible for service and maintenance.
4. Showers or combination showers-baths sha.11 be equipped with antiscald-type control valves. These valves
must be of the thermostatic or pressure balance type in accordance with ANSI/ASSE Standard 1016-96 (see
Minnesota. Rules, part 4715.1380, subpart 5). The installer must verify that the maximum temperature
setting from the factory is set or adjusted in accordance with the standard. It is recommended that the
maximum setting of the discharge temperature does not exceed 110 degrees F.
5. Vent connections serving floor drains, floor sinks, and trench drains must be taken off above the centerline
of the pipe and must rise vertically, or within 45 degrees of the vertical, to a point at least 6 inches above the
floor before offsetting horizontally (see Minnesota Rules, part 4715.2540, subpart 2).
6. The size of the water supply branch to the urinal was not noted on the submitted diagrams. Urinals equipped
with flush valves must be provided with a 3/4-inch minimum water supply branch (see Minnesota Rules,
part 4715.1730, subpart 2).
7. A cleanout shall be provided near the juncture of the back-to back lavatories (P-2).
8. Ductile iron pipe (DIl') used for water service must comply with ANSUAWWA Standard C115fA21.15 or
C151/A21.51 (see Minnesota Rules, part 4715.0510).
9. All joints and connections in the storm sewer system shall be gastight or watertight (see Minnesota Rules,
part 4715.0700). Approved resilient rubber joints must be used to ma.ke watertight connections to
manholes, catchbasins, and other structures.
10. The PVC plastic pipe material to be used for the building sewer must meet one of the following
ASTM Standards: D3034, F789, D2665, or F891. The installation must comply with ASTM
Standard D2321 (see Minnesota Rules, part 4715.0530).
11. Reinforced concrete pipes used for the exterior storm sewer system must meet ASTM Standard C76 (see
Minnesota Rules, part 4715.0540).
12. Above-grade horizontal plumbing piping must be supported as follows (see Minnesota Rules, part
4715.1430, subpart 4):
a. Plastic pipe: at least every 32 inches.
b. Cast iron: at least every 5 feet; or 10 feet when ten foot lengths of pipe are used.
c. Copper tubing (1'/.,-inch or less): at least every 6 feet.
d. Copper tubing (1'/z-inch or over): at least every 10 feet.

13. All portions of the storm sewer system located within 10 feet of the building or water service line must be
tested in accordance with Minnesota Rules, part 4715.2820.
NOTE(S):
1. The scope of this project consists of the construction of a new building. The plumbing installation includes
water closets, lavatories, a urinal, shower, mop sink, drinking fountains, laundry tubs, sinks, water heaters,
floor drains, area dra.ins, a flammable waste interceptor, and an exterior hose bib.
2. This facility will be served by new municipal water and sewer service connections.
3. The plans and specifications were prepared by a licensed plumber. Only the plumber who has prepared the
plans may use the plans for consttuction. If another plumber is contracted to install the plumbing, they must
submit their own plans and specifications for the project.
Authoriza.tion for construction in accordance with the approved plans may be withdrawn if construction is not
undertaken within a period of two years. The fact that the plans have been approved does not necessarily mean
that recommendations or requirements for change will not be made at some later time when changed conditions,
additional information, or advanced knowledge make improvements necessary.

