1. Call to Order:
Commissioner Criego called the December 23, 2002, Planning Commission meeting to
order at 6:31 p.m. Those present were Commissioners Criego, Lemke and Ringstad,
Planning Coordinator Jane Kansier, Planner Cynthia Kirchoff and Recording Secretary
Connie Carlson.

The Minutes from the December 9, 2002, Planning Commission meeting were approved
as presented.

5. Public Hearings:
Commissioner Criego read the Public Hearing Statement and opened the meeting.
A. Case #02-135 Landice Wilson is requesting a variance from the front yard
setback for the construction of a detached garage for the property located at 16252
Lakeside Avenue SE.
Planner Cynthia Kirchoff presented the Planning Report dated December 23, 2002, on
file in the office of the City Planner.
Landice Wilson is requesting a variance from the zoning ordinance for the construction
of a 576 square foot detached garage on property zoned R-1 (Low Density Residential)
and SD (Shoreland Overlay District) and located at 16252 Lakeside Avenue (Lot 23,
Lakeside Park).
In order to construct the proposed addition to the dwelling the following variance is
required: A 16.2 foot variance from the 36.2 foot average front yard setback to allow a 20
foot setback.

The subject property is a riparian lot on Prior Lake. A single family dwelling,
constructed in 1957, currently occupies the site. The lot is 9,708 square feet in area and
50 feet in width. A garage is not present on the property.
Staff recommends approval of the 16.2 foot variance from the 36.2 foot average front
yard setback for the construction of a detached garage, subject to the following
conditions:
The resolution must be recorded at Scott County within 60 days of adoption. Proof of
recording, along with the acknowledged City Assent Form, shall be submitted to the
Planning Department prior to the issuance of a building permit.
2. The building permit is subject to all other applicable city, county, and state agency
regulations.
3. The driveway shall be a maximum of 24 feet in width at the property line and meet
the minimum 5 foot side yard setback.
4. The driveway shall be surfaced with bituminous or concrete.
5. The garage shall be compatible in design and materials with the principal structure.
6. Impervious surface coverage shall not exceed 30 percent.
Criego questioned if this was in the bluff area. Kirchoff responded it did not have a 30%
or more slope. This property is conforming.
Comments from the public:
Applicant Lani Wilson, 16252 Lakeside Avenue, stated she would like to build a garage.
She has been looking into this for a long time and this site is the only place it will fit. The
garage will be 24x24 feet. Wilson explained the topography of the lot.
Criego questioned the garage size. Wilson responded she would have some storage.
Comments from the Commissioners:
Lemke:
Lived in the area and knows the property.
Agreed with staff's recommendation - A modest two-car garage is a reasonable
use of the property.
The variance to be 20 feet from the street because of the averaging makes sense as
well.
Supported the variance request.

Ringstad: · Agreed with Lemke - A two-car garage is necessary in Minnesota.
· The nine hardship criteria set by the State of Minnesota is for situations like this.
· Because of the size of the garage and topography this makes sense.
· Supported the request.
Criego:
· Agreed with fellow Commissioners and staff.

Vote taken indicated ayes by all. MOTION CARRIED.
B. Case//02-129 St. Michael's Church is requesting an amendment to the text of
the Zoning Ordinance to allow externally illuminated signs for churches on collector
streets in residential districts.
Planning Coordinator Jane Kansier presented the Planning Report dated December 23,
2002, on file in the office of the City Planning Department.
The purpose of this public heating is to consider an amendment to the Zoning Ordinance.
The applicant, the Church of St. Michael, is requesting an amendment to the Zoning
Ordinance to allow externally illuminated institutional signs along collector streets in
residential zoning districts.
Institutional signs are defined as signs, which identify the name and other characteristics
of a public or semi-public institution on the property where the sign is located. A public
or semi-public use could include schools, public buildings, libraries, religious institutions,
parks, etc.
The staffhas no objections to the proposed amendment. The ordinance already allows
internally Illuminated signs along arterial streets. The additional provisions would help
to identify public and semi-public gathering sites after sunset. In order to minimize any
impact on the adjacent residential areas, the staff would suggest including a provision
limiting the visible illumination, measured in foot-candles, at the property line. This
provision is consistent with the lighting provisions in the ordinance. The specific
language is included in the attached draft ordinance.
Ringstad:
· Questioned the amendment. Kansier said it applies across the board.

