We are an owner-operated business that was established in March of 1999 and we provide lawn service to residential and commercial properties. We currently have five employees, including owners. As to the products we plan to store in the warehouse, they are granular fertilizer in SO lb. bags and liquid weed control in 2-1/2 gallon containers. The fertilizer is delivered to us on one-ton pallets. These pallets are stacked two high (5-6 feet total height) and we receive no more than eight tons per delivery. The weed control is delivered in cases of two and we receive 2-3 cases per week generally. We carry no inventory of these products over the winter. Greg Simon has provided the MSDS sheets to you and they are also on record with the Prior Lake licensing department. We will be filling our vehicles inside of the warehouse per the Minnesota Department of Agriculture's regulations. Vehicles will be parked outside of the warehouse during the working season (typically March through November) and may be stored inside of the warehouse during the other months. Cutting Edge Moldings is the primary tenant and is projected to occupy 10,400 sq. ft. They fabricate wood moldings for the residential construction industry. In their operation, they will generate sawdust and will use local exhaust ducts to collect the combustible dust and safely remove it to a dust collection chamber. The International Fire Code (IFC) provides guidance describing special handling of the combustible dust- producing operations in Chapter 13. If the sawdust that is produced measures 420 microns or less in diameter, it will qualify as a combustible dust. Beyond the IFC, other codes that apply are NFPA 664 and the ICC Electrical Code. The IFC stipulates that a special permit is required for an operation that produces a combustible dust. Regarding "sources of ignition" the IFC states that an open flame or use of spark-producing equipment, are prohibited in areas where combustible dust is generated, stored, manufactured, processed or handled. Conclusion: It is therefore necessary to use "explosion proo�' electrical components that are exposed to the combustible sawdust. That would include special fan housings, explosion proof fan motors, etc. 2. New Frontier Lawn Service is the second tenant, and will use 3,200 sq. ft. on the east side of the building. This lawn service uses liquid herbicides, as well as a solid type of fertilizer in the activities of their business. The International Building Code (IBC) and International Fire Code (IFC) prescribe an upper limit in the amount of hazardous chemicals permitted in a building. If the amount� of chemicals exceeds the "exempt amount" then the building, or portion thereof, becomes an "H" occupancy, as per Table 2703.1.1(1) (IFC). Liquid herbicide: The MSDS of the herbicide specified for use is a"light flammable level 1" hazard and a"moderate toxic level2" hazard as per the NFPA Classification. Regarding the flammability, the Code officially defines this material as a Class II Combustible material and will exempt up to 240 gallons of this material when in storage. When the material is being dispensed, mixed, and pumped into the trucks, this is normally referred to as an "open use" activity. Far open use, the exempt amount is limited to 30 gallons. Regarding the toxicity of the liquid herbicide, when held in storage, the exempt amount is 2,000 lbs (212.77 gallons), as long as the building is sprinkled, and the material are stored in approved storage cabinets. When the material is being dispensed, and in open use, the exempt amount is limited to 2501bs (26.59 gallons) in a sprinkled building. Regarding operations of the lawn service, the liquid herbicide will be delivered in 2_ gal containers, with two containers per case, and a maximum of 6 cases at a time. Therefore the maximum quantities on hand will be 30 gallons, and this will largely be held as storage. Regarding dispensing activities, normal operations require that 2 gallons of the herbicide is mixed with 100 gallons of water. After that the diluted material is then pumped into trucks. Conclusion: The quantities of liquid herbicide that are projected for use in storage and for open use activities are well within the exempt amounts stipulated in the IFC. Solid fertilizer: The MSD5 of the fertilizer specified for use is also a"light flammable level 1" hazard and a"moderate toxic level 2" hazard as per the NFPA Classification. Regarding the flammability of the fertilizer, the material may burn at a very high temperature, but will not ignite readily. As a combustible fiber, the Code will exempt up to 1,000 cubic feet, or approximately 64,000 lbs of this material when in storage. There is no "open use" activity of the solid fertilizer in the building. Regarding the toxicity of the solid fertilizer, when held in storage, the exempt amount is limited to 2,000 lbs, as long as the building is sprinkled, and the material are stored in approved _storage cabi�ets. Considering toxicity as the highest hazard, and the most restrictive for this material, a tenant occupying this building will be restricted to storing a maximum of 2,000 lbs of solid fertilizer. Conclusion: As long as the tenant does not exceed the quantities of the specified hazardous materials, the building occupancy would not be considered "hazardous".