SCOPE: This review is limited to the design of this particular project only insofar as the provisions of the
Minnesota Plumbing Code, as amended, apply, and does not cover the water supply or sewerage system to which
this plumbing system is connected. The review is based upon the supposition that the data on which the design is
based are correct, and that necessary legal authority has been obtained to construct the project. The
responsibility for the design of structural features and the eff'iciency of equipment must be taken by the project
designer. Approval is contingent upon satisfactory disposition of any requirements included in this report.
Special care should be taken to insure that the material and installation of the plumbing system are in accordance
with the provisions of the Minnesota Plumbing Code. A copy of the approved plans and specifications should
be retained at the project location for future reference.
A set of the identified plans and specifications is being returned to Dakota Mechanical. Enclosed is a copy of the
report and transmittal letter to be forwarded to the project owner.
INSPECTIONS: All plumbing installations must be tested and inspected in accordance with the requirements of
the Minnesota Plumbing Code. As specified in Minnesota Rules, part 4? 15.2830, no plumbing work may be
covered prior to completing the required tests and inspections. Provisions must be made for applying an air test
at the time of the roughing-in inspection as outlined in Minnesota Rules, part 4715.2820, subpart 2, of the code.
A manometer test, as specified in Minnesota Rules, part 47152820, subpart 3, is required at the time of the
finished plumbing inspection. It is the responsibility of the contractor/installer to notify the Minnesota
Department of Labor and Industry when an installation for a state contract job, licensed facility, or project in an
area where there is no local administrative authority is ready for an inspection and test. To schedule inspections, ,

REQUIREMENT(S):
1. The installation of reduced pressure zone backflow preventers is permitted only when periodic testing is
- done by a trained backflow preventer tester acceptable to the administrative authority. Testing intervals '
shall not exceed one year, and records must be kept. All devices must be tested after initial installation to
assure that debris from the piping installation has not interfered with the functioning of the device. The
devices shall be overhauled at least once every five years. The installation of new backflow preventers must
be at least 12 inches, but not more than 6 feet above the finished floor or gound level.
2. The flammable waste interceptor outlet is more than 25 feet from a vented drain. Therefore, the discharge
line must be provided with a 2-inch minimum vent pipe installed within 25 feet of the interceptor (see
Minnesota Rules, part 4715.1120). This vent must not connect with the vent serving the flammable waste
interceptor. � '

3. The flammable waste interceptor shall be constructed in accordance with the Minnesota Plumbing Code,
Minnesota Rules, part 4715.1120. The interceptor shall include:
a. A minimum holding capacity of 35 cubic feet.
b. At least 3 feet of depth below the invert of the discharge pipe. .
c. A water seal of not less than 3 inches on the inlet and not less than 18 inches on the outlet.
d. Drains that discharge into the interceptor shall be designed to drain dry, and be at least 3 inches in size.
e. The interceptor shall be located so it is readily accessible for service and maintenance.
4. Showers or combination showers-baths shall be equipped with antiscald-type control valves. These valves
must be of the thermostatic or pressure balance type in accordance with ANSUASSE Standard 1016-96 (see
Minnesota Rules, part 4715.1380, subpart 5). The installer must verify that the maximum temperature
setting from the factory is set or adjusted in accordance with the standard. It is recommended that the
maximum setting of the discharge temperature does not exceed 110 degrees F.
5. Vent connections serving floor drains, floor sinks, and trench drains must be taken off above the centerline
of the pipe and must rise vertically, or within 45 degrees af the vertical, to a point at Ieast 6 inches above the
floor before offsetting horizontally (see Minnesota Rules, part 4715.2540, subpart 2).
6. The size of the water supply branch to the urinal was not noted on the submitted diagrams. Urinals equipped
with flush valves must be provided with a 3/4-inch minimum water supply branch (see Minnesota Rules,
part 4715.1730, subpart 2).
7. A cleanout shall be provided near the juncture of the back-to-back lavatories (P-2).
8. Ductile iron pipe (DIl') used for water service must comply with ANSI/AWWA Standard C115fA21.15 or
C151/A21.51 (see Minnesota Rules, part 4715.0510).
9. All joints and connections in the storm sewer system shall be gastight or watertight (see Minnesota Rutes,
part 4715.0700). Approved resilient rubber joints must be used to make watertight connections to
manholes, catchbasins, and other structures.
10. The PVC plastic pipe material to be used for the building sewer must meet one of the following
ASTM Standards: D3034, F789, D2665, or F891. The insta.11ation must comply with ASTM
Standard D2321 (see Minnesota Rules, part 4715.0530).
11. Reinforced concrete pipes used for the exterior storm sewer system must meet AS'TM Standard C76 (see
Minnesota Rules, part 4715.0540).
12. Above-grade horizontal plumbing piping must be supported as follows (see Minnesota Rules, part
4715.1430, subpart 4):
a. Plastic pipe: at least every 32 inches.
b. Cast iron: at least every 5 feet; or 10 feet when ten foot lengths of pipe are used.
c. Copper tubing (1'/4-inch or less): at least every 6 feet.
d. Copper tubing (1'/z-inch or over): at least every 10 feet.