Lemke:
· Questioned the foot-candle description. Kansier explained.
is actually pretty dim and the attempt is to reduce the glare.
One half foot-candle
Criego:
· Questioned foot-candles applying to security lights or flood lights. Kansier said it
would not apply to alarm-type security lights but would apply to parking lot
lights. It already applies in the ordinance, this amendment is specific to this
section.
Comments from the public:
Judy Menden, Facilities Manager, representing St. Michael's Church, said they would
like the sign amendment to help identify facilities. St. Michaels owns 3 of the 4 property
comers. The sign at the church is at an angle to the intersection. If they put lights on it, it
would shine directly back towards the church and not shine on any of the residential area.
It is a growing parish and events are held nightly. The lighting would help locate the
parish office, church and school.
The public hearing was closed.
Comments from the Commissioners:
Ringstad: · Agreed with staff's recommendation to make the change. The ordinance already
allows illuminated signs along arterial streets. This amendment makes sense.
· Supported.
Lemke:
· Nothing to add. Agreed with staff.
Criego:
· Questioned staff if Pleasant Avenue is a collector street. Kansier explained
Duluth Avenue is the collector street and the difference between collector and
arterial streets. It has to do with the amount of traffic, access and size of road.
· Staff will work with the applicant to make sure there is no glare on Pleasant.
· Agreed with staff's recommendation. It is appropriate of this type of amendment
to the ordinance.
· Note to applicant: There are a couple of flood lights on the parish office that sends
glare onto Duluth and suggested correcting it.
MOTION BY LEMKE, SECOND BY RINGSTAD, RECOMMENDING CITY
COUNCIL APPROVE THE PROPOSED AMENDMENT WITH THE
MODIFICATIONS MADE BY STAFF.

C. Case//02-137 Consider an amendment to Section 1104.201 of the Zoning
Ordinance Reclassifying Jeffers Pond and an amendment to Section 1104.302
amending the lot size for Hass Lake.
Planning Coordinator Jane Kansier presented the Planning Report dated December 23,
2002, on file in the office of the City Planning Department.
The purpose of this public hearing is to consider two amendments to the Zoning
Ordinance. These are:
An amendment to Section 1104.201 reclassifying Jeffers Pond from a Natural
Environment Lake to a Recreational Development Lake; and
An amendment to Section 1104.302 of the Zoning Ordinance changing the minimum
lot area for lots within the Hass Lake Shoreland District from 20,000 square feet to
12,000 square feet.
Jeffers Pond is a 45-acre lake located at the southwest quadrant of the intersection of
CSAH 42 and CSAH 21. The DNR originally classified the lake as a Natural
Environment Lake in 1984. Recently, the City asked the DNR to reevaluate this
classification. In November, 2002, the DNR notified the City that the original
classification was based on outdated or erroneous data and that the Recreational
Development classification was more appropriate for Jeffers Pond. The purpose of this
item is to amend the table in Section 1104.201 of the Zoning Ordinance and identify
Jeffers Pond as a Recreational Development Lake.
The second amendment has to do with Hass Lake, north of The Wilds and south of
County Road 42. The Planning Commission reviewed a request to reclassify the lake
from a natural environment to a recreational development lake. The City Council
approved that classification in June and forwarded it on to the DNR. The DNR did an
extensive review and did not approve the reclassification of the lake, but they say based
on the lake's proximity to County Road 42, the existing development around the lake
should be under the recreational development classification. Based on the DNR
recommendation is add the "*" to the lot area for a natural environment lake. This would
only apply to Hass Lake. It does not apply to any other natural environment lake in the
City.
The Planning staff finds the proposed amendments consistent with the DNR action on the
classification of Jeffers Pond and Hass Lake.
Ringstad clarified the request and modification.
There were no comments from the public.

Lemke: · Questioned if the setback from the lake has to be maintained at the natural
environment level. Kansier said it did, which is 150 feet.
· Agreed with staff and support the recommendation to change the ordinance.
Ringstad:
· Agreed with staff and supported both recommendations.
Criego:
· Concurred.
MOTION BY LEMKE, SECOND BY RINGSTAD, RECOMMENDING CITY
COUNCIL APPROVE THE PROPOSED AMENDMENTS.
Vote taken indicated ayes by all. MOTION CARRIED.