13. All portions of the storm sewer system located within 10 feet of the building or water service line must be
tested in accordance with Minnesota Rules, part 4715.2820.
NOTE(S):
1. The scope of this project consists of the construction of a new building. The plumbing installation includes
water closets, lavatories, a urinal, shower, mop sink, drinking fountains, laundry tubs, sinks, water heaters,
floor drains, area drains, a flammable waste interceptor, and an exterior hose bib.
2. This facility will be served by new municipal water and sewer service connections.
3. The plans and specifications were prepared by a licensed plumber. Only the plumber who has prepared the
plans may use the plans for construction. If another plumber is contracted to install the plumbing, they must
submit their own plans and specifications for the project.
Authorizarion for construction in accordance with the approved plans rnay be withdrawn if construction is not
undertaken within a period of two years. The fact that the plans have been approved does not necessarily mean
that recommendations or requirements for change will not be made at some later time when changed conditions,

Dear Mr. Arvidson:
We have completed the preliminaty geotechnical evaluation for the proposed Performance Construction
Commercial Building in Prior Lake, Minnesota. The purpose of the preliminary geotechnical evaluation
was to explore (with test pits) the soil and groundwater conditions with regard to site grading of the
proposed building and parking areas. This report is only preliminary in nature and an additional
investigation may be necessary if a more detailed analysis of the soil and groundwater conditions is _
needed.
Available Information
Stonebrooke Engineering, Inc. (Stonebrooke) provided us with an el�tronic copy of the proposed site
plan dated December 18, 2006. The plan included the building footprint and parking lot fooi�rint, along
with some of the existing conditions. Existing or proposed elevations were not provided.
Results
Six shallow test pits were observed in the summer of 2006 and hand auger probes were performed at the
same test pit locations at the project site on March 14, 2007. The hand aager probes were denoted as
HAP-1 to HAP-6 and were performed within or around the proposed building pad. The approximate test
pits locations are shown on the attached Soil Boring and Test Pit Location Sketch. The test pitlhand
auger locations were roughly determined in the field by referencing site features. The approximate
locations are shown on the attached sketch and should be considered approximate, as no staking was
availabte at the time of the investigation.
All of the hand auger probes encountered 1 1/2 to 2 feet of black, lean clay topsoil at the surface. In the
southecn portion of the buitding site, an additional 3 to 3 1/2 feet of soft lean clay was encountered
beneath the topsoil. Beneath the topsoi} aud lean clay, a medium to rather stiff sandy lean clay was
encountered to the termination depth of the probes. A more detailed description of the soil conditions
encountered at the test locations is presented in Table 1.
Note the foltowing explanations of abbreviations: CL-S = Sandy Lean C(ay, CL = Lean Clay. The
topsoil layer was typically dark brown silty sand with some organics in a wet condition.

The right hand column presents the estimated minimum depth of soil removal needed at that test location
prior to fi{1 placement or building construction. However, the actual depth of subcut needed will vary
and should be determined in the field by a qualified engineering assistant, based on actua! soil conditions
and the bui(ding loads, elevations and locations.

Groundwater was not encountered in any of the hand auger probes. Clays soils generally have low
permeability cates and the groundwater observations were made in a short period of time. As a result,
accurate groundwater readings could not be made. A natural drainage swale containing water was
observed running through the south end of the site, and two wetlands, on the north and south end of the
site, suggest a shallow water table is present in the area. Annual and seasonal fluctuations of
groundwater levels should be expected.

Preliminary Recommendations
The following subsections provide general recommendatiorts for site construction. This information is
based on the preliminary information provided to us. If the design parameters change significant(y from
those we have assumed, additional analysis may be necessary.
Standard penetration test borings were not taken to evaluate the soils at depth. Based on the exposed
soils, the area geology, and our hand auger probe results, it is our opinion the risk of detrimental
settlement is re(atively small. f-iowever, we cannot be responsibte for soil conditions below the depth of
the test pit and hand auger probes, which were 5 to 6 feet below existing grades. [f you are willing to
assume the risk of potential unsuitable soils at depth, deeper soil borings may not be warranted. If you
are unwilling to assume this risk, we recommend soil borings be conducted.
Construction
We understand the proposed construction will likely inc(ude a one to two-story slab-on-grade structure.
We anticipate the building will have masonry oc concrete walls. Driveway and parking areas are
proposed all sides of the building, and a storm pond is proposed on the north end of the site.
Discussion
It is our opinion the proposed building can be supported on spread footing foundations bearing in medium to
rather stiff, naturally deposited clay soils, or properly compacted structurat fiil. At the test hole {ocations,
the medium to stiff clay soils were typically found at depths of 1 1/2 to 5 feet below existing ground levels.
The condition of the soils in the bottom of the excavations should be evaluated by a geotechnica! engineer
or engineering assistant.
Based on the design of the site (ayout, it appears that the building will be situated over the existing
drainage swale and a portion of the south wetland (Wetland `A'). The hand auger probes conducted along
the south end of the building encountered soft clay soils to a depth of 5 feet. The depth of soft unsuitable
soils may worsen as you approach the wettand area, specifically in the area of the south driveway.
Building Pad Preparation
Excavation
The proposed buiiding pad and pavement areas should be stripped and cleared of all vegetation, topsoil,
and any o(d fi((. In addition, any layers of saft, wet, unstable clay soils should also be subcut. The
foundation can then be supported directly on the natural medium to stiff clayey soils or properly
compacted structural fill. Please refer to Table I above for the anticipated excavation depths at the hand
auger locations. Excavation depths between borings will vary and could be deeper. The excavation
depths wil{ likety deepen as you approach the wettand areas.
If the excavations to remove unsuitable soils within the building pad areas extends below design footing
etevation, we recommend the excavation bottoms be extended laterally beyond the edges of the proposed
footings a minimum of 1 foot for each vertical foot below the footing at that location (i.e., 1: l lateral
oversizing). This oversizing is necessary for the lateral distribution of the footing toads through the
fill sequence.

Fill
Filt and backfill required to bring the site to grade should be placed in thin lifts not exceeding 6 to �
12 inches and be compacted to a minimum of 95 percent of the maximum dry density based on the
standard Proctor test (ASTM D 698). [f fill depths exceed l0 feet, the minimum compaction should be
increased to 98 percent. If fil I depths exceed 10 feet, a construction delay may atso be needed to allow
the fill to consolidate. This shoutd be evaivated on a case-by-case basis.
The on-site topsoil and excessively wet ctay is not suitable for fiil or backfill within the bui(ding
footprint, oversize area, or parking tot and driveway areas. The naturally deposited on-site medium to
stiff c(ay soils below the topsoit and soft, wet clays are generally acceptable for use as ftll.
The clayey fill should be placed at a moisture content no more than 3 percentage points above and one
percentage point below the soil's optimum moisture content. If the clay fill soils are significantly above
their optimum moisture content, as they appear to be on this site, they may need to be dried prior to use.
Conversely, if dry clayey soi(s are encountered, they may not be useable as engineered fill.
If groundwater is present in the bottom of the excavations, we recommend granular fi(t be placed and
compacted to a height of 2 to 3 feet above controlled water leve(s. The fill should consist of a ctean
sand with less than 50 percent passing the number 40 sieve and less than 10 percent passing the number
200 sieve. After the sand fill has been placed, a less select mineral soil may be used to establish -
subgrade e(evations.
PreliminaryFoundation Design
Bearing Capacity
Based on the soi! boring results and performance of the above-described soil correction procedures, it is
our opinion the natural soils or engineered filt shoutd be suitable for support the proposed building asing
spread footing foundations sized for an allowable soil bearing pressure of up to 2,000 pouads per square
foot. If a higher bearing capacity is needed for the soils, we recommend performing soil borings to
obtain more complete data. on tt�e soils at depth and the relative consistency of the soils. We also
recommend the actual structural loads of the building be provided to us when available so we may review
the recommendations to determine if they still appty.
Footing Depths
Perimeter footings in heated building areas should be founded a minimum of 42 inches below the nearest
exterior grade for frost protection. Footings in unheated building or garage areas should be founded a
minimum of 60 inches below the nearest exterior grade for frost protection. (Attached garage areas are
generally considered heated structures.)
Settlement
[t is our opinion that total and differential settlements based on these loadings should not exceed 1 inch
and I/2 inch, respectively. [n deep fill areas, settlements over 1 inch can occur. These areas may require
a construction delay. If sandy soils are used as fi11, the time to a{low the fil{ to consoSidate can be greatly
reduced.

Floor Slabs
Generally, minimum floor slab etevations are dependant on the normal and high water levels of any
surrounding water features. We recommend the floor slab designed at an elevation a minimum of 4 feet
above the normal water level of the wetland and proposed pond and 2 feet above the high water level.
Subgrade
After the building pad preparation has been completed, we anticipate the floor subgrade wili be natural
clayey soils or compacted fill. Backfill in footing and mechanical trenches should be compacted to a
minimum of 95 percent of the standard Proctor ma�cimum dry density. -
Vapor Barrier
Excess transmission of water vapor could cause floor dampness, certain types of floor bonding agents to
separate, or mold to form under floor coverings. We recommend placing a vapor retarder or barrier below
the floor if coverings or coatings less permeable than concrete will be used, or if moisture is a concern.
Current industry recommenda.tions are to place the vapor retarder or barrier directly below the concrete.
It is then desira.ble to take precautions against shrinkage a.nd curling of the floor slab. Industry practice
has been to allow burying the vapor retarder or barrier below a layer of sand to reduce curling and
shrinkage of the concrete, but this practice often traps water between the slabs and the vapor retarder or
barrier, causing problems after a period of months. In any case, we recommend consulting with floor
covering manufaclurers regarding the appropriate type, use and installation of a vapor retarder or barrier
to preserve warranty assurances.
To reduce shrinkage and curling processes associated with placing concrete directly on the vapor retarder
or barrier, we recommend:
• usin� the largest possible maximum aggregate size and/or coarse aggregate.
• using the lowest practical slump.
• using the lowes� necessary cement content to reduce top-to-bottom moisture differentials.
. carefully curing the concrete.
• optimizing the spacing of control joints.
• cutting control joints as soon as practical.
We recommend that the vapor barrier be inspected immediately before the concrete is placed to identify
and patch l�oles or other potential paths for moisture vapor migration.
Drainage Considerations and Below Grade Walls
Seepage Control
If a basement is to be constructed, it will be surrounded by mostly clayey soils. If water percolates down
alongside the walls, it may become perched and then enter the basement through shrinkage cracks in the
concrete or masonry block. Collecting runoff and discharging it welt away from the foundations and
stoping the ground surface down and away from the basement walls are two common methods of
re�ucing infiltration and percolation.

As a precaution against basement seepage, we recommend installing a perimeter foundation drain system.
One possible system could include a perforated pipe with an invert within 2 inches of bottom-of-footing
e'�;vation. Collected seepage should be routed to a sump and then drained by a pump or gravity to a storm
sewer or low azea on the site.
The seepage control system should include permeable material against the basement wall, such as a
synthetic wall drainage system or at least 2 feet (horizontat) of permeable sandy gravel or sand backfil[.
The sandy gravel or sand backfiil should have less than 50 percent passing the number 40 sieve and less
than 5 percent passing the number 204 sieve. Where the sandy gravel or sand backfill extends outside the
footprint of the building, it should be capped by a slab, pavement or at least 1 foot of clay or clayey topsoil.
We also recommend that a drainage collection system be instailed below the lowest floor grade. The
system could include drainage pipe and coarse gra.vel or clean sand. Any collected water could then be
routed to a sump where it can be removed from the structure.
Lateral Earth Pressure
Backfili against the basement walls should be compacted to a minimum of 90 percent of the standard
Proctor maximum dry density. Beneath steps, slabs and pavements, it should be compacted to a minimum
of 95 percent. The basement walls should be waterproofed and braced prior to backfilling.
If imported sandy gravel or sand is used as backfill against the wall, a lateral earth pressure of 45 psf per
foot of depth should be used to design the basement wall. To use this design, the sand backfill must
extend upward and outward from the bottom of the footing at a 30-degree angle from vertical. For an
8-foot wall, the horizontal thickness of sand fill must be a minimum of 4 feet. If on-site clayey soil is
used as backfill against a synthetic wall drainage system or granular chimney drainage layer, we
recommend using a Lateral earth pressure of 65 psf per foot of depth for designing the wall.
Pavement Areas
Subgrade Preparation
We recommend the vegetation, topsoil and very soft to soft soils be excavated from the pavement areas
such as driveways or parking lots. In areas requiring engineered itll to establish pavement grades, the
excavation should be oversized at least t foot beyond the outside edge of the toe of the roadway
embankment for each foot of fill placed below the bottom of the toe of the roadway embankment.
The engineered fill piaced in paved areas should be compacted to at least 95 percent of the standard
Proctor density to within 3 feet of subgrade and 100 percent within the upper 3 feet. We recommend the
moisture contents of the engineered fill soils be within 3 percentage points of the optimum moisture
content to within 3 feet of subgrade and no greater than 1 percentage point over the soits' optimum
moisture content in the upper 3 feet.
Proofroli
Prior to placement of the pavement section, we recommend the pavement subgrade be proofrolled with a
loaded tandem truck to detect unstable areas. Any unstable areas should be subcut and replaced with a
drier, compactible soil or dried and recompacted.

Proposed Pavement Section
Based on the borings, it appea.rs the subgrade soils will consist mainly of clayey soils. These soits
generally have Hveem stabi(ometer R-values ranging from 6 to 20. For pavement design, we recommend
an assumed R-value of 10 6e used. .
Utilities
The soils at depth appear genera,lly suitable for pipe support. In most areas of the site, groundwaCer
appears to be relatively shallow and may adversely affect utility line excavation and installation. Due to
the impermeable nature of the soils and since groundwater levels fluctuate with seasonal precipitation -
rates, on-site observations should be made during construction. If groundwater is encountered, provisions
should be made to remove the water with sump pumps.
Clayey soils are usually moderately corrosive to metal pipe. We recommend using non-corrosive pipe or
a corrosion protection system for the underground utilities.
The engineered fill placed as utility trench backfill should be compacted to at least 95 percent of the
standaxd Proctor density to within 3 feet of subgrade and 100 percent within the upper 3 feet. We
recommend the moisture contents of the engineered fill soils be within 3 percentage points of the
optimum moisture content to within 3 feet of subgrade and no greater than 1 percentage point over the -
soils' optimum moisture content in the upper 3 feet.
It appears that a temporary underground sanitary sewer holding tank is proposed neax the southwest
corner of the building in the parking lot area. Depending in the static groundwater levels in the area,
some buoyancy forces may be present when the tank is not full. Considerations should be made to
counteract these buoyancy forces if they are present.
Additional Investigation aad Testing During Construction
Soil borings were not performed on this site. Soil borings may be prudent in some areas to deternune the
extent of the soft soils encountered, and the relative consistency of the native soils. This will be
especially valuable in the south and southwest areas of the site. We make no comment on the condition
of the soils beneath the depth of our hand auger probes.
We reeommend a geotechnical engineer or representative be on site during the excavation of the building
pad. At that time, the suitability of the subsurface soils for support of fill and foundation loads can be
further evaluated. Excavation depths and pravided oversizing can also be documented.
Compaction tests shoutd be taken during the building pad preparation, utility trench installation and
foundation wall backfill operations. In general, compaction tests shoutd be taken after about 2 feet of fill
has been placed in the excavations and then at about 2-foot vertical intervals thereafter.
In roadway subcut areas, we recommend a proofroll be performed before ptacement of the aggregate
base. The proofroll should be performed by observing the behavior of the subgrade soils when subjected
to the whee( loads of a fulty loaded, tandem-aacle end dump. The proofroll should be observed by a
geotechnical engineer.

We have met with Mr. Johnson and Mr. Knaeble the remaining property owners for easement acquisition. Mr. Johnson took the
easements home for signature by his wife and himself today. We are hopeful we will have them back eazly next week. Mr. Knaeble
does not want to include the storm water pond for the future street in this agreement. He is agreeable to just granting the required
sewer and water easement at this time. He will review this with his partner and get back to us next week. Based on that timeline it will
be very tight to have the easements on the Council Agenda for the 20th.
To begin construction in addition to the easements and building permit you need to have a Development Contract and the engineering
plans approved. Preparation of the contract will require a cost estimate for the proposed public sewer and water improvements.
Additionally your final plans will need to be approved. My understanding is that Stonebrooke Engineering is working on these plans.
Even if we had the easements I do not believe we would have all the Development Contract items or the plans approved by next Wed
as is needed to obtain the building permit. I recommend you contact Jane next week to work with her on the Development Contract so
you can stazt providing cost estimate info and the appropriate documents for approva( on September 4th. I will continue to update you
on the easements.

I spoke to Steve Albrecht with the City of Prior Lake this a.m. He indicated that 2 of the 4 property owners that are required to sign
utility easements have done so or have agreed to sign. The City is meeting with the other 2 this week to hopefully obtain the required
signatures.
Steve is hopeful that atl easement documents and the Development Contract will be signed / executed in time to obtain City Council
approval at the August 20 meeting. Based on this information, the best case for obtaining any grading permit or building permit would
be after the August 20 meeting; this will be confirmed with the building dept. The next City Council meeting after August 20 is Sept.

Based on conversations at our July 26 meeting, I am assuming that you would like us to hold on releasing any materials for production,
which includes precast wall panels, precast floor plank, baz joists & deck and footing & CMU rebar unti( all documents are signed and
final approvals are obtained with the City. Please keep me posted as information is available, as the material I have noted is critical
path and will directly affect the construction schedule. As I noted in the previous e-mail, we may potentially be pushed to the next

Following are the results of the preliminary Site plan review for the LeMair Building. Our
review was based on the 2003 Minnesota State Building Code (MSBC) which adopted
with amendments the 2000 International Building Code (IBC) with handicap regulations
of the Minnesota Accessibility Code Chapter 1341. Also requirements of the 2003
Minnesota State Fire Code (MSFC) which adopted with amendments the 2000
International Fire Code (IFC).
1. Complete a Building Code analysis. ISC Chapter 5. Include the following:
a. Occupancy Classification.
b. Type of Construction.
c. Location on Property.
d. Allowable Floor Area.
e. Height and Number of stories.
f. Separated or non separated uses.
g. Exiting.
2. Provide fire lanes for fire apparatus response. Signage to read:" No Parking Fire Lane
by order of Fire Department". Indicate on Site plan. Locate by Fire Hydrants and
Siamese Fire Department connection. IFC 1001.7.1.
3. If provided, indicate means of lawn irrigation. May use separate service and metering
for billing purposes.
4. Accessible parking stalls are required to be 20 feet deep. MSBC 1341.0428 Subpart 6.

other than means of egress. IBC 1005.3.2. Lavatories, janitor's rooms and access to
tenant B are not allowed in this stairway.

22. Tenant finish permits are required.
23. At tenant pernut application, list types, and quantities, location of storage and

RE: Site plan review for LeMair Building �
Following are the results of the Site plan review for the I.eMair Building. Our review was
based on the 2003 Minnesota State Building Code (MSBC) which adopted with
amendments the 2000 International Building Code (IBC) with handicap regulations of the
Minnesota Accessibility Code Chapter 1341. Also requirements of the 2003 Minnesota
State Fire Code (MSFC) which adopted with amendments the 2000 International Fire
Code (IFC). The items are numbered the same as the August 3, 2007 Site plan review
Memorandum and additional comments are in italics. Items completed have been
eliminated.
�. Accessible parking stalls are required to be 20 feet deep. MSBC 1341.0428 Subpart 6.
Provide dimension. Architect and I discussed at the DRC meeting on August 30, 2007.
V5. Deternune depth of automobiles parked in western diagonal parking stalls, it appears as
though the drive lane may be diminished because the autos will protrude into the �6'
21 '-10" drive lane. Architect and 1 discussed at the DRC meeting on August 30, 2007.
The following are building plan comments:
17. Submit the Structural Engineers requirements for Special Inspections IBC 1701.5.
21. Provide a detailed description of the type of work and processes the tenant occupants.
This review is based on civil, building plans and a letter from the architect dated August
22, 2007 that was submitted on August 30, 2007. The site plans must be reviewed by the
Cities Developmental Review Committee (DRC) which consists of representatives of
Planning, Engineering, Parks, Finance, and Building Departments. The DRC must
approve the site plans before a building permit can be issued. All of the above items must
be addressed before the building permit is issued.

Subject: CJF Holdings Reimbursement
In accordance with the Development Contract signed May 19�', 2008 and the Amendment to the
Development Contract signed October 19�', 2009 with CJF Holdings, the City is required to
reimburse the Developer for constructed improvements in the Welcome Avenue and Industrial
Circle area.
Below is an excerpt from the Amendment to the Development Contract paragraph 28 B.
"B. The City shall reimburse the Developer an amount of $159,925.00 as connection fees are
collected from other Industrial Park properties for the extension of sewer and water from
Industrial Circle to Welcome Avenue. This amount was calculated as the construction cost
(172,172.00) of the utilities plus 12% ($21,573.00) of the original bid ($179,780.00) for
engineering and construction staking, less the sewer and water connection charge reimbursement
($33,820.00) to CJF Holdings on May 19�', 2008. The total construction cost for the extension
of sewer and water from Industrial Circle to Welcome Avenue is $193,745.00. This construction
cost does not include the Developer's site utility costs."
The City recently collected connection fees from Integra Telecom in the amount of $45,000.00
for their property at 5786 Credit River Road SE in accordance with the easement agreement
dated August 17�', 2007.
The connection fees collected in the amount of $45,000.00 as a part of that connection
permit should be distributed to CJF Holdings in accordance with the Development
Contract and Amendment.
As other properties connect to the system in that area they should also pay this connection fee of
$45,000. That fee should be distributed to CJF Holdings in accordance with the Development
Contract up to the amount specified in the Development Contract Amendment. The remaining
balance owed to CJF Holdings amounts to $114,925.00 ($159,9251ess $45,000).
